2003-02-23City of Beverly, Massachusetts Public Meeting Minutes Board: Board of Health Subcommittee: Date: February 20, 2003 Place: Beverly Council on Aging, Arts & Crafts Room Board members present: Frank S. Carbone Jr., MD, Joseph W. Walsh Jr., and William J. Alpine Jr., Esq. Board members absent: Others present: William Burke, Director of Public Health, Tom Scully, Director of Community Services, Pat Zingariello, Public Health Nurse and Endicott College Student Nursing Instructor and Students. Recorder:Judith Balboni Chairman Carbone opened the meeting at 7:30 a.m. The minutes of the regular monthly meeting on January 23, 2003 were accepted as mailed. Mr. Burke introduced Colleen Clark, Instructor of Student Nursing at Endicott College and welcomed attending students to the meeting. An internship/rotation program has been setup for 7 student nurses to each spend three days in the Health Department observing the department’s community involvement. This is the second week of the program. Mr. Burke informed the Board that American Petroleum, 596 Cabot Street was fined $200.00 and rdth served two-day suspension on February 3 – 4 for a third violation of ‘Youth Access to Tobacco’ regulation in a twelve-month period. Pat Zingariello told members that plans and preparation are continuing for Community Wellness Day on April 5, 2003. Letters from sponsors and donations from local banks and civic organizations are being received. Pat has been receiving reimbursements from Medicare and other HMOs that were submitted after the fall flu clinics. A special fund has been set-up for insurance reimbursements. Phyllis Mondello introduced herself from Tobacco Control Coastal Collaborative for Youth Access. She applauded the Beverly Board for its positive part in Beverly’s tobacco regulations. She told what her job has been and how she carries out her compliance checks. She does site visits quarterly, hands out a specialized kit containing rules, signs, local and state regulations and a sample of ways to train new employees on screening patrons. Last month, some discussion took place regarding updating/amending the language in ‘Youth Access to Tobacco’ regulation and what the criteria might be in decision about changing regulations? It was put off until this month’s meeting. Copies of proposals for discussion, were Handed out by representatives of the Tobacco Control Collaborative. Chairman Carbone discussed proposals with board members. Section V-Violations and Penalties, A. to remain the same. B. first violation-change from a warning to $100.00 fine. Chairman Carbone motioned to change, Walsh second, all in favor to accept. Section III-Tobacco Sales to Minors Prohibited, F. Vending Machines, Chairman Carbone motioned to mirror the State’s regulations. Joseph Walsh seconded, all in favor to accept. Mr. Alpine asked for more time to take under advisement the language as is, to read state’s regulations and to come up with draft of new language. It can be put on agenda for next month’s meeting. The future is uncertain for Tobacco Control Program with the recent budget cuts. Representatives think they will be okay until June but are not sure of the programs existence come July 2003. We won’t know then how often compliance checks will be carried out or by who. Mr. Burke reminded the Board that Beverly was hosting another regional board meeting next Thursday, February 27, 2003 at 7 p.m. here at the Senior Center. Walter Montgomery from Northeast Massachusetts Mosquito Control and Wetlands Management District will attend. Representatives from Clean Air North will also attend. Chairman Carbone asked for a list of all Boards that will be attending and representatives names. Mr. Burke is still waiting for budget projection for FY2004 from administration. Projection was to be provided to departments by the beginning of February. If projection is available, a budget discussion will be added to March meeting agenda. Mr. Scully informed the Board there is a meeting today with Mayor. For now, he has said the health department has mandated requirements and remains safe. The administration is hoping to get employees to accept a 75/25 percent change rather than the current 90/10 percent in insurance payments. All labor unions must agree in order to be implemented. The next scheduled Board meeting is March 20, 2003. Meeting adjourned at 8:10 a.m. Respectfully submitted, Judith Balboni
