Walsh, Jr. BOARD OF HEALTH - MONTHLY MEETING - AUGUST 3 1972 Meeting called to order at 6:10 p.m. Members present were R. Massa and A. J. Callahan, Jr., members. Attending were Joseph W. Walsh, Jr., Director; Thomas Bussone II, Assistant City Solicitor; Thomas Clark, Beverly Times Reporter. Minutes of the July 6, 1972 meeting were accepted as mailed. The bill schedules were signed, and the monthly reports of the staff members were read. OLD BUSINESS 138 Livingstone Avenue The Director reported to the Board of Health that Mr. James A. Dooling III, owner of 138 Livingstone Avenue was notified by registered mail of the Board's decision of July 26, 1972 and re- affirmed on a motion duly made and seconded and so voted at this meeting to deny his request to re-occupy for the purpose of providing live-in caretaker to curb vandalism. Mr. Walsh further reported that he has been checking the property twice daily and has observed two cars parked in the yard. The Director told the Board that he has already discussed with Mr. Thomas Bussone II, Assistant City Solicitor, court action against Mr. James A. Dooling IIl for re-occupying 138 Livingstone Avenue before connecting said dwelling to the municipal sewer. Mr. Walsh reported that he has met with Mr. Edward Aucone, Chief of Police, and he had requested that the midnight to eight a.m. patrol check the property to determine whether or not the above-mentioned cars were parked over-night. The Director told the Board of Health that once it has been established by the police department that Mr. James A. Dooling III was allowing his premises located at 138 Livingstone Avenue, Beverly, Massachusetts to be re-occupied, that he (the director) will request the law department to get an injunction from Superior Court barring James A.. Dooling III from re-occupying the premises until it is connected to the municipal sewer. Mr. Walsh to submit another report at the September Board meeting. School Dentist Mr. Walsh reported to the Board of Health that he had met with a representative of Civil Service regarding our appointment of a part-time dentist from the eligibility list as sent to us from Civil Service list and failure to do so would result in our termination of the other four (4) provisional part-time dentists. The Civil Service representative explained that to fulfill our obligation to Civil Service that we would only have to retain the interested party one (1) morning a week and by doing so could retain the other four part-time dentists. The Board of Health on a motion made and seconded voted unanimously to affirm their decision of July 26, 1972 and hire Doctor Richard S. Helman, 2 Scribner Road, West Peabody, Massachusetts for Tuesday mornings during the 1972-73 school year. Glaucoma Clinic Mr. Walsh reported to the Board of Heaith that the statistics are complete regarding referrals for further examination of 18 people who attended our Glaucoma Clinic which was held on April 22, 1972 and that there were 3 diagnosed cases of Glaucoma, 5 others were referred for further examination for other eye problems, and 10 were examined and cleared of any symptoms of Glaucoma. The Board accepted this report as final. Change of Occupancy Statistics Calls from Gas Company 184 Permits issued 55 Temporary permits issued 5 Permits refused 2 Permits refused held over 13 Referrals 0 Inspections: A. Ventresca: 50; R. Montoni: 6; A. Semple: 4; E. Curelli: 2 Mr. Walsh reported to the Board of Heaith that during the past month over 12,000 notices were mailed to Beverly residents to make them aware of our Change of Occuapncy Permit regulation. The Director informed the Board of Health that the office has been receiving calls from concerned citizens regarding their obligations to fulfill the requirements of our regulation. The Director explained that the mailing was needed because the Code Inspectors were having a difficult time with the owners of multiple family structures who occupied one of the apartments and rented the other apartments and had not been aware of our regulations. He further explained that before the permits went into effect all owners of more than one parcel of property as recorded in the Assessor's Office were sent a copy of the regulation and a copy of Article II of the State Sanitary Code. The Board accepted this report as a final report. Adoption of Plastic Plumbing Pipe for Multiple Family Houses Mr. Walsh reported that he had written to the HUD Regional Office in Boston regarding our obligation to adopt the use of plastic pipe and what federally funded programs we would lose for failure to adopt the regulation and as of this date had not received a written reply from them. He told the Board that he had written to the State Board of Examiners of Plumbers and received the following reply: July 17,1972 In answer to your letter of July 11, 1972, please be advised as follows. I am enclosing a sample form letter which will be sent to you with proper signature if and when the Health Department of Beverly requests the variance from this Board. I believe you will find the form letter is self explanatory. The findings of this Board, relative to the use of PVC and ABS beyond a one family dwelling, were made in two separate written reports to Governor Sargent through the Secretary of the Cabinet of Consumer Affairs, Mr. William I. Cowin. We are not at liberty to release these reports unless directed to by that office. If you wish, however, you may contact Mr. Cowin directly regarding this matter. (signed) Irving J. Risi, Executive Secretary Board of State Examiners of Plumbers The Director explained to the Board that he had sent a letter to Mr. William I. Cowin, Secretary of the Cabinet of Consumer Affairs and a copy to the Governor's office requesting a copy for public distribution, of the report as submitted to them by the State Board of Plumbing Examiners. Mr. Walsh reported that as of this date he had rot received a reply from either office. No action was taken by the Board of Health until copies of the State Board of Plumbing Examiners report to the above-mentioned parties is made available to the Board of Health for them to study. Transfer Request of plumbing Inspector Mr. Thomas Bussone, Assistant City Solicitor explained to the Board that he had not completed this report relative to the transfer of Mr. Robert Russo, Plumbing Inspector, to the Building Department and request a two-week extension. The Board granted Mr. Bussone's request and tabled further action until after they have received the assistant City Solicitor's report. NEW BUSINESS Massage License Mr. Walsh explained to the Board that Mrs. Margaret G. L. Haight of 32 Buffum Street, Salem, Massachusetts has applied for a license to do massage in a local nursing home. The Director reported that she was a licensed practical nurse since 1936, and had been doing massage work from the same time. Mr. Walsh told the Board that she was presently licensed in Salem and had shown a current LPN Registration. The Board, on a motion made and seconded, voted to grant the license to do massage to Mrs. Margaret G. L. Haight of 32 Buffum Street, Salem, Massachusetts. 11 Garden Street (see minutes May 1971) Mr. Walsh read the following letter from Mr. Leonard F. Roberts, 12 Rowell Avenue, Beverly, Massachusetts: "In the last year I have spoken with you several times about the odor from a cesspool. The cesspool which is located on Garden Street in Beverly. On the property of Albert Thomas of 11 Garden Street, Beverly, Mass. It appears you and Alderman Ash and Mayor Grimes can find nothing to do about this matter I have have now contacted Ken Tarbell of the Massachusetts Health Environmental Dept. who suggested I write you a letter to get some action on this odor I have to put up with. Mr. Tarbell tells me that accordance with the State Sanitary Code, Regulation 2,19 of Art. XI states Discharge to Surface of Ground: No sanitary sewage or industrial waste shall be allowed to discharge or spill onto the surface of the ground or to flow into any gutter, street, roadway or public place; nor shall such material discharge onto any private property. Also, he stated you have full authority to take action by Regulation 2.10 of Article XI which states: Connection to common Sanitary Sewer. Individual sewage disposal systems or other means of sewage disposal shall not be approved where a common sanitary sewer is accessible in an abutting way and where permission to enter such a sewer can be obtained from the authority having jurisdiction over it. The Board of Health may require the owner or occupant of an existing building or buildings wherever a common sanitary sewer is accessible in an abutting way to cause such building or buildings to be connected with the common sanitary sewer in a manner and within a period of time satisfactory to the Board of Health. Mr. Tarbell has asked me to submit a second copy of this to his attention Your prompt action on this matter will be appreciated. The Director explained to the Board that we had discussed this problem last year and though Alderman Eugene Ash had a sewer estimate proposal submitted by the City Engineers for $5,100.00 and Alderman Ash then submitted an order to the Board of Aldermen requesting a $5,100.00 appropriation to correct the problem, there were no results. Mr. Walsh stated that he had checked with the Clerk of Committees on the status of the order and was informed that it was not transferred to this year' s city government. The Board, after discussing the problem, ordered the Director to investigate the possibility of connecting via an easement through the Robert's property to the municipal sewer on Rowell Avenue and report his findings at the September meeting. Plumbing Inspector Vacation Replacement Mr. Walsh informed the Board of Health that Mr. Albert Grant, our substitute plumbing inspector, was because of illness, unable to be Mr. Russo's vacation replacement this year. The Director explained to the Board that Mr. Russo had another plumber, Mr. Vernon Cormier, to be his replacement this year. The Board discussed the temporary appointment and on a motion made and seconded voted unanimously to approve the temporary appointment at a salary of $150.00 per week of Mr. Vernon Cormier. The Director explained to the Board that Mr. Philip Dunkelbarger ,the City's Recycling Expert had called two meetings in July for the purpose of discussing new methods of recycling our refuse. The first meeting was to discuss a new method of converting sorted refuse into a material that could be used as substitute for top soil. The other meeting was called to discuss the drafting of a letter of interest to the Aenco Company of Deleware, that would not bind or obligate the city of Beverly to join in the proposed venture, for the purpose of doing an in-depth study of the solid waste generated by the City of Beverly, Peabody, and Salem, and the Towns of Danvers and Middleton and for the company to determine whether or not their proposed plan is practical. Mr. Walsh read to the Board a letter sent to the Board of Health from Mr. Robert Curtis, Danvers Town Manager, who has an alternate proposal to submit to the City or Town governments of Beverly, Salem, Peabody and Middleton for a privately operated regional solid waste facility which would be located in Danvers. The Director explained to the Board that both proposals were just proposals and that the City of Beverly was not at this time committed financially to either proposal. The Board accented this report as one of progress. Housing Code Enforcement Records Mr Walsh informed the Board of Health that a Mr. Wayne G. Sharpe Jr. assistant Treasurer of the Cambridge Savings Bank has requested for his bank a list, if any, of Housing Code Enforcement violations for the following Beverly properties: 18-20 Simon Street 42-44 Simon Street 30 Grant Street 3 Gage Street 47-49 Simon Street 33 Mill Street 25 Bennett Street The Board, after discussing this request, instructed the Director to ask for a written request from the Cambridge Savings Bank stating just what information they desired relative to the above mentioned properties.
