BOH minutes 6-22-2022 City of Beverly, Massachusetts Public Meeting Minutes Board: Board of Health Date: June 22,2022 Place: Beverly Council on Aging Building Suites A& B Board members present: Dr.Justin Jordan MD,William J.Alpine,Jr. Board Members Absent: Ms.Susan Higgins Others present: William Burke,Director of Public Health,Bruce Doig, Community Services Director, and Beth Oldmixon,Assistant Solicitor Recorder: Kathleen McCullough Dr. Jordan called the meeting to order at 6:30 p.m. The Board approved and accepted the minutes of the May 18, 2022 meeting. Updates to the Sale of Tobacco Products to be consistent with Mass State Law MGL Ch270, Section 6 and 105 CMR 665 were presented. Ms. Oldmixon was present to clarify the new changes after review. There is now a three day suspension for first offense whereas the city only fined the establishment. After four violations within 36 months there will be a hearing. There should be consistent suspension structure in all cities and towns to reflect the state regulations to be enacted by July lst. Dr. Jordan motioned to accept,Mr. Alpine seconded the motion. All in favor of the Sale of Tobacco Products changes. Mr. Burke will notify Joyce Redford of the progress of the meeting. Robert Howard has applied to have six chickens on his property at 1 Marion Drive. He already had the chickens but was unaware that he needed an animal permit. A site visit was made and the coop was at least six feet from line, the yard was well kept and there were no issues. Dr. Jordan motioned to approve, Mr. Alpine seconded. Officer Lipinski met with Katelyn Latouf of 11 Sylvan Road. He reported that the chickens were housed in the coop and the setbacks were five feet or better. Ms. Latouf had received a two month probationary permit in April. The formal permit will now be issued to expire the end of calendar 2022. Dr. Jordan motioned to approve and Mr. Alpine seconded. Chris Coulon and Andrew Bixby have requested a variance for Article 12, Sec. E body regulations requiring evidence of practice in body art. Mr. Coulon has been apprenticing at a body art establishment in Saugus but is now at Garden City Tattoo. He has completed two years of tasks in Saugus relevant to tasks required in Beverly. Mr. Alpine suggested the regulations should be updated to be in line with other cities and towns. Mr. Burke recommended a permit with restrictions. It will define apprentice tattoo under supervision and instruction with no micropigmentation or cosmetic tattooing. Dr. Jordan motioned to approve the variance. Mr. Alpine seconded the motion. Mr. Coulon will be given the variance with the restrictions. Mr. Burke had a few updates for the Board. He attended the City Council Budget Hearings on June I". It went well but Mr. Burke expressed his concern about employee retention. The Council replied that it is something that needs to be worked out with the Union. Mr. Burke thanked Kathleen McCullough for helping out in the office and covering for Clerk of the Board for meetings. He also thanked Pam Woodbury for staying late and coming in on Fridays to help with coverage. Ms. Woodbury and Mr. Burke conducted interviews for the vacant administrative assistant position on June 8 and 9. An offer was made to candidate Lynne DePiero, and she accepted. The anticipated start date is July 7t'. Ms. DePiero is currently working for the Council on Aging in a similar capacity. She comes with knowledge and experience with municipal finance and budget software. She is also familiar with our staff. The Health Inspector position remains vacant do to lack of experienced candidates. Mr. Burke had a conversation with Human Resources Director about looking for a second sanitarian position versus the health inspector. It is hoped that a sanitarian position will attract experienced public health professionals committed to the field. Human Resources will discuss the matter with the mayor. Camp inspections and beach water sampling is in full swing. Arts Fest was held, and the Farmers Market is ongoing every Monday with other seasonal food events to follow. Mr. William Alpine informed Mayor Cahill and the Board that he will be resigning his position that he has held with the Board for twenty years. He thanked the City of Beverly and the Board of Health for the opportunity to serve and especially proud of the work of the Board during the pandemic. Mr. Alpine motioned to adjoin the meeting.
