Walsh, Jr. BOARD OF HEALTH - MONTHLY MEETING - October 10, 1972 Meeting called to order at 6:30 p.m. Members present were Dr. Jacob H. Fine, Chairman; Angelo R. Massa and A. Joseph Callahan, Jr. Also attending were Joseph W. Walsh, Jr., Director, Thomas Bussone, Assistant City Solicitor, Paul Hayworth, Managing Editor of the Beverly Times. The minutes of the September 14, 1972 meeting were accepted as mailed. The monthly bill schedules were approved and signed and the monthly report of the various staff members were read and approved. OLD BUSINESS 138 Livingstone Avenue (See minutes September 1972) The Director reported that Mr. James A. Dooling, HI, owner of 138 Livingstone Avenue was ordered by the court to connect his dwelling to the municipal sewer by October 26, 1972 and he was further ordered by the court to keep the premises vacant until the dwelling is connected to the municipal sewer. Mr. Walsh told the Board that a report of any further action taken by the court will be presented at the November Board meeting. The Board accepted this report as one of progress. Change of Occupancy Permit Statistics Calls from Gas Company 141 Permits issued 62 Temporary permits issued 14 Referrals 1 Referrals (held over) 13 Miscellaneous and calls not covered 64 11 Garden Street (See minutes September 1972) The Director read the following communication from Mayor Herbert F Grimes: "September 22, 1972 Beverly Board of Health Joseph W. Walsh, Jr., Director City Hall Beverly, Massachusetts Joseph W. Walsh, Jr., - Gentlemen: In response to your letter of September 18, pertaining to required sewer connection at 11 Garden Street, Beverly, Massachusetts please be advised Commissioner of Public Works has been directed to take the necessary steps to make this connection with all possible speed following proper City requirements. Money is available in existing account. Yours very truly, (signed) Herbert F. Grimes, Mayor The Board accepted this report as a final report. Combined Collection of Garbage and Rubbish (See minutes Sept. 1972) The Director read the following communication from Mayor Herbert F. Grimes: (Letter to Board of September 22, 1972) Item 2. Relative to your letter of same date, September 18, pertaining to refuse collection on joint basis; please be advised that the City will be prepared to make said joint collection upon to the expiration of existing contracts in March of 1973, and to run on a trial parallel basis on the first of February. My office, as well yours, should institute and perpetuate a proper public educational program in this matter. In conversation with Mr. Walsh, it is agreed he will recommend the inclusion of necessary funds under the category "COLLECTION OF GARBAGE" in his budget as usual, with the full expectancy this money will ultimately be cut with the successful implementation of joint collections, by the City. Very truly yours, (signed) Herbert F. Grimes, Mayor The Board of Health instructed the Director to work on a new announcement and other educational material available. Mr. Walsh to cheek other avenues of publicity available to the Board and submit a report to the Board at the November meeting. The Board of Health instructed the Director to send a letter to Mayor Grimes asking him to clarify his statement regarding "Parallel collection" of garbage and rubbish by the private contractors and the City of Beverly. Centerville Sewer Survey Report The Director reported to the Board that the Mayor has acknowledged receipt of our letter to him relative to the sewering of the Centerville section of the City. Mr. Walsh further reported that the Mayor will release a general statement to the local press, but not the report itself. The Director also reported that the Mayor had given him a copy of the easement status report which was included in a recent mailing to the Board Members. Mr. Walsh told the Board that he had notified as requested by the Board, Mr. Robert Russo, Plumblug and Sanitary Inspector, in writing of their request of bi-monthly reports from him of conditions in the Centerville section of Beverly. The Board of Health accepted this report as one of progress. Plumbing Inspector Transfer Request Mr. Thomas Bussone, Assistant City Solicitor, read to the Board the law department's memorandum regarding Mr. Robert Russo, Plumbing and Sanitary Inspector's request to be transferred from the Board of Health, to the Building Department. The Board of Health discussed the law department's memorandum and on a motion made and seconded voted unanimously to request from the law department a written legal opinion as to the feasibility of such transfer and the reasons, if any, for refusing said transfer. This opinion to be submitted to the Board prior to the November meeting. The Beverly Board of Health shall vote at the November meeting on Mr. Russo's request and shall give the reasons for approving or disapproving the request, at that time. Housing Code Enforcement Records The Director reported to the Board that he had been contacted by Mr. Wayne G. Sharps, Jr., Assistant Treasurer of the Cambridge Savings Bank relative to the Board's policy regarding the release of Housing Code Enforcement Records. Mr. Walsh told the Board that he had referred the Cambridge Savings Bank, and its Attorney to the City Law Department. The Board accepted this report as informational. Horse Permit The Director reported that the petitioner, Mr. Luis Masforroll of 759 Hale Street, Beverly Farms, MA. had not filed for a zoning variance as of this date. The Board tabled indefinitely any further action until the petitioner had fulfilled all the zoning Board of Appeals requirements. Sanitarian Exam The Director reported to the Board that he had contacted Civil Service to determine if the Civil Service Sanitarian's examination announcement was ready and if the test date for the Sanitarian's position had been established. Mr. Walsh reported that the flyer for the position should be sent by Civil Service to the Board of Health for approval within two weeks. The Board accepted this report as informational. Health Conference The Board of Health on a motion made and seconded voted unanimously to send the Director of Public Health to the Health Officers Conference which will be held at the Wychmere Harbor Club in Harwichport, Massachusetts and to reimburse him for his expenses. The Board of Health on a motion made and seconded voted unanimously to have Mr. Leo L. Panunzio, Milk and Food Inspector, replace the Director in his absence. Red Tide Episode The Director read to the Board of Health Mr. Leo L. Panunzio, Milk and Food Inspector's report of his action taken on Septamber 14, 1972 regarding his placing of an embargo on all soft shelled clams being sold in Beverly and how this embargo was completed by 6:30 p.m. of the same day. The initiative shown by Mr. Panunzio by placing the embargo is commended by the Beverly Board of Health. Therefore, the Beverly Board of Health, on a motion made and seconded, voted unanimously to commend Mr. Leo L. Panunzio for an excellent job. 1973 Budget The Board of Health will meet October 19, 1972 to review the Health Department's 1973 budget as proposed by the Director. Morgan Acres Sub-Division The Director read a letter from the Inspector of Sewage Disposal Systems to the Board of Assessors regarding certain building lots which were found to be unsuitable for sub-surface disposal systems. The lots are 1, 6, 7, 8, 9,12,16 and 17; the report further states that no testing was done on lots 3 and 5 and that lot 18 was suitable for the installation of an approved system.
