Walsh, Jr. BOARD OF HEALTH - MONTHLY MEETING - MARCH 1. 1973 Meeting called to order at 6:30 p.m. Members present were A. Joseph Callahan, Jr., and Angelo R. Massa. Also attending were Joseph W. Walsh, Jr., Director; Thomas Bussone II, Assistant City Solicitor; Leo L. Panunzio, Milk and Food Inspector; and Ernest Curelli, Sanitarian. The minutes of the February 1, 1973 meeting were accepted as mailed. The monthly bill schedules were signed and the monthly reports of the various staffmembers were read. OLD BUSINESS Sanitarian' s Exam The Director read the following letter from Civil Service to the Board of Health: "February, 25, 1973 Dear Mr. Walsh: Your request for thc addition of a Certification Requirement in connection with the examination for Sanitarian, Beverly Health Department, has been received. After careful consideration; it is my decision that this request be denied. The examination announce will, therefore, be issued in the form previously submitted. Very truly yours, (signed) Mabel A. Campbell Director of Civil Service By: (signed) Bernard T. Sexton Assistant to the Director" 72-18260 The Director asked the Board to request the Law Department to appeal the decision of Civil Service to deny our requested certification requirement for the position of Sanitarian for the City. The Board on a motion made and seconded voted to request the Law Department to appeal the decision of Civil Service deleting the registration requirement fi'om the Sanitarian's flyer. Clinics The Director told the Board that he was planning with the Lions Club another Lazy-eye or Amblyopia Clinic for pre-school children. The clinic is being tentatively scheduled for the last week of April and will be of a four-day duration and will be held at the First Baptist Church. Mr. Walsh explained to the Board that he was planning, with the Kiwanis Club, to co-sponsor a hearing clinic for Beverly residents. This clinic tentatively scheduled for the middle of May for a four-day period. The Board accepted these reports as informational. Music Theatre The Director read the following letter from Mr. C. Henry Glovsky, Attorney and President of the North Shore Music Theatre to the Board. "February 21, 1973 Gentlemen: I am writing on behalf of North Shore Community Arts Foundation, which operates the Terrace Restaurant during the summer at the North Shore Music Theatre. We are having considerable difficulty in finalizing plans, and accordingly, respectfully request an extension of an additional year within which to install toilets on the premises. Your helpfulness in this regard will be appreciated. Sincerely yours, C. Henry Glovsky (signed) The Board deferred action on their request until the April meeting. Sonny's Lunch The Milk and Food Inspector reported to the Board that Mr. Anthony Pelosi, owner of Sonny's Lunch, located at 392 Cabot Street, Beverly, Mass. had sufficiently improved his toilet facilities as outlined by him to the Board of Health during our last meeting. Mr. Panunzio explained that the renovations were not completed but that the work already finished was to his satisfaction. The Board accepted this report and on a motion made and seconded voted to take no further action. The Director reported to the Board that 27½ and 29 Vestry Street and 28r Cabot Street had been demolished by Kanter Realty Trust and in compliance with our demolition request to the Realty Trust. The Director told the Board of Health that the decision in the case of Kanter Realty Trust vs. City of Beverly was rendered in the Board of Health's favor. The Superior Court upheld the District Court's decision, but decreased the fine from $500.00 to $250.00. The Assistant City Solicitor discussed with the Board the merits of having the Board of Health or Building Inspector demolish derelict buildings within the City. The Board discussed several options available and instructed the Director to meet with the Building Inspector and Code Inspectors to initiate action on the following three vacant dwellings: 14 Ropes Street, 9 Central Court, and 11 Central Court. The Board told the director to make all requests to the Building Inspector in writing and request his opinion to be returned to the Board in writing. The Board of Health on a motion made and seconded voted to authorize court action against the owners of the following pwperties: 85 Hale Street, 3 Charles Street, 11 Access Road and 126 Dodge Street. The Director to submit a progress report at the April meeting. Combined Collection of Garbage and Rubbish The Director reported to the Board that the publicity campaign to notify the residents of the City of our new collection program has been increased and begivnlng on March 1, 1973, and continuing until March 12, 1973 advertisements notifying the citizens will be in either the Salem News or Beverly Times. Mr. Walsh explained that the Milk and Food Inspector and the Sanitarian are distributing to the chain stores and large shopping areas copies of our handout pamphlet and posting our newspaper advertisement in the stores. The Director reported that he had been interviewed by Station WMLO who is going to do a series of announcements during the coming week and that WESX had told the Director that beginning today (March 1) they will do a series of news spots and announcements informing the citizens of our new collection program. The Director told the Board that the department had utilized all means available to them to publicize the combination of garbage and rubbish program. Mr. Walsh explained to the Board of Health that the mass mailing to all householders within the city and newspaper advertisements cost the city approximately $925.00 which in comparison with neighboring communities who are presently converting to the same collection systeu, was very inexpensive. The Board of Health accepted this report as one of progress. NEW BUSINESS Masseur License The Director asked the Board of Health for permission to request the Law Department's Assistance to formulate rules and regulations for massage, manicuring, or vapor baths. Mr. Walsh noted that several communities are presently challenging these masseurs or vapor bath establishments after they had begun operation. The Director explained that he would like to establish guidelines for licensing these establishments before rather than after they have begun operation. The Board of Health discussed the Director's request and on a motion made and seconded voted to approve the drafting of Rules and Regulations for massage, manicuring, or vapor baths. School Health Policies The Director submitted to the Board for their appwval a guide for school health policies submitted by Ethel L. Turenne, RN and Elizabeth T. Scoglio, RN, the Public Health Nurses, and approved by Dr. Salvatore P. Gemmellaro, Medical Director, for the Board of Health. Included within the school health policies are the following five items needed to support the nursing activities in the City's parochial schools. ADOPT: Regulations by Department of Mental Health and Department of Education to school age children in special education classes - namely, the mentally retarded and the "emotionally disturbed" and the Department of Public Health regulation #5-b; Chapter 71, Section 57, General Laws of Education. ADOPT: Policies of the Division of Sanatoria and Tuberculosis Control regarding child-centered tuberculin testing program. ADOPT: Massachusetts Department of Public Health immunization procedures. ADOPT: Regulations for Physical Examination of School Children in Massachusetts. ADOPT: "A Guide for Developing Policies for Handling Health Emergencies at School" recommended by the Massachusetts Department of Public Health. The Board of Health discussed the proposed School Health policies and on a motion mede and seconded votedl to accept the school health policies with the following five (5) Health Rules and Regulations: ADOPT: Regulations by Department of Mental Health and Department of Education to school age children in special education classes - namely, the mentally retarded and the "emotionally disturbed" and the Department of Public Health Regulation #5-b; Chapter 71, Section 57, General Laws of Education. ADOPT: Policies of the Division of Sanatoria and Tuberculosis control regarding child-centered tuberculin testing program. ADOPT: Regulations for Physical Examination of School Children in Massachusetts. ADOPT: "A Guide for Developing Policies for Handling Health Emergencies at School" recommended by the Massachusetts Department of Public Health. Transient Fruit Peddlers The Director requested permission from the Board of Health to seek assistance from the Law Department in the drafting of Health Rules and Regulations pertaining to transient or mobile vendors operating within the City. These regulations would include stopping on city streets or parking on private property. The Board discussed the Director's request and on a motion made and seconded voted to grant the director's request. Food Handlers Training Program The Board of Health approved the suggestion of the Milk and Food Inspector that an educational program is needed for all food service establishment personnel working within the City and on a motion made and seconded voted to authorize the Director and Milk and Food Inspector to institute as soon as possible a Food Handlers Program.
