2001-07-19City of Beverly, Massachusetts Public Meeting Minutes Board: Board of Health Subcommittee: Date: July 19, 2001 Place: Beverly Council on Aging, Arts & Crafts Room Board members present: Frank S. Carbone Jr., MD, Norman Spector and Peter Hersee Board members absent: Others present: William Burke, Director of Public Health, Thomas Scully, Director of Community Services, Joseph Reale, Environmental Analyst and Pat Zingadello, Public Health Nurse. Recorder: Judith A. Balboni The meeting was called to order at 7:30 a.m. The Board reviewed and accepted the minutes of the June 7, 2001 meeting. In the first order of business, Ms. Jane Militello, Senior Care, Inc. requested a variance from the Food Code, Manager Certification Requirement. Ms. Militello reports that all food arrives pre- packaged. No food handling other than dispensing, done on site. Senior Care Inc. holds 6-month and 1-year training programs for all employees. They also do routine health checks on employees. Daily food temperatures are taken. Department of Public Health and Food & Drug support this variance. After a brief discussion, Mr. Hersee motioned to accept, Mr. Spector seconded; Board approved request. The second order of business came from Joe Boccia, Director of Camp Mitchrnan requesting variance from State Sanitary Code; Chapter V, Minimum Standards for Swimming Pools, Antivortex Main Drain Cover. The pool was constructed in the 1950's and has two very large drains located in fifteen feet of water. Mr. Reale discussed the issue with Mass. Dept. of Public Health, Division of Community Sanitation which concurred that an antivortex drain cover would not be needed, if even possible. Motion by Mr. Spector to approve variance, Mr. Hersee seconded. Bruce Patten representing Tuck Point Condominium Trust requests a waiver from the lifeguard requirement. There are no children residing on premises, there is a Certified Pool Operator. Chairman Carbone requests that in the future waivers should be requested well in advance of pool season. Board will take under advisement. Board discussed request with Joe Reale. Tuck Point pool does not have a self-closing and self- locking gate to pool. Board approves variance with condition that appropriate gate is installed. On the agenda next were five restaurants requesting renewal of the Environmental Tobacco Smoke Variance. Variances were granted for one year and will expire on August 31, 2001. The restaurants represented were: Freddie's Restaurant, Kitty O' Shea's, Cracker's Pub, Harry's 240, and Beverly Depot Restaurant. Chairman Carbone stressed that menus should be kept to incidental, suggesting maximum $6.95 as guide. Mr. Burke discussed with the Board, compliance checks and any other issues if present. No petitioner was found to be in violation during the recent compliance check. Chairman Carbone stated to the applicants that the Board will be revisiting the issue as soon as this fall. Peter Hersee motioned to approve requests with Norm Spector seconded. Board accepted. Mr. Burke gave the Board a brief update on issue with Laine Chase, 63 Ober Street. Mr. Burke and the Board discussed the Salem Board of Health's issue with smoking regulation and getting together with other close communities to work together on a Regional approach. Meetings have been taking Place regarding Grants from Delta Dental and Monroe E. Trowt Award;.a High School-based Health Clinic and licensing of Dental Clinic. Mr. Burke, Sue Pelletier, Dental Hygienist and Pat Zingariello, Public Health Nurse have all been attending and keeping updated on process. Pat Zingariello reported to the Board that the Web page is near ready. She is pleased with the outcome. As part of the "Ban the Burn" sun safety grant, Pat has been presenting information on sun safety and skin cancer to staff members of the Recreation Department and along with "Troodles", the clown she did a presentation for children enrolled in programs thru the Recreation Department. She also distributes 'handouts' as she inspects the summer camps along with Diane Kurkjian, Code Enforcement Inspector. Next scheduled meeting is August 23, 2001.
