MINUTES - BEVERLY LICENSE BOARD - THURSDAY, JANUARY 9. 1997
Meeting called to order at 6:05 p.m.
All members present.
Chairman Terry introduced the members of the Board.
1. City Solicitor, Marshall
Insurance for Special Licenses.

He stated Chapter 258, Section 10E was amended in 1993' effective
1994 absolving and exempting City of liability. At this point it
is not necessary for the City to be covered for liability in the
issuance of licenses. Insurance is difficult to get and maybe an
unnecessary burden.
2. Letter re Kitty O'Shea's from the church next door to that
address demanding that license be rescinded. Mr. Handly stated
that the principle use of the building where the church is located
is residential. The statute does not apply. Mr. Handly to send a
letter of reply to address the issue to the attorney.
3. Casa de Luca - Application for a change in stock, change in
manager, change in officers and pledge of stock.
Mark Clinton was present.
Mr. Terry - You are the manager of record? Yes. This was all done
last March. Change in manager from Mr. Beatrice to you. Why
weren't we notified? Lawyer was supposed to handle. Left it in
his hands. Should have come before the Board.

Any changes that are made must come before the BoarU. Itow long
have you been there? Four years. Experience? 20 years in the
business.
Mr. Cook - 100 shares outstanding? Originally 40. You have taken
over the additional 60 shares? Yes. At some point would like a
copy of the Promissory Note.
Mr. Heller - You are the sole owner? Yes.

Motion - Mr. Heller - that the application from Mr. Clinton for a
change of manager, transfer of stock, change in officers and pledge
of stock to make him sole owner at Casa de Luca be approved.
Seconded Mr. Cook. Motion carried 3-0.
6:20 - Chairman Terry called for a 5 minutes recess.
Meeting reconvened at 6:25 p.m.
Mr. Cook noted that the minutes from meeting of May 6th were dated
May 2 and should be corrected.
4. One day licenses - Rich Doucette from New England Health and
Racquet present to request a one-day Beer and Wine License for a
function for the Chamber of Commerce to be held on January 29 from
5:00-7:30 p.m. Motion made and seconded to approve the license.
Motion carried 3-0.
5. Application from Marco Casarano, Mama Gina's for a Beer and
Wine Restaurant License. Mr. Casarano and Mr. Dan White (brother-
in-law) present.
Mr. Terry - You are the sole owner and manager? Yes. How did you
came about coming into this business? It was my father's and he
decided it was too much for him. I left my job at Ames and decided
to take over. Who owns the equipment? I do.
Your father had some problems. I was made aware of the problem
July 1996. He was closed a lot. Yes, he had a legal problem and
physical problem. When did you find out about the problem. About
July, it was in the paper. it was a problem with falsifying
documents. Accountant was also brought up on charges. My father
is no longer involved in the business.
Do you have proof of ownership? Yes. You should write to him to
get a statement that everything was transferred to you as of a
particular date. Are you currently running the business? Yes.
Are you selling beer and/or wine? No, we are operating but not
selling beer and wine. How long were you with Ames? 4 years. I
took a leave of absence.
Mr. Cook - Do you feel you know the business?

Mr. Cook - You are 25? Yes. Had a couple of years experience at

Mr. Cook - It might be wise to take a course, TIPS. You know that
the Board only recognizes MA licenses as valid ID's.
Previous license was listed as 287 Rantoul Street.

What is the
Form 14A needs to be redone. Not filled out properly.
Diagram submitted. Is there much work going on? Are you going to
be doing a lot of remodeling? Presently seating for 15 but
capacity is 35. Once things get going, we will increase to 35.
Discussion followed.
Mr. Casarano - Mr. Alexander is the landlord. We are open 11:00
a.m. to 11:00 p.m. Monday through Thursday. Friday and Saturday
11:00 a.m. to 12:00 Midnight. Sunday 1:00-8:00 p.m. Does the
Board need to notified if I change my hours? No.
We will be selling pizza, pasta, subs. Want it to be a family
business. Also looking for a video license.
Mr. Terry - Anyone present to speak against granting the license?
No. Anyone in favor?
Mr. White - Have complied with handicapped law. Would like to see
him get license.
Motion - Mr. Heller - That the Board grant a Beer and Wine
Restaurant License to Marco Casarano dba Mama Gina's Restaurant at
289 Rantoul Street. Seconded by Mr. Cook.
Mr. Cook - This Board approved the license for your father on May
2. Contacted him, he never picked up or paid for his license.
Speaking to make you understand that it was totally discourteous
and lack of cooperation. I want to impress upon you. You are hard
working but quite frankly did not appreciate the treatment the
Board got. We are always here. We're more than available at any
time. I hope you get the message.
Mr. Terry - Chair seconds Mr. Cook's comments. Motion carried 3-0.
Motion - Mr. Terry - That the License Board change its policy
regarding the need for liability insurance when issuing a one-day
license. Second Mr. Cook. Motion carried 3-0.
Next meeting will be February 6.
