2002-09-10City of Beverly, Massachusetts Public Meeting Minutes Board: Board of Health Date: September 10, 2002 Place: Beverly Public Library, Program Room Board members present: Frank S. Carbone Jr., MD, Peter Hersee & Joseph W. Walsh Jr. Board members absent: Others present: William Burke, Director of Public Health, Thomas Scully, Director of Community Services and Pat Goelhert, Tobacco Control Collaborative. Recorder:Judith Balboni Chairman Carbone called the meeting to order at 7:30 a.m. The purpose of this special meeting was to have extra time to visit private clubs, learn more about their membership process and help the Board in drafting language for new Environmental Tobacco Smoke Regulation. Chairman Carbone asked Mr. Burke for his report on observation/visit of private clubs. Mr. Burke met with representatives from five of the seven private clubs. He was assured that they all have key card entry. All function areas were physically separated from bar areas and were smoke free. Mr. Burke was told there were no instant memberships granted. Some clubs offer associate/courtesy memberships. They can use facilities but are restricted from holding elected offices and voting. Some have a limit on number of associated members based on percentage of their regular membership. Most only allow one guest per visit and limit that to a couple visits. The guest cannot stay if member leaves premises. Smokers attending functions are not allowed to enter club area to smoke. Chairman Carbone would like to see public areas posted with universal no-smoking signage. He also spoke of putting the private clubs on warning that Beverly wants a total ban and that any abuse of regulations will not be tolerated. Mr. Hersee suggested delaying action until August 2003 when other surrounding communities will take effect. He questioned the handling of variances, suggested variances be extended to the August 1, 2003 enactment date pending compliance with original stipulations. After some discussion, Chairman Carbone motioned to accept the current draft of tobacco regulations, based on Clean Air Works, except for private clubs and to go into effect August 2003. Motion seconded. Vote unanimous. Summary of Regulation will be posted in newspaper. The Department of Public Health will be notified. The next regular monthly meeting is scheduled for September 26, 2002. The meeting was adjourned at 7:50 a.m. Respectfully submitted, Judith Balboni
