AUGUST 8, 1996
Meeting called to order at 6:15 p.m.
Members Terry and Heller present. Member Cook absent.
Chairman Terry introduced the Board.
1. Pisani's Market - Christopher Palazola present for Pisani's, Lt.
Roccio and Officer Ganey present representing Beverly Police
Department.
Police Report Of May 17, 1996, entered into record.
Officer Ganey stated that he and Sgt. McCarthy were on bike patrol
nn May 17 at 6:07 p.m. at Lynch Park. Chevy van and Blazer pulled
into lot and 2 kids got out. They had suitcases of beer. we
stopped both vehicles and found several types of beer. Four were
arrested. All were juveniles. Walter Patterson bought at
Pisani's. He said he had bought before that night without ID. He
produced a MA Driver's LiCense.
Lt. ROCCio - What name is on the license? Adam Hoffman, DOB 8-2-72.
What is Patterson's DOB? 9-3-77 . What did you do after the
arrests? We called Pisani's and talked to Brian Clee. He was
working the register. He remembered Mr. Patterson. He stated he
was a regular and stated that night he did not ask for an ID.
Mr. Heller - In the past he presented some other ID. Yes, picture
is similar. In your experience, does walter Patterson who is 19,
does he look to be 24? I'd day around 21. Did you determine if
this was tampered with? He stated he bought it in NH. Does not
have MA seal.
Mr. Terry - Your name? Christopher Palazola, manager of Pisani's.
Do you have any questions? No.
Mr. Heller - Does this look similar to the person who used the ID?
Officer Ganey - Yes, it does.
Mr. Palazola - I don't have anything to say. Those are the facts.
I spoke to the employee. we have a TJ surveillance in place and I
check to see that they' are checking ID's. We also have a guide at
the register. The clerk was let go for that reason because he did
not check ID. But h~ had relied on that iD in the past.
Mr. Terry - Motion that the.license at Pisani's Market be suspended
for 10 days, 2 days to be served and 8 placed in suspension for one
year.

You can take time to tell us what two days that you would like
close. Seconded Mr. Heller o Motion carried 2-0.
~Lr. Terry explained the Right of Appeal to Mr. Palazola.
2. Boston Beer and Wine Company - Application for a Wine and Malt
Package Goods license at 138 Elliott Street.
Peter Donovan, President and majority stock holder, and Jean M.
O'COnnor, Manager and Vice-President, present to speak to the Board
concerning this application.
Mr. Donovan Concept is direct market of wines, delivery of our
product. If people want to come on site we will show our products
and prices. Am an importer and exporter. The license is an
accessory use. Import wines and beer. As importer will sell at
retail. Federal law allows me to import or ex~ort any beer and
wine. 5% of my space canbe used for retail.
Jean has retail experience. Has been a bartender for two years.
Will be at 138-140 Elliott Street.
Mr. Terry Any one present in favor of the license? No one
present.
Jean O'Connor - Have been a bartender with checking ID's. Never had
a problem. Know marketing. work with MADD and SADD.
Mr. Terry - Any one present in opposition? NO.
Mr. Heller - Motion to approve the application for a beer and wine
license at 138-140 Elliott Street. Seconded by Mr. Terry. Motion
carried 2-0.
3. Giblin Realty Trust Application to pledge the All Alcoholic
Beverage license at 298 Cabot Street.
Kim Driscoll, Attorney from Alexander, Femino and Lauranzano,
representing Mr. Giblin, Have a commitment from the bank and would
like to pledge the license. Pledge agreement has been signed. Hope
to be open in 8 weeks now that they have received financing.
Mr. Terry Motion we approve license pledge for Kitty O'Shea's.
Seconded by Mr. Heller. Motion carried
4. Atomic Cafe ~ Mr. Mahoney present to request an Entertainment
License. Letter submitted.
Mr. Terry asked him to describe the type of entertainment he would
be having. Poetry readings and acoustic, not amplified, guitars.
How long have your been open? Two weeks. How is business? Good.
HOw many days for entertainment? Most likely, Friday and Saturday
nights.
Mr. Heller Any neighbors that will be disturbed? There are
several layers of ceiling with sound proofing. w'nat type of menu do
you have? Capuccino.
Mr. Heller - Motion to approve an Entertainment License for Friday

and Saturday nights. Seconded by Mr. Terry. The license will be
from 7:00-11:00 p.m. on Fridayand Saturday nights with an option to
come before the Board to extend the nights as needed. Motion
carried 2-0.
Next meeting scheduled foe September 5, 1996.
One day licenses - Endicott College
approve the licenses as submitted.

6. Miscellaneous
Received and placed on file the communication from the ABCC
concerning the Vittori-Rocci Post to pay a fine of $280.73 in lieu
of serving suspension.
Receivedand placed on file communication concerning the Union
Club and application for Keno.
Acknowledge the unsigned communication regarding Elks Hall.
Clerk mentioned a complaint received in the Mayor's Office
concerning noise at closing.
Motion to adjourn at 7:00 p.m.
