1996-10-28MINUTES OF THE ORDINANCE REVIEW COMMITTEE REGULAR MEETING The Ordinance Review Committee met on Monday, October 28, D96, at 7i30 p.m. in the Clerk of Committee's Room, Third Floor, City Hall, Beverly, MA. PRESENT: Crystal Atherton and Gem/Padsella. ABSENT: Mary Grant, Tom Alexander, Roy Gglineau, Arthur Powell and Elizabeth LeBrun. Geny Parisella and Crystal continued reviewing the documents enti~ed "Administrative Organization" containing 47 pages. We made notes in the margins with questions and issues to be shared with Atty. Curran and the other members. We spent considerable time discussing the duties and powers of the office of City Accountant and the office of Budget/Management Analyst. The statutory powers are specffically separated in the Charter in Article 9, Transitional Provisions Section 9.6 Time of Taking Effect (i): The Charter separates the duties of the Auditor under our old Charter into two specific functions, the position of Budget/Management Analyst performs the functions outlined in Chapter 4!, Sections 50, 51, 53 and 54A and the new position of City Accountant performs the functions as ou~ined in C. 41, Sections 52, 56, 57, and 58. We read all of the sections in the Charter that relate to the Budget Analyst position as follows: Section 2-8 Officers Elected by City Council. (A) Budget/Management Analyst Seelion 9-6: Time of Taking Effect (a) Section 9-6 (I). Time of Taking Effect. We should bring these sections to the attention of Atty Curran for the draf[ing of the ordinance for these two positions. Gerry and I agreed that the ordinanee as it presently exists for the position of City Auditor is repealed by the new Charter. Cheek with Mike as to the ordinance draped for City Auditor??? Gerry and I also discussed who the appointing authority is for the positions in the Finance Department? We agreed that all the appointees are "city officers" and · concluded that these positions would be appointed by the Mayor and not the new depadment head, Director of Finance. Run this by Mike too! Concerning the draft of 47 pages that we have been reviewing, Crystal made the following observations to bring to the attention of Atty. Curran in drafting new ordinances: Page 17: G.A.R. Hall Commission. The building was a gift to the City and was used in the past as the Senior Citizens Center. Since the new Senior Citizens Center was built, the hall has been used for rental purposes and is the offices of the Veterans Agent. Please note that two members of the senior citizens of the city were on the Commission only because of its use as a senior center. Since they no longer use this building, there is no reason to have two senior citizens on this Commission. According to the Veterans Agent the North Shore Red and Gun Club meet monthly, the Police Department has training sessions there, veterans groups meet there. Jerry and I agreed that the following Commissions were established by a state statute and their purpose, duties and powers and membership would most likely be dictated by that statute. C. 40 RegisWars of Voters M. G. L. C. 51 We looked at the duties and responsibilities of the Collector/Treasurer and ask the following questions: (1) See. 2-192 custody of contracts. Why would the collector has custody of all city contracts. The CPO has these contracts and by statute is required to provide the Auditor and the City Clerk with all city contracts. See. 2-194 "City collector-treasurer, under the direction of the standing committee on finance and property, shall keep an accurate and tree account of all receipts ..." Question, now that the Council has its budget/m~nagement analyst to perform the post audit functions and report to the Council, would this statement still be true? Sec. 2-197.
