MINUTES - BEVERLY LICENSE BOARD - March 4, 1999
Meeting called to order at 6:10 p.m.
All members present.
1. Wild Horse Cafe - No one present.
2. Continuation of February 4 hearing re Brew House.
Continued because of information that was submitted.
Mr. Alexander- Was not protesting documents. Was not
questioning the Police Department in any way. We wanted you
to know that we are not questioning the police actions. We
welcome their involvement. We take this very seriously. The
incident New Year's Eve - the two employees no longer
working. The third was suspended. It was a breakdown that
was addressed.
Internal memos sent to the staff.
a. Must cooperate with police.
b. First responsibility is to respond quickly and courteous
with the Police Department. Copy submitted.
Memo submitted to the Board included summary of changes
that have taken place along with a copy of employees that
were involved at the restaurant with their ages.

Discussion held.
We want to emphasize we have seen this as a restaurant.
Young people thought it was a bar. Have tried hard to reverse
this. We are now hosting Kiwanis, Lions, Beverly Teachers
group. We had Rotary today. Regret prior problems. We have
instituted number of things that we hope will make this not
happen again.
Mr. Kelley- Appreciate action taken by the company.
However, manager on that night refused to give her name.
She no longer works for the company. The server also is no
longer with the company. Phil Sak was suspended and
reprimanded. I am told he is a good employee and enthusiastic.
Went some time with pay. He has demonstrated in the past that
he is a good employee.
Mr. Kelley - Disappointed that you didn't do this the last time
we met. You did bring out a couple of things.
Employees' statements indicated the police overreacted.
Disappointed with the statements. Changes are important to
correct the problem. In a short time there were four incidents.
(Incidents summarized.) In a relatively short time there were a
number of incidents that did not reflect well on the business.
Comes down to whether or not these steps that have been taken
significantly address the situation or whether the Board should
penalize the Brew House.
Mr. Ranta- I would like hear from Lt. Roccio. Have there
been any other incidents?

Lt. Roccio- Have been no calls for service. Brew House called
us that they confiscated a fake ID. No disturbances. Nothing
shows on police records. Pleased to see the changes. Feel we
are on a positive path. Did not feel that after the last meeting.
Those four incidents were serious and flagrant. Should they be
penalized? Only the Board can determine that.
Mr. Heller- After reading statements and after hearing police,
am disturbed.
Motion - Considering the severity recommend a 3-day
suspension and suspend the suspension for one year. If there is
a problem in that year, the suspension would be served along
with whatever other action is taken.
Seconded by Mr. Ranta with the comment that he agrees it
appears to be serious violations. Have an obligation to the
community to keep the changes going in a positive direction.
Encouraged by what they have done and with what Lt. Roccio
had to say. Motion carried 3-0.
Mr. Alexander - When.would that take effect?
Mr. Ranta - Effective today until March 3, 2000.
Mr. Alexander - What do you mean by a violation?
Mr. Ranta - It would be a matter that the Board would vote,
something that would merit a suspension.
3. Police Report - 99-577 - Received and placed on file.

4. One-day licenses - Motion made and seconded to approve a
one-day license for Endicott College. Motion carried 3-0.
5. Clerk instructed to invite Mr. Hubbard to the Board's next
meeting.
Next meeting scheduled for April 15.
Meeting adjourned at 7:05 p.m.
