LICENSE BOARD CITY OF BEVERLY MASSACHUSETTS MINUTES - BEVERLY LICENSE BOARD - January 6, 2000 Meeting called to order at 6:00 p.m. All members present. Lt. Roccio also present. Board introduced by Chairman Kelley. 1. Continuation of hearing for Sonny's Mobile from meeting December 16, 1999. At December meeting, Councilor Murray spoke and submitted letter from CIS in opposition to the application. 116 Standley Street - Opposed Susan Kenney - Spoke and submitted letter. Opposing the sale of alcohol at the convenience store. Letter read into record. Letters from the following also submitted - Shawn Mahoney, Judy Boyle, Claude Burr. Mr. Calabro - submitted information about location manager and assistant manager. Mr. Michael Fazio - owner - was present and spoke. Since we have opened, we have not had a problem. Upgraded the property. Presently selling cigarettes. Have had two other Minutes - January 6, 2000 Page 2 stores. Never had a problem. We are a very good neighbor. Realize we are in a neighborhood. No kids hanging around. Feel we have been excellent neighbors. Councilor Murray - Submitted letter from Win Rand - read letter into record. Audrey Civitarese, 462 Essex Street - against. Judy Boyle, 458 Essex Street- Submitted petitions in opposition. Stated they have done a fine job at the store. Opposed to the granting of the license. Extremely concerned. Harriet Campbell, 2 Boyden Street - Opposed. It is a concern with the school nearby. Traffic. Area has been highly developed. Safety reasons. Lawrence Gallant, 17 Scenna Road - resident for 31 years. I don't see how it will be an enhancement for them. They will be providing service to the people outside the community. Not in favor. Shawn Mahoney, 7 Eagle Lane - Grossly inadequate. Opposed. Bonnie Ingemi, 456 Essex Street, Opposed to the license. Concerned it will diminish value of property. Maureen Banks, 42 Middlebury Lane - Lots of children. Undermines what DARE Program teaches. Opposed. Diane Kwiatek, 13 Millbrook Road - In close proximity of the playground. Opposed. Minutes - January 6, 2000 Page 3 Lt. Roccio - Chief Terry is in opposition. Strongly feels no community need. Petition in favor submitted - Not all names have addresses. Extensive number of signatures. John Murray - My name is on the petition, but I did not sign. Ed Potvin - Opposed - too close to Harry Ball Field.. Mr. Kelley - The Statute speaks in terms of the licenses to serve the public need. Doesn't give much guidance. Really a question of availability. Closest package stores are North. Beverly and Beverly Farms. It is a question of whether or not it is necessary as a public need for the common good. Basically for the convenience. There are 30 individuals who feel strongly to attend. There are signatures indicating others are in favor. Cannot validate signatures. Any questions? Mike Fazio - We have done a good job. We are trying to enhance the property. We would do everything fight at our convenience store. Mr. Ranta - Appreciate citizens taking the time to be heard. I am a member of your community. The licenses are granted based on a quota. It is determined by the population. Availability is pre-determined. A lot of what I have heard is adverse to alcohol. Beverly is not a dry town. It is an issue of public convenience. These are items sold in the community. Appears there is a necessity in the area. Closest are North Beverly and Beverly Farms. Is a need at this time in the area for Minutes - January 6, 2000 Page 4 the sale of beer and wine. Appreciate your concern. I say this as a resident of Centerville. Eric Kenney, 120 Standley Street - Petition in opposition. Mr. Heller- Seems as though I agree that the new owners of the establishment seem to be doing a good job of keeping the place up. We assume that the license applicants are responsible business people. They are constantly under surveillance. Feel that the reasons given in opposition could be valid for every license in the city. Mr. Kelley - Have considered comments for and against. A lot of concerns are about store and traffic. For that reason I will be in favor of granting the liquor license. I don't think it will change the texture of the community. Motion - Mr. Kelley - To take a vote on the application. Mr. Murray - Have a convenience store which is obviously different than the store that used to be in Centerville. Do not have same situation. This will add to the problem. Motion to have a vote - Seconded and carried 3 - 0. Motion made and seconded to approve the application for a Beer and Wine Package Goods license. Motion carded 3 - 0. 2. Re-application fxom Emerald Eye for a full license. Tom . Hamilton present. Doing a lot of renovation. Converted it from a pub to a restaurant. We are going to concentrate on food. 50 seat capacity. Bar sits 8. Previously transferred from previous license. Minutes - January 6, 2000 Page 5 Anyone present, to speak? No. Motion - Mr. Ranta - to approve the license. Seconded by Mr. Kelley. Motion carried 3 - 0. 2. One-Day Licenses - Motion made and seconded to approve the following licenses. Masonic Temple Endicott College 3. Motion made and seconded to approve the following policy to be adopted effective immediately concerning the use of CORIs. a. CORI will be a part of the application package. b. Clerk will sign requests for CORI c. Self-address stamped.envelope will be included with request. d. CORI will be returned to the applicant at the public meeting and a receipt will be issued. e. Clerk will destroy any CORIs for person not in attendance at the meeting. A note to that effect will be filed in the folder. Motion carried 3 - 0. Next meeting scheduled for February 3.
