MEETING OF THE
BEVERLY ORDINANCE REVIEW COMMITTEE
The regular meeting of the Beverly Ordinance Review Committee was held
on September 9, 1996, in the Council Meeting Room, Third Floor, City Hall,
Beverly, MA. Meeting was called to ordered at 7:30 P.M.
PRESENT: Mary Grant, Gerry Parisella, Crystal Atherton, Roy Gelineau
ABSENT: Elizabeth LeBrun, Arthur Powell, and Tom Alexander
Mary Grant told the Committee that she had reviewed the draft ordinances for the
Public Safety Division and Municipal Cede Inspections. Mary said she would make
notes concerning the questions the Committee had and send them to Mr. Curran for
his review and comment at our next meeting.
The Committee reviewed the draft on the deparlment of Human Resources. The
following are some of the comments and questions raised at this meeting concerning
the Human Resource Deparhttent. Under Purpose (B) 4. The wording "reasonable
effort" gives no teeth to the ordinance. B (5) It was suggested that the word "sex"
be changed to "gender" however, this may be a term that complies with Federal and
State Statutes. Committee feels that some tool for performance evaluations should
be set up by ordinance. Under Scope of Department Activities No. 4, who sets City
Salaries? Crystal pointed out that most of the city employees are members of a
union and the tinion sets up a Grade system by contract. Department heads,
Assistant Department heads, confidential secretaries and a few people who have not
accreted into a union, do not have any specific salary structure. It appears to be
"what the market can bear". Roy Gelineau expressed concern about the working in
No. 7 "so as to insure the payment of equal compensation for equal work". What is
the standard to determine what equal compensation for equal work is? He
suggested that we use the words "to insure the payment of equitable compensation."
Paragraph 11 (c) Does this mean that the director must attend all negotiating sessions
and is this inconsistent with present collective bargaining agreements in place?
Section C Paragraph 13. It is suggested that this paragraph require that the Director
maintain all personnel files in a central place. Department heads should be required
to copy all documents to the Director that effect an employee's personnel records.
Section c Paragraph 14. This paragraph appears to be too broad. What type of
safety program? It is occupational safety requirements that this paragraph should be
addressing?
Under qualifications, it is the Committees belief that a person with experience of
three years in the field of Human Resources should be considered. Section (D)
paragraph (3) strike the word "the" in the third sentence. So that the paragraph
reads "serving in said department".
Sub-paragraph 1. The Committee suggests that this paragraph contains some
language suggesting that these procedures be done in accordance with all existing
collective bargaining agreements presently in effect.
Sub-section 2. There is a concern about the wording "the existing high standards"
but Crystal pointed out that this language is taken directly from the section on
Human Resources in the Charter (see Article 5-7 Department of Human Resources.
Sub-paragraph 2.
Sub-section 5. Should this paragraph be more specific and suggest that an employee
handbook by developed.
Roy agreed to draft a letter to Atty. Curran pointing out our concerns as they relate
to the Human Resource Ordinance.
The next scheduled meeting will be had on Monday, September 23, 1996 at 7:30 at
City Hall. Atty. Curran will be at this meeting and Crystal has invited Tina
Cassidy, the Planning and Economic Development Director and Tim Brennan, the
Municipal Code Enforcement Director to attend.
Upon motion duly made and seconded, it was
VOTED: to adjourn.
