BOARD OF HEALTH - MONTHLY MEETING - MARCH 4. 1971
Meeting called to order at 6:35 p.m. Members present were A. J. Callahan, Jr. and Angelo R. Massa.
Also attending were Joseph W. Walsh, Jr., Acting Director; Leo Panunzio, Milk and Food Inspector,
Robert Russo, Plumbing Inspector; John Christie, Beverly Times Reporter, and Richard Montoni and
Alfred Semple, Code Enforcement Inspectors.
The minutes of the February 1, 1971 meeting were accepted as submitted. The monthly reports of
the various staff members were read. The bill schedules were signed.
OLD BUSINESS
Dunkin Donuts
The following is a report from Leo Panunzio, Milk and Food Inspector, regarding his inspections of
Dunkin Donuts for the Month of February.
"During the month of February 1971, I re-checked the premises at 411 Cabot Street, Dunkin Donuts,
on six different occasions. On one inspection, I brought Mr. Walsh with me. The owners have
indicated a desire to co-operate and have thus far initiated an attempt to do so. They have engaged
a cleaning firm to maintain the facilities and re-paint the walls and ceiling. The firm at this writing is
now under a contract with Dunkin Donuts.
They have agreed to paint the walls in the food preparation area, scrape and seal storage floor area,
put in new racks in storage area, replace wood chopping block, provide better protection for food
in refrigerator, weekly clean all the filters in the establishment and various other cleaning duties. A
temporary license has been issued to the establishment (30 days).
My feeling is the Board should proceed as per the last month, i.e. continue the re-inspections to the
point of full compliance".
The Board of Health on a motion duly made and seconded voted to accept Mr. Panunzio's report as
one of progress.
138 Livingstone Avenue
The following is a report from Mr. Robert Russo, Inspection of Sanitary Sewerage Disposal Systems,
regarding the charge of effluent from a septic tank located at 138 Livingstone Avenue, Beverly,
Massachusetts:
"As requested by the Board of Health, I am submitting this letter to notify the Board members of one
of the conditions that exists at 138 Livingstone Avenue, owned by James A. Dooling
Approximately three years ago, I was asked by the Health Department to make a dye test at the
above-named property. The results of the test proved positive, the effluent from the septic tank at138
Livingstone Avenue is piped directly into Bass River
Mr. T. H. Scanlan was a witness to this test."
Mr. Robert Russo, further explained that the owner of 138 Livingstone Avenue would have to install
a lift station which would be located outside of the dwelling and that the municipal sewer was
available.
After a brief discussion, the Board of Health on a motion duly made and seconded unanimously voted
to order the owner of 138 Livingstone Avenue to connect to the municipal sewer within ninety days.
Pre-School Vision Screening Clinic
Mr. Joseph W. Walsh, Jr., Acting Director of Public Health, told the Board that the clinic was
scheduled for the week of April 12-16, 1971 and would be at the First Baptist Church. He further
explained that the Beverly Lions Club, Young Mothers of the First Baptist Church, Beverly
Kindergarten Association, Beverly Visiting Nurses Association, are actively working with the Health
Department in planning this very important clinic.
Mr. Walsh told the Board that the Advisory Board consisted of twenty-five people and one meeting
was held February 10, 1971 and the next Advisory Committee meeting would be March 11, 1971.
The Board accepted this report as one of progress.
Code Enforcement Keports
Mr. Richard Montoni, Code Enforcement Inspector, told the Board that he has instituted court
proceedings against Thomas Santamaria, owner of 48 Bow Street and 62 Cabot Street, Beverly, as
both structures have been in violation of Regulation 12.1 of Article II of the Massachusetts Sanitary
Code: "lack of two means of egress". He has also filed complaints against Mr. W. David Crosby,
owner of 39 Railroad Avenue and 11 Access Road and Mr. Ronald Davis and Mr. Ronald Summitt,
owner of 23 Simon Street. These above listed properties have numerous violations of Article II of
the State Sanitary Code.
Mr. Montoni further stated that he had "condemned 23 Simon Street and has ordered the tenants to
vacate the premises for their own safety. I have taken legal action because of the lack of landlord
initiative to correct the violations".
Mr. Montoni reported that 23 Simon Street had a very serious wiring defect on the furnace and that
it should be corrected immediately to protect the safety of the occupants.
After considerable discussion, the Board of Health instructed Mr. Walsh to check with the legal
department for an opinion as to whether the Board of Health had the right to correct the electrical
violations as reported by Mr. Richard Montoni and bill the owners by putting a lien on the property.
The Board of Health also instructed Mr. Walsh to send a letter to the tenants of 23 Simon Street
ordering them to vacate the property for their own safety.
Mr. Richard Montoni suggested to the Board that they should look into the possibility of adding a
re-location officer to the code enforcement division of the Board of Health. He commented that the
Board of Health evicts people, then they are responsible for relocating them into a safe, decent, and
sanitary apartment."
The Board took Mr. Montoni's suggestion under advisement.
Mr. Richard Montoni to compile a list of the properties owned by Kanter Realty Trust that are either
vacant and/or in violation of Article II of the Massachusetts Sanitary Code and submit the report at
the April Board meeting
Drug Appropriation
Mr. Joseph W. Walsh, Acting Director, reported that if the $2,500.00 was appropriated to the Board
of Health for drug rehabilitation assistance, Project RAP has requested that it be expended to pay the
salary of the professional counselor who runs two encounter group sessions a week. Mr. Walsh
further reported that an opinion was forthcoming from the City Solicitor regarding the legality of the
appropriation and we should wait for his opinion. The Board of Health tabled further discussion until
the Board of Aldermen appropriate the money, then they will discuss the setting of the necessary
guidelines before expending any monies for drug rehabilitation.
NEW BUSINESS
Horse Permit Request
Mr. Walsh read the request of Mr. Ralph Leonard, Jr. to keep three or four horses on his propetty
located on Old Rubbly Road, Beverly. Two immediate abutters, Mr. Vincent Martucci and Mr. &
Mrs. Leonadic Philipedes have submitted written letters approving Mr. Leonard's request. The Board
instructed Mr. Walsh to notify the people who live on Robinson Road of Mr. Leonard's request and
report his findings to them at the next Board meeting. The Board tabled Mr. Ralph Leonard's request
until the April Board meeting.
BOCA Rehabilitation Code
Mr. Alfred J. Semple, Code Enforcement Inspector, suggested to the Board that they should study
the BOCA Residential Rehabilitation Code and decide if it could be adopted for use in Beverly.
The Board of Health took Mr. Semple's suggestion under advisement.
School Payment
The Board discussed the request from Mr. Joseph W. Walsh, Jr., and Mr. Leo L. Panunzio for
financial assistance from the Board to pay for courses being taken by both of them at North Shore
Community College, Beverly. The Board informed the other inspectors that if they wanted to attend
Public Health Courses to submit their request for payment to the Board in writing and the Board will
act at that time on their request.
Annual Report
The Board of Health accepted the 1970 Annual Report as mailed.
Custodian of the Records
The Board of Health on a motion duly made and seconded unanimously voted to make Joseph W.
Walsh, Jr., Acting Director of Public Health, custodian of the Board of Health Records.
Fees for Certified Copies of Records
The Board of Health on a motion duly made and seconded voted to charge a fee of one dollar per
page for a Board of Health record that has to be certified.
Relocation
On a motion duly made and seconded the Board unanimously voted to approve the mayor's request
to move the Board of Health Office from its present location to Rooms 21 and 23 which are located
on the second floor.
Board of Health Agents
On a motion duly made and seconded the Board of Health unanimously voted to make Mr.
Richard Montoni and Mr. Alfred Semple, Agents of the Board of Health.
Senior Clerk
Joseph W. Walsh, Jr, submitted a letter from Miss Paula Clancey requested that she be promoted
from Junior Clerk Typist to Senior Clerk Typist. Mr. Joseph W. Walsh, Jr., Acting Director,
recommended the Board that they write a letter to Mayor Herbert Grimes
requesting that Miss Clancey be promoted.
The Board of Health instructed Mr. Walsh to write a letter to the Mayor requesting that Miss
Clancey be promoted to Senior Clerk Typist.
Cesspool. 858 Hale Street
Mr. Robert Russo, Inspector of Sanitary Disposal Systems, reported to the Board that there was
not any evidence of overflowing sewerage at this time and he will re-check the complaint later this
month and report his findings at the April meeting.
The Board of Health went into executive session, with staff present for the purpose of discussing
the organization structure of the department
All staff were requested to submit letters if they wished to be upgraded in their job classification.
"Gentlemen:
This letter is in reference to our conversation of February 1, 1971 at the monthly meeting of the
Board of Health. In answer to the Board's request relative to my acceptance of the position of
Sanitarian, I would like to re-affirm my feelings relative to this promotion.
I feel that this letter can fill any voids left by that conversation.
As I stated that evening my acceptance of the position was contingent basically on the granting of
a grade change in the job classification scale under the Yarger Plan. Presently, as Milk and Food
Inspector, my grade is listed as Grade 16; Sanitarian also carries a grade of 16, so obviously, a change
of position in itself offers nothing in financial gain. A two-step grade increase would be acceptable
to me. Consider, gentlemen, my position without the grade change: an entirely new field of endeavor;
broader responsibilities and a net loss of three dollars ($3.00)
per week, in as much as my automobile allowance would drop $150.00 for the year! As you readily
agreed at the Board meeting, my request for grade change is justified.
I would hope in your correspondence with those individuals responsible for affecting such a change
in grade you would convey these aforementioned thoughts.
If those in authority i.e. Board of Health, the Mayor, Legal Affairs and Accounts Committee, and
Board of Aldermen agree to such a change, then of course we would have a situation agreeable to
all.
I would appreciate your making this letter a part of the Board's permanent records.

WHEREAS, Thomas H. Scanlan has for the past twenty-nine years been Director of Public Health
for the City of Beverly, and
WHEREAS, the said Thomas H. Scanlan has retired, the Beverly Board of Health desires to spread
the following resolution upon the minutes:
RESOLVED, that we recognize the excellent, energetic and intelligent service that Thomas H.
Scanlan has rendered to the City of Beverly during his incumbency. We feel that through his wisdom
and personal efforts, the Board of Heaith has attained a reputation of providing immeasurable service
to the community.
RESOLVED FURTHER, that in recognition of his services to the citizens of Beverly, the aforesaid
Thomas H. Scanlan enjoy his retirement and send warmest regards to both Thomas H. Scanlan and
his family.
FURTHER, that the secretary of the meeting be requested to transmit these resolutions to Mr.
Thomas H. Scanlan as a testimonial of the esteem and respect in which he will always be held by his
former associates.
