20220516 Regular City Council Meeting Minutest City of Beverly Regular City Council Meeting Public Meeting Minutes j Monday, May 16, 2022, 7:00pm City Council Chambers, 191 Cabot St. Julie Flowers, City Council President, called the meeting to order at 7:03pm, City Clerk, Lisa Kent, took the attendance by roll call. Members Present: Hannah Bowen, Steven Crowley, Kathleen Feldman, Scott Houseman, Estelle Rand, Todd Rotondo, Matthew St. Hilaire, Brendan Sweeney, Julie Flowers Members Absent: None Feldman led the pledge of allegiance. Comments by Citizens Neil Levine, 36 Thorndike Street, read a land acknowledgement statement and also read a statement in support of adding it to the regular agenda of the City Council and other actions the City could take. Wayne Miller, 5 Pasture Road, speaking on behalf of Green Beverly, noted the results of a recent PEW survey regarding climate change which emphasized the importance of reducing large-scale carbon dioxide pollution. He highlighted the urgency of the need for a whole of society approach and spoke about the importance of education and action. Bob Black, 438 Elliott Street, stated he lost front hedges, two trees, and part of the walkway and front lawn when Elliott Street was widened several years ago. Black stated he is not against bike lanes, but it would be good if there is still street parking. Black said he has a short driveway with only room for one car, so he would not be able to have anyone over or another homeowner with more than one car would not have a place to park their cars. No street parking makes sense from Cabot Street as far as Northern Avenue, but from Northern Avenue to Danvers is very residential and wide. Black asked the Council to reconsider eliminating parking on that end of Elliott Street. Gerry Perry, Budget Analyst for the City Council, stated this is a situation that has been ongoing since he has been here. The appointing authority should be doing the evaluation, and this will correct that. Perry thanked the City Solicitor for the language. Perry recommended adding language so that, by vote of the Council, the Council President could be delegated to be responsible for the evaluation. Houseman asked if this is supported by the administration. Perry stated he has not heard any negative feedback from the Mayor's Office and it has been reviewed by the Solicitor's Office. Public Hearings Order#135-7:30 PM-A Transfer of$17,510 from the Airport Enterprise Fund to Match a Grant for Fencing Bowen stated she is supportive of grants but always likes to hear and share with the public how this supports the airport operating budget and capital plan and asked about long term plans. Gloria Boullion, Airport Manager, stated both grants are from the DOT. The one for noise modeling had been denied before because the airport normally would not qualify for this, but it was received after persistence. The fencing is an ongoing project that will always need replacement. It will continue to occur over the next 10 years or so. Finance Director, Bryant Ayles, stated the vast majority of these grants are close to 95% funded through FAA and MassDOT. The airport has a five-year plan. There was some discussion about the noise mitigation studies. A motion to recess the public hearing on Order#135 to 7:55pm was made and seconded. A vote was taken, and the motion carried (9-0). Order#136-7:40 PM-A Transfer of$3,620 from the Airport Enterprise Fund to Match a Grant for Noise Model Analysis Ayles stated that the enterprise fund balance can afford both of these transfers. Rand asked about noise analysis and electric planes. Order#133-7:45 PM-National Grid Plan#30390943-Cabot Street Sibhita Mahabier, representative from National Grid, stated that this is to provide service to a light at this location. The hearing was closed, and the item was referred back to Committee on Public Services. Motions and Orders (Continued) Order#141-Proposed Ordinance Amendments Regarding Possession or Consumption of Alcohol on Public Ways, Public Places or on Private Property and Sandwich Board Signs Kent read the order. Public Hearines (Continued) Order#134-7:50 PM-National Grid Plan#21195878-Bayberry Lane Mahabier stated that this is to bring everything up to code. The hearing was closed, and the item was referred back to Committee on Public Services. A motion for a two minutes recess was made and seconded. A vote was taken, and the motion carried (9-0). Order#135-7:30 PM (7:55pm)-A Transfer of$17,510 from the Airport Enterprise Fund There was some discussion of the state and federal matches to the City's contribution. The hearing was closed, and the item was referred back to Committee on Finance &Property. Order#065-8:00 PM-National Grid/New England Power Company Petition for Transmission Line Franchise (Continued from 3/l/22, 4/4/22 and 4/19/22 meetings) Tim Averill, 165 Lothrop Street,thanked the City Council for all their consideration. Averill stated he is part of a group that has had a number of meetings. The group's key asks are that the City please implement a strong working group that can draft the conditions that ought to be followed in the memorandum of agreement and to ensure the working group has community representation. David Mahood, 191 Lothrop Street, stated that fossil fuel companies have been profiting at the expense of the planet for years. Mahood spoke on lobbying groups supported by utility companies. Beverly needs to transfer off of fossil fuels. Flowers noted some of the communications the Council had received regarding the project which is available on the city's website. Tim O'Leary,National Grid project manager, reiterated the need for this cable. This process started with the City in 2018, and the application went to the EFSB in June 2019. All this time, the cable is getting older and older and subject to failure. During that time frame, the MOA was discussed and went on for months until an agreement was decided with the City of Beverly. The Beverly City Council Meeting Minutes—Allay 16,2022 page 4 of 9 need for this is critical. The cable continues to have a reliability concern every week or month that goes by since it was approved by the Energy Facilities Siting Board in October, and it would affect not just Beverly but surrounding communities. O'Leary stated that National Grid did not put in the grant for a location earlier because the City asked National Grid to hold off to have some studies done,which was a very reasonable request. Then in February the application was submitted, and it is now May. National Grid is asking for a vote on this because we cannot wait much longer to start construction on this pivotal cable. There has been great reliability in this area, but there is a lot of work that goes on behind the scenes to make that happen. The main overhead cable is subject to Mother Nature, so a reliable underground cable is needed. We are trying to serve our customers. Jim Younger, 32 Butman Street, asked the City Council to take time to make the right decision. Feldman asked about increases in costs for work. In the agreement drafted a couple years ago, the figures associated with the cost of repaving the streets and what that would entail has really expanded with shortages, labor, and costs recently. Feldman asked if Commissioner Collins had worked on new numbers. Sweeney stated it has been discussed with Commissioner Collins. In section 10 of the MOU, subsection A,there is a provision that mentions that amount that National Grid will pay to the City for the relevant repaving work associated with this project. That figure is $2,750,000, which was agreed upon by National Grid and the City in March of 2020. Economic conditions have changed significantly since then, and the cost of routine paving in the City has gone up. Sweeney stated that is a matter he would like resolved going into any potential agreement. O'Leary stated that National Grid has looked at some of the paving costs and has been in discussion with Commissioner Collins. Bowen asked a related question about the consulting engineer, if the cost estimate of$200,000 would be enough and what in particular those who want to stay up to date will get.for I communication. Collins stated this path was chosen because it allows the City to bring in a consultant who has done this on other cable projects. This is someone who will be with the contractor every day. Collins stated the project website does have its own dedicated weekly email blast that they do from National Grid. If there are remarkable problems that require design changes,those can be discussed. Whether or not the amount is sufficient is a fair question; it also would depend on how long the project lasts. Rotondo asked for clarification on the King Street option. Rotondo also stated that some residents are concerned about foundations and asked about remediation and pre/post inspections. E O'Leary stated that National Grid will do a video survey of the roads, conditions, and outside of premises. In the letter that goes out, it says residents can call for an interior survey. It would typically be done a few weeks prior to construction, so that is an option for customers. The King Street alternative was a project alternative, not a route selection; King Street was a separate project that was looked at. It would have been 11 miles of overhead production through six communities, including wetlands. It was not feasible. Even if it was, it would still need to be underground once it came to Beverly for about seven miles. The EFSB found it was not feasible at all. Rand stated that electricity is key to the future for clean energy and asked how this project Beverly City Council Meeting Minutes—May 16,2022 page 5 of 9 i integrates with the future of clean energy. Danielle Aretz, who handles stakeholder relations and outreach for the project, stated there are generation plants which can come from a number of different sources. National Grid does not own generation because a company is not allowed to own all segments of the sector.National Grid procures that energy from the generation and moves it through the transmission system. The power that moves through transmission lines includes a variety of types of generation. Transmission brings the power from where it is made to where it has to go. Rand asked if there is a written plan on how National Grid is committed to that future and stated she would love to see percentages of where energy is coming from and the plan for moving forward. Aretz stated National Grid could get that information. As renewable energy comes online,that adds into the system. Mark Rielly,representative from National Grid, stated the company just recently announced a plan to be fossil free by 2050. Any discussion about climate change necessarily involves discussion of electrification. A very robust transmission system is needed to accomplish that electrification goal. Houseman asked about streets being repaved. The MOU does not include East Lothrop, Cross, or Boyle, which is basically the entire length of Ward 4. Houseman asked for confirmation that it is just an oversight and those streets will be taken care of. Rielly stated there was no intent to exclude those streets. Whatever street that was disrupted would be restored. The City would be paid and would complete the work. Houseman stated that legal notices have gone to property owners and asked how the process has or will be handled to make sure tenants are notified as well. Rielly stated that all notices for the siting board hearing went to each tenant. Aretz stated that for all notifications National Grid has not only the abutters list but also tenant information, so the property owners and current residents are included. Houseman asked what kind of proactive outreach was or will be done to make sure to identify residents who may have sensitive health issues that might require particular attention. Aretz stated that when National Grid goes door to door, they ask if there are any special concerns I and keep a list. There was some discussion around the balance between prompting people to consider medical concerns and respecting their privacy. Houseman stated in the document it says construction hours are lam- 4:30pm, but may include weekend hours as exceptions. If there are exceptions, advanced notice would be given to the city engineer. Houseman suggested adding some notice provision other than simply the city engineer and asked what can be done to provide better communication to residents. Aretz stated the main way to communicate with residents is to have them opt into the email blast because information is provided about construction for the week.National Grid does not do robocalls; it is basically through email. If there is enough notice, it might be possible to go to that specific area and leave notices on doors or do what has been done with other cities and towns which is working with the city's communications director to get the word out. Flowers opened the discussion back up to the public. Neil Levine, 36 Thorndike Street, asked about the sourcing of the local labor supply and looking at woman-owned, minority-owned, veteran-owned suppliers. On the National Grid website there is a supplier diversity and sustainability program that speaks to this. Levine asked what the relationship is between that program and this project. Rielly stated he did not have any specifics now but could find more information on this. Alyssa Rayman-Read, 163 Lothrop Street; spoke about wanting to move forward and understanding that it needs to happen. Rayman-Read offered to meet personally with any of the councilors who are willing to meet. There needs to be a new version of the MOA prior to granting any permits. Rayman-Read asked for a working group to create accountability to further answer some of the questions that are being raised and to work collaboratively on strong language that is enforceable. Rayman-Read referenced a correspondence that was sent with some draft ideas as a starting point. Flowers referred the item to a special meeting on May 23 at 6pm for conversation with outside legal counsel and discussion among the councilors. Shurdha stated that the police said he sold a Dodge Durango but it was the owner of Cabot Fuel who sold the Durango. Shurdha stated he did make the mistake of leaving a plate on from auction. It was an accident, and it is up to the owner to cancel plates. Shurdha stated the E police report said nothing about his name,just the plate. Shurdha stated he just sells cars and has nothing to do with the other business or the gas station. It is strictly a landlord/tenant relationship. It is up to the owner to get rid of plates. Shurdha stated he would get rid of them anyways but they were confiscated before then. s i Beverly Police Department Officer Erik Abrahamson stated he came across a vehicle with a plate that did not match. The gentleman was making the purchase from Alba Auto or Cabot Fuels; there is some type of business arrangement between them. This first individual that the police came across said they got the car from Jamal at Cabot Fuels who said to come back and get the title and the car would be "good for a couple weeks" until then. Mr. Shurdha has begun the process to get dealer plates, but there was someone driving a vehicle attached to the previous owner. It sounds like the vehicles to the right are Alba Auto's and the vehicles to the left may be Jamal's. This unsuspecting citizen who was allowed to drive off with the wrong plate could have been criminally responsible. Multiple plates were attached to vehicles they should not have been on. The plates did not belong to those vehicles and were plates that had been either revoked or cancelled. Rand called to order Committee of Whole at 9:19pm. Abrahamson continued that Mr. Shurdha was advised not to.put any other plates on other vehicles. Abrahamson stated he seized all plates he could at the time but could see one in the locked office that Mr. Shurdha said belonged to Cabot Fuel. Abrahamson stated he then went back the next morning and spoke to Mr. Orlando Ortiz who claimed to be the manager and mechanic. Mr. Ortiz was operating the gas pump and the same office area and said that was Alba Auto's office. It seemed like everyone was pointing fingers and said they didn't know their boss or coworker's names. Rand asked Officer Abrahamson if there is a process underway and how long that may take. Abrahamson stated that Mr. Shurdha did what he needed to get a license from the City and has applied for a dealer license and is possibly trying to do the right thing. There is a process from the registry that requires a state police inspection. The process is in motion. Abrahamson stated he does not know when someone would come to do the inspection. It says on the application it can take 4-10 weeks. Rotondo stated that it seems like Alba Auto is trying to do the right thing but the connection between the businesses is unclear. The Jeep the other business owner asked to put on his side of the parking lot. Assistant City Solicitor Beth Oldmixon stated the Council's options are to suspend or annul the license or to request that he come into compliance and clarify the business area. Abrahamson stated if the Council suspends the dealer license, the RMV would probably deny a dealer plate. It is probably better that he work towards doing the right thing rather than have the license suspended.
