Walsh, Jr., Sanitarian Recorder: Joseph W. Walsh, Jr. BOARD OF HEALTH - MONTHLY MEETING - FEBRUARY 1, 1971 Meeting called to order at 6:30 p.m. Members present were Dr. Jacob H. Fine, Chairman; A. J. Callahan, Jr.; and Angelo R. Massa. Also attending were Acting Director, Joseph W. Walsh, Jr.; Leo L. Panunzio, Milk and Food Inspector; Robert Russo, Plumbing Inspector; Richard Montoni and Alfred J. Semple, Code Enforcement Inspectors. The minutes of the January 4, 1971 meeting were accepted as mailed. The monthly reports of the various staff members were read and the monthly bill schedules were signed, OLD BUSINESS Pre-school Vision The pre-school vision screening clinic report was referred to the March meeting. 138 Livingstone Avenue Retreat house at 138 Livingstone Avenue, Beverly was referred to the March meeting. NEW BUSINESS Dunkin Donuts Mr. Leo L. Panunzio, Milk and Food Inspector, requested that Mr. Anthony Triantafillou, owner of Dunkin Donuts located at 411 Cabot Street, Beverly, appear before the Board of Health to discuss numerous violations of Article 10 of the Massachusetts Sanitary Code and his company's problems in being able to maintain the health and sanitary conditions required by this regulation. After considerable discussion the Board, on a motion made and duly seconded, unanimously voted that a thirty (30) day temporary Food Service Permit be issued to Dunkin Donuts and this permit's renewal is subject to further inspection by the Milk and Food Inspector. In addition, this thirty (30) day Food Service Permit will be issued over the next several months or until the Milk and Food Inspector determines that a permit of longer duration can be issued. Sanitarian The Board discussed the possibility of appointing a provisional Sanitarian to fill the position vacated by Joseph W. Walsh, Jr. until a promotional Civil Service examination can be requested. The Board requested Mr. Walsh to obtain more information as to the proper procedure needed to be followed and report his findings at the March meeting. North Suffolk Legal Assistance Assn. Mr. Walsh sent a copy of the letter to each Board member and requested Mr. Thomas Bussone, assistant City Solicitor, to meet with the Board to render an opinion as to whether we have to honor this request for copies of all our Code Enforcemant Inspection Mr. Thomas Bussone "cited that the law department does not define these records as public and that it would hinder the day-to-day operation of the Board of Health". Mr. Bussone suggested that we refer Mr. Bernard J. MacCallum, the attorney for several tenants in Gloucester Crossing area to him and he will consider answering any specific questions that Mr. MacCallum might ask. Board told Mr. Walsh to work with Mr. Bussone in this matter and that between the two of them answer the letter from the North Suffolk Legal Assistance Association referring further questions to Mr. Thomas Bussone. Mr. A. J. Callahan, Jr. suggested that we make the Gloucester Crossing area a high priority area and that we should bring our code enforcement files up to date. Mr. Walsh will assign one Code Enforcement Inspector to the Gloucester Crossing area on a full-time basis while the other Code Enforcement Inspector finishes our section of the City EC-9 on our map. The Board requested a progress report from the Code Enforcement Inspectors at the March meeting. Drug Appropriation Mr. Walsh reported to the Board of Health that the Mayor had requested the Board of Aldermen to approve the appropriation of $2,500.00 to the Board of Health Account - Board of Health - Drug Rehabilitation Assistance". The Mayor explained to Mr. Walsh that the money would be used for psychiatric care of Beverly residents only. The Mayor explained that the money would be expended under the direction of the Board of Health and the Mayor. After a brief discussion of the merits of the appropriation, the Board approved the effort, but felt they need clarification of individual responsibilities and requested more information regarding this matter be presented at the March meeting. Septic System Lot #13 Arbella Road Mr. Walsh sent letters to the Board members from Mr. Robert Russo, Sanitary Inspector, and Mr. Kenneth Knowlton, Superintendent of the Salem-Beverly Water Supply Board, approving the granting of a variance to install a sub-surface sewage disposal system on # 13 Arbella Road, Beverly to Mr. Howard Page, 17 Pierce Avenue,Beverly who intends to build a home for his own occupancy. "This letter is in reference to the January 18, 1971 letter from Ken Knowlton of the Beverly-Salem Water Board. I was present and observed the test holes and perc test made on Lot 13 Arbella Road in September of 1970. Results of these tests were good, but there is some question as to the distance of the leaching field in relation to the water shed. In my opinion, a sewage system can be built upon this lot and kept beyond the 100 foot distance required by Article II. I recommend that the Board of Health approve this lot and also grant a variance to cover the reserve area of the leaching field. To satisfy the bank that is going to hold the mortgage on this home, the granting of the variance for lot # 13 Arbella Road must be in writing." (signed) Robert Russo, Sanitary Inspector. After discussing this variance request, a motion was made and seconded that the Beverly Board of Health grant a variance on the recommendation of Robert Russo, Sanitary Inspector to Howard Page, 17 Pierce Avenue, Beverly to install a sub-surface sewage disposal system on Lot # 13 Arbella Road, Beverly and unanimously voted to approve this request. Mr. Walsh to send a letter from the Board of Health to the bank that is going to approve the mortgage on this house. Municipal Dump Mr. Walsh read a letter from Mr. Walter Doyle, Clerk of Committees, explaining that Alderman Peter F. Fortunato, Chairman of the Finance and Property Committee requested a weekly report from the Health department in relation to conditions at the city dump. After discussing the problems at the city dump, the Board of Health on a motion made and duly seconded voted unanimously to fulfill the request of the Chairman of the Finance and Property Committee for a weekly report of conditions at the dump until otherwise specified. Reports from Plumbing Inspector Mr. Robert Russo, Plumbing Inspector, reported to the Board that there was not any further action being taken at this time by the City in constructing a lift station to be located at Bay View Avenue and Neptune Street. The Board tabled further action until the April Board meeting. Mr. Russo, Sanitary Inspector, told the Board of Health that a dwelling formerly owned by James A. Dooling III is now owned by the Church of the Gift of God, Inc. and is discharging raw sewage into the Danvers River and should be required to tie into the municipal sewer system. The Board instructed Mr. Russo to send a letter regarding this problem to the Board of Health for action at their March meeting. Mr. Russo reported that he had dye-tested certain drain lines and the toilets at the Beverly Fish and Lobster Company located at 19 Water Street, Beverly and the results of these tests were negative. He further explained that even though the company was not connected to the City sewer lines, they were not discharging sewage into the harbor because they were connected to a leaching pit. Thomas H. Scanlan The Board of Health enters into the permanent record of this month's business that Mr. Thomas H. Scanlan, Director of Public Health for the City of Beverly, has retired after twenty-nine years of service to the City. The Board further wishes to acknowledge in these minutes Thomas H. Scanlan's retirement and his devoted service during the past twenty-nine years to the community. Next Meeting The next regular monthly meeting of the Beverly Board of Health will be held on Thursday, March 4, 1971 at 6:30 p.m. in the Board of Health Office, City Hall, Room 36. Dear Mr. Page: Your request for a variance from Regulation 3.2 of Article XI of the Massachusetts Sanitary Code which requires that septic tanks and leaching fields be located at least 100 feet from "tributaries to reservoirs, including open and subsurface drains" has been granted by the Beverly Board of Health for Lot 13 (only) Arbella Drive, Beverly, Massachusetts. The Board of Health granted this variance after evaluating favorable reports submitted by Mr. Robert Russo, Sanitary Inspector for the City of Beverly, and Mr. Kenneth F.
