2001-10-18City of Beverly, Massachusetts Public Meeting Minutes Board: Board of Health Subcommittee: Date: October 18, 2001 Place: Beverly Council on Aging, Arts & Crafts Room Board members present: Frank Carbone, Jr., M.D, Norman Spector and Peter A. Hersee Board members absent: Others present: William Burke, Director of Public Health, Patricia Zingariello, Public Health Nurse and Thomas Scully, Director of Community Services. Also present, Pat Goelhert and Kitty Hunt from Tobacco Control Program. Recorder: Judith Balboni. The meeting was called to order at 7:35 a.m. The Board reviewed and accepted the minutes of September 13, 2001 meeting as mailed. Mr. Burke introduced Mr. Salim Uddin, owner of Lil Peach, 160 Essex Street who was asked to be present to discuss the following matter. On September 24, 2001 the Coastal North Shore Boards of Health Tobacco Control Collaborative conducted tobacco sales compliance checks for the Beverly Board of Health and found this establishment sold to a minor, thus violating the Board’s Chapter 9A, Regulations Affecting Youth Access to Tobacco. Our records indicate Lil Peach is a repeat violator. The penalty for a third violation is a fine, up to $200 dollars and suspension of the Tobacco Retailer’s Permit for a period of at least 2 but no more than 5 days. Mr. Uddin accepted responsibility for the violation. The employee was a family member, new to this country with a language barrier problem. The Board stressed that he needs better educate the employees. Chairman Carbone thanked him for attending and would take under advisement. Next on the agenda was Walgreen’s, 54 Elliott Street. District Manager Ann O’Herren, and Manager Doug Shelton were asked to be present to discuss their fourth violation within 24 months of Board’s Regulation Chapter 9A. The penalty for a fourth violation is a fine, up to $300 dollars and a suspension of Tobacco Retailer’s Permit for period of at least 30 days but no more than 90 days. Ms. O’Herren told the Board that Walgreen’s has a district wide training program. Mr. Shelton is a new store manager as of June. He told the Board that the person who sold was a new employee and had not been properly trained. They now have a new policy in place regarding training. The Board will take under advisement. Mr. Robert Jerrin approached the Board with proposal for new ETS regulations and some concerns with the present regulation. The Board informed him that all ETS issues and discussion of new regulations would be taken up in the New Year as well as a public hearing. The Board would welcome his proposal at that time. Mr. Burke updated the Board on the Flu Clinic planned for October 23, 2001. The Health Department has 550 doses to give out. Mr. Burke introduced Ms. Kathy McCullough to the Board. Ms. McCullough is the new part- time clerk in the Health Department. The Board discussed issue of Walgreen’s. Motion made to suspend tobacco sales permit for 30 days and fine them $300 dollars. Seconded, and vote unanimous in favor. Board voted to fine Lil Peach $200 dollars and suspend tobacco sales permit for 2 days. Mr. Burke and Ms Zingariello have been attending meetings regarding the school-based health clinic. The date for the Regional Wellness Fair at Salem State College has been changed to April 28, 2002. Ms. Zingariello conducted the Employee Wellness Day at City Hall on October 4, 2001. The staff is monitoring various web sites for bio-terrorism information. Several regional informational meetings with state public health and safety officials are being planned. Next meeting scheduled is November 15, 2001.
