Employment Contract
LIBRARY DIRECTOR
AGREEMENT made this 19th day of June, 1989 between the Board of Trustees of the
Beverly Public Library, hereinafier referred to as the "Board", and Mr. Thomas F. Scully, hereinafier
referred to as the "Director."
In consideration of the mutual promises herein contained and other good and valuable
consideration, the receipt of which is hereby acknowledged, the Board of Trustees and the Director
agree as follows:
1. EMPLOYMENT: The Board hereby employs Mr. Thomas Scully as Library Director,
effective as of July 1, 1989, and Mr. Seully hereby accepts employment as Library Director, on the
following terms and conditions.
2. SALARY: The Board agrees to pay the Director for the diligent, faithful and competent
performance of his duties and responsibilities at the following annual rates of pay:
(a) 7/1/89 - 6/30/90:$37,512.55
(b) 7/1/90 - 6/30/91: Subject to negotiation
(c) 7/1/91 - 6/30/92: Subject to negotiation
3. TERM: The Director shall be employed for a Three year period commencing July 1, 1989
and ending June 30, 1992, subject to the terms and conditions herein provided.
4. DISMISSAL: Anything contained in this Agreement to the contrary notwithstanding, the
Board may dismiss the Director from employment at any time from and aaer July 1, 1987 and during
the term hereof upon the Board's written finding of inefficiency, incapacity, conduct unbecoming a
Director, insubordination, breach of contract, or any other good cause, said finding having been
established pursuant to the following procedure:
(1) At least 14 days before the hearing at which the Board intends to deride whether to
dismiss the Director from employment, the Board shall give written notice to the Director
including the time and place of the hearing, the alleged cause(s) for which the dismissal is
proposed and who shall conduct the hearing.
(2) The Director may attend the hearing, with or without counsel, to hear and cross-examine
all witnesses against the Director, and to present witnesses in defense.
(3) The Board shall hold the heating in open session, unless the Director requests that the
hearing be held in executive session.
(4) Within 21 days after the hearing, the Board shall issue its decision together with the
findings of fact on which said decision is based and provide a copy thereof to the Director.
(5) Nothing contained her~ shall be deemed to Emit whatever rights the Director may have
to appeal a decision of the Board dismissing him from ~rnployment from and after July 1,
1987 provided, however, that any such a~tion must be brought within 20 days of the
Director's receipt of the Board's decision. (As noted, the Director has no rights to appeal a
dismissal upon or prior to the end of his probationary period.) In the event of any appeal, the
parties may, if they so desire, upon terms mutually agreeable, submit their dispute to an
impartial arbitrator.
5. NOTICE OF TERMINATION: The Director may t~ninate this contract by submitting
written notice to the Board not less than thirty days prior to the final day the Director intends to
work.
6. MATERIALS AND FACILITIES POLICIES: The Board has adopted a written policy,
which is hereby made a part of this contract (Exhibit C), on selection of library materials and on use
of materials and facilities in compliance with the Library Bill of Rights and the Freedom to Read
Statement of the American Library Association and other related policies, resolutions and statements
defining the principles set out in the basic documents of intellectual freedom. The Board delegates
to the Director, subject to the control of the Board, the administration of said policies.
7. DUTIES AND RESPONSIBILITIES: The Director shall diligently, faithfidly and
competen~y perform the duties and responsibilities set forth in the job description of the Director,
a copy of which is attached hereto. (Exhibit A).
The Director shall comply with the duly adopted policies and procedures of the Board of
Trustees and shah serve and perform such duties at such times and places and in such manner as the
Board may from time to time direct.
8. BENEFITS: The Director shall be entitled to the benefits set forth in Exhibit B attached
hereto.
9. TERMINATION OF EMPLOYMENT: It is understood and agreed that the Director's
employment and this contract of employment expire, on June 30, 1992, unless sooner dismissed as
provided herein. There. after, any continued employment of the Director is subject to the will of the
Board. Absent any appointment(s) by the Board for the period from and after June 30, 1992, the
Director's employment will automatically terminate on June 30, 1992.
10. The Board agrees to evaluate the performance of the Library Director at least once each
contract year.
11. ENTIRE AGREEMENT: This contract embodies the whole agreement between the
Board and Director and there are no other inducements, promises, t~q~ns, conditions, or obligations
made or entered into by ~ither party other than those contained herein.
12. This Agreement is subject to funding each y~ar by the Beverly Board of Aldermen and
to approval by the appropriate City authorities.

Exhibit A
DUTIES AND RESPONSIBILITIES
The Library Director will:
1. Implement all written policies duly enacted by a majority of the Board, including such new
policies as are hereinaRer enacted by the Board. The Director may from time to lime recommend to
the Board new policies or changes to be enacted, but final discretion to make such changes will reside
in the majority of the Board. The Board and the Director will cooperate in the implementation of all
such policies.
2. Be responsible for overseeing the physical condition of buildings; for effectuation ofnorrnal
maimchance and repair, for advising Trustees of any emergency, or advising Trustees of capital
repairs needed, and shall make reports at least semi-annually in May and November of the physical
condition of the library and equipment.
3. Be responsible for the creation, presentation and execution of the budget. Upon approval
of the budget by the Board and the City, it is the Director's responsibility to administer the services
and staff of the Library to meet the goals and objectives set forth in the budget.
4. Act as technical advisor and be responsible for a monthly and an annual report. Each report
will contain information regarding: (1) finances, (2) circulation and (3) programs.
5. Be responsible for the administration of all contracts.
6. Be responsible for the appointment, promotion, transfer, and dismissal of all non-civil
service employees.
7. Select and order all books and other Library materials, according to the policy of the
Board.
8. Be aware of community needs and with the approval of the Board, fulfill the following: (1)
carry out plans for extending library services, (2) be responsible for the writing of grants and/or
proposals, (3) create plans for the future and (4) maintain a program of public relations.
9. Attend all Board meetings (unless excused by the Board) and ensure that records of Board
meetings are kept.
10. Be informed of local, state and national laws regarding library legislation and report such
information to the Board of Trustees.
11. Affiliate with state and national professional organizations and attend professional
meetings and workshops when they are of particular benefit to the library. The approval of the Board
will be required for expenditures not provided for in the budget, or in the funds set aside as trust
funds income allocated to professional development, which funds may be used by the Director in his
discretion pursuant to the existing guidelines relative to such funds.
12. Make use of the services and consultants of the Eastern Regional Library System and
Massachusetts Board of Library Commissioners.
13. Carry out such other duties as may be assigned by the Board of Trustees as are
appropriate to the position of Library Director.
Exhibit B
BENEFITS
A. SICK LEAVE: The Director Shall be entitled to accrue sick leave with pay at the rate of
11/4 days for each month of service. The Director is entitled to accumulate sick days up to a
maximum of 200 days.
Sick leave may only be used for personal injury or sickness.
B. VACATION: The Director, upon the anniversary date of his employment each year during
the term of this contract, shall be entitled to vacation time with pay according to the following
schedule:
1 - 4 years 10 days
5 - 9 years 15 days
10 - 19 years 20 days
20 years or more 25 days
C. HOLIDAYS: The Director shall be entitled to the following paid holidays:

Martin Luther King Day
Presidents' Day
Patriots' Day
Memorial Day
Independence Day
Labor Day
Columbus Day
Veterans' Day
Thanksgiving Day
Christmas Day
plus any other regularly scheduled workday, up to a maximum of two (2) days, that may he
declared a holiday by the Governor, the General Court or the City of Beverly, provided the Library
is in fact closed on said day.
D. FUNERAL LEAVE: In the event of a death in the Direetor's immediate family, the
Director shall be allowed to be absent from work, with pay, on all days falling within the five calendar
days commencing the day of death.
Immediate family means husband, wife, child, grandchild, parent, grandparent, brother, sister,
mother-in4aw, father-in-law, brother-in-law, sister-in-law, or a person living in the Direetor's
immediate household.
E. PERSONAL LEAVE: The Director shall be allowed, each contract year, three (3) personal
days with pay to attend to personal business matters which necessitate the Director's presence and
which earmot be scheduled after work hours. Personal days shall not be cumulative from year to year.
F. LONGEVITY: Longevity shall be paid in accordance with the revised ordinances of the
City of Beverly.

POLICY FOR THE SELECTION OF MATERIALS AND MAINTENANCE OF
COLLECTION
The Beverly Public Library endorses the Library Bill of Rights and the Freedom To Read
Statements of the American Library Association as herein appended. In essence, these statements
endorse freedom of access to information and literary materials, with limits set only by budgetary
restraints and the criteria of book selection as follows:
1. Comemporary significance or currein usefulness or interest.
2. Authority and competence of presentation.
3. importance as an historical record or of permanent value.
4. Relevance to existing collection.
5. Requests from users of the library (however, textbooks will not be purchased per se, and
will be included in the collection only if this is the only source of information on a topic of general
interest.)
6. Physical quality of format and binding.
7. Presentation of all views on controversial issues.
8. Balance of special group interest with general demand.
9. Cost in relation to the individual title and to the overall collection.
10. Selection of materials for the adult collection on the basis of adult needs (selection will
not be restricted by the possibility that children may obtain material their parents consider
inappropriate.)
11. Selection of materials on the basis of recommendations of ac, eepted established review
sources such as Library Journal, Publishers' Weekly, New York Times, Wilsons Library Bulletin,
Kirkus, Saturday Review, etc.
12. Weeding and discarding of the collection on a systematic basis (This function is
necessitated by limitations of space, obsolescence of materials, lack of use over an extended period
of time, physical condition of the book stock, and acquisition of new materials. The same criteria
applied to the purchase of new books will be applied to the discarding and weeding of books. )
13. Request from patrons to withdraw materials from the collection to be made in writing and
to be evaluated within the comext of the Freedom to Read Statement and Library Bill of Rights.
14. Priority of the collection of the Main Library in the a~uisition of materials (Exceptions
may be made for materials especially suited for the Farms Branch or the Bookmobile.)
CHILDREN'S/YOUNG ADULT COLLECTIONS
Responsibility for the reading of children rests with their parents. Since the scope of the
collection in the Youth Services area (including the Young Adult area and the Children's Room)
ranges from preschool through middle school, parents are advised to particularly note the suitability
of books for each child.
Materials will be chosen for children on the basis of recommendations by recognized
authorities in the field of children's literature; specific review sources such as The Bulletin of the
Center for Children's Books, School Library Journal, Horn Book, etc. The materials will attempt to
satisfy the child's horizons and interests. The Library will provide supplementary materials which
enrich the resources available to children, but no materials which are strictly curriculum-related, and
belong within the province of the schools. Specific requests for books and other materials by children
and adults will be honored when the requested item will add to the strength of the collection, and
when the budget pen-nits. The same criteria of service and selection stated in the Library's service
goals apply to children and young adults.
Due to extreme space limitations, it is necessary to weed vigorously and remove books which
do not circulate with a modicum of frequency.
GIFTS
The Library appredates gifts and accepts them with the following provisos:
-that the same criteria apply to the incorporation of gifts into the collection as the selection
of books and other library materials.
-the Library reserves the right to administer gifts with a view to the best interests of the
Library
-the Library will not become a depository or custodian for materials of great monetary or
historical value.
EXHIBITS
The Library encourages displays and exhibits, and will observe the same precautions as
applied to library materials, but assumes no responsibility for restitution in case of damage or theft.
RESPONSIBILITY
These policies for library service and selection ofmatefials have been formulated by the Board
of Trustees of the Beverly Public Library. The Board delegates the Director to act as its agent in the
administration and implementation of said policies.

AGREEMENT made this May 15, 1995 between tile Board of Trustees ofthe Beverly Public
Library, hereinafier referred to as the "Board", and Mr. Thomas F. Scully, hereinafter referred to as
tile "Director."
In consideration of the Mutual promises herein contained and other good and valuable
consideration, the receipt of which is hereby acknowledged, the Board of Trustees and the Director
agree as follows:

In consideration of the mutual promises herein contained and other good and valuable
consideration, the receipt of which is hereby acknowledged, the Board of Trustees and the Assistant
Director agree as follows:
1. EMPLOYMENT: The Board hereby employs Ms. Sheila Glowacki as Assistant Library
Director, effective as of July 1, 1989, and Ms. Glowacki hereby accepts employment as Assistant
Library Director, on the following terms and conditions.
2. SALLY: The Board agrees to pay the Assistant Library Director for the diligent, faithful
and competent performance of her duties and responsibilities at the following annual rates of pay:
(a) 7/1/89 - 6/30/90: $32,550.00
(b) 7/1/90 - 6/30/91: Subject to negotiation
(c) 7/1/91 - 6/30/92: Subject to negotiation
3. TERM: The Assistant Library Director shall be employed for a Three year period
conunencing July 1, 1989 and ending June 30, 1992, subject to the terms and conditions herein
provided.
4. DISMISSAL: Anything contained in this Agreement to the contrary notwithstanding, the
Library Director may dismiss the Assistant Director from employment at any time during the term
hereof upon the Library Director's written finding of inefficiency, incapacity, conduct unbecoming
an Assistant Director, insubordination, breach of contract, or any other good cause.
The Assistant Library Director shall have the right to appeal the decision of the Library
Director to the Board of Trustees according to the following procedure:
(1) At least 14 days before the hearing at which the Board intends to decide whether to
dismiss the Assistant Director from employment, the Board shall give written notice to the Assistant
Director including the time and place of the heating, the alleged cause(s) for which the dismissal is
proposed and who shall conduct the heating.
(2) The Assistant Director may attend the hearing with or without counsel, to hear and
cross-examine all witnesses against the Assistant Director, and to present witnesses in defense.
(3) The Board shall hold the heating in open session, unless the Assistant Director requests
that the heating be held in executive session.
(4) Within 21 days after the heating the Board shall issue its decision together with the
findings of fact on which said decision is based and provide a copy thereof to the Assistant Director.
(5) Nothing contained herein shall be deemed to limit whatever rights the Assistant Director
may have to appeal a decision of the Board dismissing her from employment provided, however, that
any such action must be brought within 20 days of the Assistant Director's receipt of the Board's
decision. In the event of any appeal, the parties may, if they so desire, upon terms mutually agreeable,
submit their dispute to an impartial arbitrator.
5. NOTICE OF TERMINATION: The Assistant Director may terminate this contract by
submitting written notice to the Board not less than thirty days prior to the final day the Assistant
Director intends to work.
6. MATERIALS AND FACILITIES POLICIES: The Board has adopted a written policy,
which is hereby made a part of this contract, on selection of library materials and on use of materials
and facilities in compliance with the Library Bill of Rights and the Freedom to Read Statement of the
American Library Association and other related policies, resolutions and statements defining the
principles set out in the basic documents of intellectual freedom. The Assistant Director assists in the
administration of said policies.
7. DUTIES AND RESPONSIBILITIES: The Assistant Director shall diligently, faithfully and
competently perform the duties and responsibilities set forth in the job description of the Assistant
Director, a copy of which is attached hereto. (Exhibit A).
The Assistant Director shall comply with the duly adopted policies and procedures of the
Board of Trustees and shall serve and perform such duties at such times and places and in such
manner as the Director may from time to time determine.
8. BENEFITS: The Assistam Director shall be entitled to the benefits set forth in Exhibit B
attached hereto.
9. TERMINATION OF EMPLOYMENT: It is understood and agreed that the Assistant
Director's employment and this contract of employment expire on June 30, 1992, unless sooner
dismissed as provided herein. Thereafter, any continued employment of the Assistant Director is
subject to the will of the Board. Absent any appointment(s) by the Board for the period from and
after June 30, 1992, the Assistant Director's employment will automatically terminate on June 30,
1992.
10. The Library Director agrees to evaluate the performance of the Library Assistant Director
at least once each contract year.
11. ENTIRE AGREEMENT: This contract embodies the whole agreement between the
Board and Assistant Director and there are no other inducements, promises, terms, conditions, or
obligations made or entered into by either party other than those contained herein.
12. This Agreement is subject to funding each year by the Beverly Board of Aldermen and
to approval by the appropriate City authorities.

DUTIES AND RESPONSIBILITIES
The Assistant Library Director will:

3. Assist in preparation of and monitoring of the Library's budget.
4. Direct the Library's operation in the absence of the Library Director.
5. Assist in planning and evaluating Library projects by gathering, researching and presenting
information.
6. Take minutes at meetings of the Board of Trustees.
7. Assist in the staff hiring process by participating in pre-screening and imerviewing of job
applicants.
8. Assist in evaluating departmental functions, collection development, public and technical
services.
9. Assist in the preparation of grant applications.
10. Participate in activities of professional associations; attend institutes and workshops and
report on such activities to the library staff.

BENEFITS
A. SICK LEAVE: The Assistam Director shall be entitled to accrue sick leave with pay at the
rate of 2 days for each month of service. The Assistant Director is entitled to accumulate sick days
up to a maximum of 200 days.
Sick leave may only be used for personal injury or sickness.
B. VACATION: The Assistant Director, upon the anniversary date of her employment each
year during the term of this contract, shall be entitled to 20 days vacation time.
C. HOLIDAYS: The Assistant Director shall be entitled to the following paid holidays:

the Assistant Director shall be allowed to be absent from work, with pay, on all days falling within
the five calendar days commencing the day of death.
Immediate family means husband, wife, child, grandchild, parent, grandparent, brother, sister,
mother-in-law, father-in-law, brother-in-law, sister-in-law, or a person living in the Assistant
Director's immediate household.
E. PERSONAL LEAVE: Ile Assistant Director shall be allowed, each contract year, three (3)
personal days with pay to attend to personal business matters which necessitate the Assistant
Director's presence and which cannot be scheduled after work hours. Personal days shall not be
cumulative from year to year.
F. LONGEVITY: Longevity shall be paid in accordance with the revised ordinances of the
City of Beverly.
