1999-12-13PRESENT: ABSENT: PUBLIC: BEVERLY AIRPORT COMMISSION MINUTES OF THE REGULAR MEETING DECEMBER 13, 1999 Commissioners Bamico, Eaton, Farmer, Gourdeau, Lydon, Mahoney, Nelson, Rosen, Vitale, and White Commissioner Duval Ken Lewis, Dave Graham, Peter Simpson, Rene Mary, Ken Robinson, Mel Briggle, Victor Capozzi, Craig Schuster, and Greg Smart CALL TO ORDER: Chairman Farmer called the meeting to order at 7:30PM. 1. Readin4~ of the Minutes for November 8, 1999 - Chairman Farmer called for a reading of the minutes. Commissioner White made a motion to accept the minutes, seconded by Commissioner Gourdeau. Motion passed unanimously. 2. Readin~ of the Financial Report for October and November 1999 - Financial reports were not available due to the city's computer software conversiom OLD BUSINESS: Chairman Farmer told the Commission that the Old Business topics (GTE, Gon~as Property Acquisition, McLellan Relocation, Gumard Area, Taxiway "D"/Guidance Signs, Onmi RFP, Omni Remediation, Water & Sewer) were covered in the Airport Manager' s written report that was included in the meeting packets and he and/or the Airport Manager would discuss some of these subjects. GTE - Chairman Farmer reported that the GTE check for $62,500.00 has been deposited in the airport coffer and the new hangar tenants have taken possession of the hangars. Chairman Farmer also informed the Commission that the Beverly Police Dare van is being stored in one of the hangars for the winter. Gon4~as - Airport Manager informed the Commission that the Gongas' attorney was being sent (the next day) the Commission's iustmctious of not allowing them occupancy beyond 120 days from the date the city acquires title and that the they will pay market value rent 90 days from the date the city acquires title. Chairman Farmer asked for a consensus of the Commissioners; if they favored giving the Gongas' up to September 2000 to find another house and not to be charged rent. All but Commissioner Gourdeau favored not giving the Gongas' up to September 2000. Commissioner Gourdeau made the motion that the Commission not make a decision what to do until the letter is sent and BEVERLY AIRPORT COMMISSION MINUTES OF THE REGULAR MEETING DECEMBER 13, 1999 the Gongas' reply that they accept or do not accept the 120 day occupancy term. The motion was not seconded. Gumard AreafT Ford - Chairman Farmer informed the Commission of the meeting held the previous week with the B.A.C. Lease Subcommittee and Tom Ford and Mr. Ford's attorney. Commission Mahoney provided details of the meeting. One of the agreed to changes was Tom Ford would pay us approximately two-thirds of the rent during the demolition process. When they get the building permit they will pay the ~dl agreed upon amount, and that after the January 4th, 2000 ConCom meeting the proposed lease with Tom Ford would go before City Hall. Taxiway "D" & Guidance Sign Project- Airport Manager explained the engineering decision of FAA and M.A.C. to halt the "D" extension until spring (this same info was contained in the written airport manager' s report that was a part of the meeting packets). Stockpiled dirt piles were also relocated to avoid dirt blowing on parked Omni aircraft tiedowns. NEW BUSINESS: Omni Site RFP - Commissioner Vitale updated the Commission. Commissioner Viiale informed the Commission that a subcommittee decision will not be made until after the holidays (approximately the second week of January) and that the two proposers have also been informed. AIRPORT MANAGER'S REPORT: The Airport Manager's December 1999 report for the meeting was included in the commission packets. The Airport Manager updated the Commission on events that had taken place since the packet mailings; updates included: Omni Remedlation - Project is closed out. Cost for subsurface analysis was $4,200.00 and $1,300.00 for the Response Action Outcome (RAO). City Solicitor will initiate a lawsuit again~ Jim Rutherford to recover the cost. Commissioner Mahoney asked fithat was a fair price. Greg Smart of Smart Associates (E&K's environmental consultants) said it was a reasonable price. The Airport manager also said it was the least expensive of three submitted cost estimates. BEVERLY AIRPORT COMMISSION MINUTES OF THE REGULAR MEETING DECEMBER 13, 1999 Sewer Line - Airport Manager told the Commission that the sewer line was scheduled to be inspected December 15, 1999 and if okay sewer system could be activated. Also, ODF Contractors would clean up their construction mess. ODF suggested that Frank gillilea be approached to authorize the pavement work from the airport road to the airport administration building be reconstructed in the spring versus the trench patch that was done. Chairman Farmer said it was his understanding that ODF Inc. would approach Frank Killilea; Airport Manager Mezzetti said he would talk with Gary Milone of ODF. Airport Manager updated the Commission with November 1998 and November 1999 traffic counts. Airport Manager informed the Commission that he will be talking with Scott MacLeod at the next M.A.C. meeting about the FY00 land acquisition supplemental grant amendment and the latest airport 5-year C.I.P. and A.S.M.P. projects (E&K and Commissioner White will also attend). Airport Manager informed the Commission that he and Commissioner Barnico would be attending a Beverly Homecoming Committee meeting the night of 12/15/99. Patti LeBlanc of the Homecoming Committee had requested we attend to see if the Homecoming Committee could help the B.A.C. with funding in order to have another Homecoming Aviation Day. Airport Manager informed the Commission that the city computer system was Y2K compliant as was the emergency generator, airfield lighting, and Nayaids. CHAIRMAN/COMMISSION COMMENTS: Chairman Farmer requested the Airport Manager take video pictures of the condition and contents of NAA (East side) hangar and Yanai Sightseeing LLC hangar. Chairman Farmer informed the Commission that demolition company had been selected to demolish the Murrin/McLellan house, he also informed them of the trees on the Murrin/McLellan site are going to be cut down. Chairman Farmer told the Commission that the RW 27 fence lowering will be accomplished by the' Fonzo brothers to accommodate Liberty Publishing Company. 3 BEVERLY AIRPORT COMMISSION MINUTES OF THE REGULAR MEETING DECEMBER 13, 1999 Chairman Farmer also requested that Liberty Publishing be made aware of F AA requirements regarding building heights. Chairman Farmer showed an old photograph of the airport that he found at City Hall. It will be ~'amed and hung on the wall in the Airport Admin/Maint buildin4~. A current aerial photo of the airport will be sought and hung at City Hall. Chairman Farmer requested the Airport Manager look into the possibility of selling GTE pump house equipment. Chairman Farmer distributed copies ofprojaets and duties the Airport Manager has been involved in for Commission review. Chairman Farmer said he was open for suggestions as to how the Commission wants to do the evaluation. Chairman Farmer felt that for the coming year a work planning method be used. For fight now the evaluation would be based on the information handed out to the Commission. Commissioner Gourdeau asked the Airport Manager about a hand-operated vacuum that the Commissioner had obtained a brochure on. The Airport Manager had obtained pricing on a particular unit but would need to make future arrangements for a demonstration. Chairman Farmer said B.A.C. Chairman and Vice Chairman elections needed to be done. He said nominations could be taken ~'om the floor or a subcommittee could be formed and he asked what the Commission preferred. A poll was taken, all preferred ~'om the floor nominations. The Vice Chairman position was done first. Chairman Farmer made a motion to nominate Bruce Eaton for Vice Chairman, seconded by Commissioner Lydon. Chairman Farmer asked if there was any discussion. Commissioner Gourdeau said yes, that he would like to make a second motion to nominate Commissioner Vitaie. Commissioner Mahoney seconded the motion. Chairman Farmer said there were now two nominations for Vice Chairman. Chairman Farmer asked who was in favor of Bruce Eaton continuing as Vice Chairman. Chairman Farmer announced Bruce Eaton as the Vice Chairman. Chairman Farmer asked for a motion for the Chairman seat. Commissioner White made a motion nominating Mr. Farmer, seconded by Commissioner Lydon. Chairman Farmer asked if there were anymore nominations. Commissioner Lydon made a motion to nominate Commissioner Gourdeau for Chairman, seconded by Commissioner Rosen. Chairman Farmer announced that (he) Chairman Farmer would go first and called for a vote. Chairman Farmer then called for the vote for Commissioner Gourdeau. Chairman Farmer was re-elected Chairman of the Beverly Airport Commission. 4 BEVERLy AIRPORT COMMISSION MINUTES OF THE REGULAR MEETING DECEMBER 13, 1999 Chairman Farmer turned the floor over to Dave Graham ofEdwards & Kelcey Inc. Dave Graham updated the Commission on House Bill No. 3210 (the "Tree Bill"). Per Dave, the issue is essentially dead at this point. Someone had added an amendment that significantly "watered down" the bil/'s effectiveness, particularly how the bill affected private airports. M.A.C. felt it was not acceptable and asked that it be yanked, and per M.A.C. counsel go hack into it next year. Dave reported that the sales tax bill, House Bill No. H4837 is in good shape and it looks favorable to be signed by the government aRer February. Dave talked about the availabi/ity of airport web sites and that Bob Mezzetti will view what Edwards & Kelcey has to offer should BVY be interested. Bob will also see what the city's computer personnel might be able to do for the Dave ~ talked about a recent meeting with the airport and several comnuss~oners in which Smart Associates identified a host of environmental areas that DEP could call the airport (or any airport) to task on, and that Smart Associates could help with an environmental assessment if the airport was interested. E&K was also going to look into the possibility of including such an assessment in the upcoming Scoping EAfENF of Runway Safety Areas grant project and "Bromfield" funding. Commissioner Gourdeau asked about deer on the airport. If it becomes a danger on the airside portion, controlled huntin4; would be initiated. PRESENT: ABSENT: PUBLIC: BEVERLY AIRPORT COMMISSION MINUTES OF THE REGULAR MEETING DECEMBER 13, 1999 Commissioners Barnico, Eaton, Farmer, Lydon, Mahoney, Nelson, Vitale, and White Commissioners Duval, Gourdeau, and Rosen Ken Lewis, Dave Graham, Peter Simpson, Ken Robinson, Mel Bfiggle, Victor Capozzi, Craig Schuster, Tina Cassidy, and Rich Mello CALL TO ORDER: Chairman Farmer called the meeting to order at 7:30PM. 1. Presentation: Project Update, Dave Graham, Edwards & Kelcey Inc. - Dave Graham and Craig Schuster updated the Commission on the December 22, 1999 RSA EA/ENF Scoping Project (this was also covered in the Airport Manager's report). Dave mentioned that it was important that whatever RSA scenario was chosen that the airport have at least one 5000' runway. Dave mentioned the importance of getting the Chapter 5 AMPU information (Alternative Development Analysis) from Dufresne-Henry. The chapter contained needed information on rimway RSA alternatives. Airport Manager Mezzetti told the BAC that Dufresne-Henry was mailing Chapter 5 within the week. Craig Schuster reported that by the end of the week E&K planned on mailing out the draft EA/ENF Scope. Craig also mentioned that the airport should, within a week or two, make its selection of an independent cost estimator who would review E&K's proposed fee structure when they are submitted. Commissioner Bamico emphasized that the FAA and MAC were talked to in the case of a Modification of Standard alternative, that it was not the BAC's plan that if we stayed with RW 9/27 to do nothing for RSAs, that we will look at shifting RW 9/27 to get more RSA at end of RW 27 and getting as much RSA through use of retaining walls at end of RW 9, and we would also look to future improvements as funds became available. 2. Reading of the Minutes for December 13, 1999 - Chairman Farmer called for a reading of the minutes. Commissioner Nelson pointed out a typographical error on page 5, "Brom~eld' funding should be "Brownfield" funding. Commissioner Mahoney made a motion to accept the minutes, seconded by Commissioner Barnleo. Motion passed unanimously. BEVERLY AIRPORT COMMISSION MINUTES OF THE REGULAR MEETING DECEMBER 13, 1999 2. Reading of the Financial Report for December 1999 - Chainnan Farmer called for a reading of the financial report. Chairman White gave the financial report that included operations and maintenance and capital projects. Commissioner Mahoney made a motion to accept the financial report to audit, seconded by Commissioner Bandco. Motion passed unanimously. B. OLD BUSINESS: (covered in the Airport Manager's Report) NEW BUSINESS: · Omni Aero Maintenance Inc. - Request to Lease Tiedown Space Chairman Farmer referred this to the Omni RFP Sub-Committee. Hangar Interest - Knight Hawk Express Airport Manager Mezzetti reported the interest of Knight Hawk Express (charter) to construct a hangar with a footprint of 15,000 - 17,500 square feet. Mr. Mezzetti gave them the telephone number of airport FBOs that might have existing space and that, fithe FBOs cannot help them, to call him back and he could show them potential hangar development areas. Knight Hawk Express is not an air cargo operation. They have one Citation, one King Air and one ChieRain. AIRPORT MANAGER'S REPORT: The Airport Manager's January 2000 report for the BAC meeting was included in the commission packets. Commissioner Mahoney asked what Smart Associates EA/ENF environmental responsibilities that were listed had to do with their recently submitted $1,400.00 proposal for an environmental audit of the airport. Would there be a duplication of effort or is it two different things? Airport Manager Mezzetti said the environmental "audit" items were being included in the proposed project scope. Chairman Farmer said in that case, Commissioner Mahoney and Commissioner Barnico did not have to analyze the environmental "audit" proposal. The Airport Manager updated the Commission on events that bad taken place since the packet mailings; updates included: · GTE Fire Pump Room - Airport Manager reported that Mr. Peter Sherman (who did the current installation for GTE) is not optimistic about a market for BEVERLY AIRPORT COMMISSION MINUTES OF THE REGULAR MEETING DECEMBER 13, 1999 GTE pump house equipment that might be sold fithere is no need for the current reservoir system, now that city water is available. Given there are two systems, primary and backup, Chairman Farmer wants to know if we can take out one of the systems with no problem. Survey - Hancock Survey has staked the comers of the former Murdn/McLellan property. Also an airport property marker was found to be located in the middle of Mr. Durkee's private road. Chairman Farmer wants to talk about what the BAC wants to do with the information. Beverly Homecoming Aviation Day - Airport Manager reported on a meeting held with the Homecoming Finance Committee (at the request of Phyllis LeBlanc). The committee said they could probably give the BAC $1,200.00 to get a parachute demonstration team drop, money for approximately (6) six portable toilets and a (2) two member police detail for eight or ten hours. The finance committee suggested an auto parking fee that would be split between the BAC and the Homecoming Committee. The BAC could use its share to offset material and service costs for the event. Commissioner Barnico questioned a parking fee for a public parking lot. Commissioner Banrico told the BAC that the Homecoming Committee was very pleased with last year's '~thrown together" aviation day and suggested than any future events be advertised further in advance. Commissioner Bamico told them he would put it before the BAC regarding paid parking and concessions. Cb. airman Farmer suggested the BAC put together an Airport Homecoming Aviation Day Committee and asked Commissioner Vitale if he would be the Chairperson. Commissioner Viiale agreed. Chairman Farmer stressed keeping FBOs and other airport members informed. Commissioner White and Nelson agreed to be on the Aviation Day Committee. Tom Ford Final Draft Lease - Airport Manager Mezzetti reported receiving the proposed final draft that had the approval of the Tom Ford Lease Subcommittee. The Airport Manager recommended the full Commission give the Lease Subcommittee the go ahead to process the Ford lease. Commissioner Lydon made a motion that the Commission authorizes the Lease Subcommittee to proceed with the lease approval process, seconded by Vice Chairman Eaton. Motion passed unanimously. BEVERLY AIRPORT COMMISSION MINUTES OF THE REGULAR MEETING DECEMBER 13, 1999 CHAIRMAN/COMMISSION COMMENTS: Chairman Farmer told the Commission of the letter sent to the Gongas' giving them until January 22, 2000 to decide fithey would sell their house and property otherwise the airport would seek an avigation easement. Chairman Farmer told the Commission of Vice Chairman Eaton's suggestion to put a RFP together to place survey points on airport property boundaries. Vice Chairman Eaton said the various FBO leaseholds could also be delineated. Chairman Farmer asked for a motion for Vice Chairman Eaton to put together a RFP to pick up perimeter points ~'om our existing paperwork, Commissioner Lydon made the motion, seconded by Commissioner Barnico. Motion passed unanimously. Chairman Farmer expressed concern of a real estate sign placed along airport property, apparently in the City's Right of Way. City Planner, Tina Cassidy, explained that it was allowed, however, it was unusual in that such signs are typically on private property. Chairman Farmer also expressed concern that other city departments e.g. the Police Department and the School Department, when given permission for a particular activity, go beyond what was agreed to, and that it had to stop. Chairman Farmer also said that per the Airport Manager, FAA says that other municipal departments that use airport property must pay reasonable rent and the BAC must look into that. · Chairman Farmer said it was a question of respect, that in the case of the sign, the real estate company should have talked with the airport. · Chairman Farmer also questioned why some properties under the Beverly ConCom's jurisdiction are not cleaned up. Commissioner Lydon suggested that the person who is selling property come forward and get information on what FAA says can or cannot be done on the property. City Planner Tina Cassidy said Airport Manager Mezzetti sent the developer information on required notilieation to FAA and that she would send the site plans to BAC for their review. Chairman Farmer told the Commission that one of the Fonzo brothers had said they were interested in building a couple of houses in that area and that he (Chairman Farmer) told him that FAA would need to know that.
