2002-08-22City of Beverly, Massachusetts Public Meeting Minutes Board: Board of Health Subcommittee: Date: August 22, 2002 Place: Beverly Public Library, Program Room Board members present: Frank S. Carbone Jr., MD, Peter Hersee and Joseph W. Walsh, Jr. Board members absent: Others present: William Burke, Director of Public Health, Thomas Scully, Director of Community Services and Pat Goelhert, Tobacco Control Collaborative. Recorder:Judith Balboni Chairman Carbone called the meeting to order at 7:30 a.m. The Board reviewed and accepted the minutes of June 11, June 27 and August 8, 2002. Mr. Burke updated the Board on several issues. Mingo Beach had to be closed on August 8, 2002 due to high bacteria counts. It was reopened on August 16, 2002. Yesterday the weekly tests were repeated, results should be available later today. Mr. Hersee mentioned the recent correspondence to Stop & Shop on Enon Street regarding nighttime deliveries. He suggested reviewing past Board of Health minutes and/or correspondence to clarify delivery hours agreed upon. Mr. Burke and Ms. Zingariello, Public Health Nurse met with Jack Good from Beverly Hospital regarding plans for a local Community Wellness Day. A tentative date April 5, 2003 has been chosen. Mr. Burke informed the Board that a part-time inspector has been helping with the restaurant and retail food inspections. No administrative actions at this time. nd Recent compliance checks by Tobacco Control found two establishments in violation for the 2 time and two establishments were first time violators. One-Stop Market on Cabot Street and A-1 Sunoco on Brimbal Avenue will receive notices of $100 fines. White Hen Pantry and Rapid Refill Convenience will be sent warning notices. It was suggested that subcommittee of Boards of Health continue regional meetings in the future, expand discussion to common issues like WNV, beaches, ETS, etc. There seemed to be an interest from surrounding cities and towns with continuing the regional format. In the next order of business, Chairman Carbone addressed the members and others in attendance regarding ETS regulation. The Board is not going to rescind any portion of the Regulation but their main goal is to protect persons at their workplaces. It is not the Board’s intent to stamp out smoking. The Board wants to be fair to the private clubs, as well as, the restaurant and bar owners, before making their decision. One of the questions asked, how private is private? Peabody recently referred to MGL Chapter 180 regarding licenses of private clubs. Should we assume that all the private clubs are in good standing with the law? It seems that many questions have surfaced. What is an associate or temporary member? What are bar privileges? Mr. Hersee feels the board should listen to the private clubs and get facts on memberships and temporary memberships. Mr. Walsh agreed that more information from the clubs would be helpful. The Board directed Mr. Burke to meet with a representative and visit each private club in Beverly over the next two weeks prior to a special meeting that will be held to discuss this information and allow the board to draft language to regulation that will be fair to all. Variances previously allowed are due to expire on August 31, 2002. Mr. Hersee motioned for month-to-month extensions until decision on regulation made. Mr. Walsh seconded. Vote in favor. The next regular monthly meeting is scheduled for September 26, 2002. The meeting was adjourned at 8:10 a.m. Respectfully submitted, Judith Balboni
