2003-03-20City of Beverly, Massachusetts Public Meeting Minutes Board: Board of Health Subcommittee: Date: March 20, 2003 Place: Beverly Council on Aging, Arts & Crafts Room Board members present: Frank S. Carbone Jr., MD, Joseph W. Walsh Jr., and William J. Alpine Jr., Esq. Board members absent: Others present: William Burke, Director of Public Health, Tom Scully, Director of Community Services, Pat Zingariello, Public Health Nurse and Kitty Hunt, Coastal North Shore Tobacco Control Program. Recorder:Judith Balboni Chairman Carbone opened the meeting at 7:30 a.m. The minutes of the regular monthly meeting on February 20, 2003 were accepted as mailed. Mr. Burke informed the Board that the Community Wellness Fair is in the final stages. The Cummings Center will be hanging a banner for us. The Salem News is providing an insert into the paper next week. We are still looking for door prizes. Pat has received Proclamation from Mayor. She has four entertainment participants and a promise for donation of hand-made quilt in a health theme by the Garden City Quilters. The elementary school children through the Dental Clinic are participating in an essay contest with a dental theme. Prizes and recognition will be awarded. The FY 2004 proposed budget was presented by Mr. Burke. Mr. Scully informed the Board of the overall economic conditions facing the city. The Health Department is mandated by law to perform numerous types of inspections. Some services may have to go, a user fee may have to be implemented. The 1994 fee schedule needs to be gone over, updated and most fees increased to cover associated costs. Other fees considered may be for re-inspections, user fees and fines for operating without permits. A motion was made by Mr. Walsh to accept the proposed budget as presented, seconded by Mr. Alpine, vote unanimous. Last month, talk of changes to Chapter 9A, Regulations Affecting Youth Access to Tobacco were held off until more time was had to consider new language. The new amended ETS Regulations will be going into effect August 1, 2003. The Board went over the “Super Dalton” model regulations proposed by the Tobacco Control and were taken into consideration and discussed by Board. The Board is in favor of prohibiting tobacco vending machines, removing the written st warning for a first offense violation, stiffer fines for violations, $100 for 1offense, $200 and a 7- nd day suspension of tobacco license for 2 offense within a two-year period and a $300 fine and a 30-day suspension for three or more violations within a 2-year period. License could be revoked completely if store is caught selling three times in one year to minor. The new terms will be straight forward and clear. New regulation is still incomplete but a new draft will hopefully be ready for April meeting. With recent and proposed budget cuts to Tobacco Control Program, compliance checks of stores may fall back to department. Kitty Hunt, Coastal North Shore Tobacco Control Program, applauded the Beverly Board for its positive part in Beverly’s tobacco regulations. On updates, Mr. Burke said the Regional Essex County Collection Network chose Clean Harbors (Safety Kleen) as vendor for 2003-2004 collection season for Household Hazardous Waste Collection. th April 26, Household Hazardous Waste Collection Day is all set for this year. Waste oil and electronics will not be accepted as in years past. Electronics can be collected at curb after a permit fee is obtained from Engineer’s office. Waste oil can be brought to the city garage on Park Street. North Beverly Plaza has a new food establishment, Baja Fresh which opened in the old Bruegger’s Bagel location. Pat Zingariello and Mr. Burke met with Ms. Mary Foley, DPH - Oral Health, to discuss the Dental Clinic in tight budget times. Mr. Burke told the Board that the $17,000 Delta Dental Grant should help with the dental hygienist salary. Pat Zingariello and Mr. Burke met with the new Domestic Violence Advocate from the Beverly Police Department to discuss possible future interactions. Mr. Scully asked Mr. Burke to do a follow-up on recent beach contaminants. The next scheduled Board meeting is April 24, 2003. Meeting adjourned at 8:30 a.m. Respectfully submitted, Judith Balboni
