Scanlan, Director of Public Health, Richard Montoni, Code Enforcement Officer, Leo Panunzio, Milk and Food Inspector, Robert Russo, Plumbing Inspector, and Joseph W. Walsh, Jr., Sanitarian Recorder: Joseph W. Walsh, Jr. BOARD OF HEALTH - MONTHLY MEETING - JULY 13, 1970 Meeting called to order at 6:05 p.m. Members present were Dr. J.H. Fine, Chairman; Angelo R. Massa and A. J. Callahan, Jr., members. Also attending were Joseph Walsh, Leo Panunzio, Robert Russo, Richard Montoni, and Alfred Semple. The minutes of both the June 1st regular monthly meeting and the special meeting of June 24, 1970 were accepted. The monthly reports of the various staff members were read The following municipal officials: Dean Palmer, Fire Chief, John T. Whitaker, Building Inspector; and Richard Montoni, Code Enforcement Inspector, submitted written opinions regarding the granting of variances of a second means of egress from apartments in structures owned by Mr. & Mrs. Wolf Winikur, Mr. Orlando Desilvestre, and Mr. Cecil Weinstein. All three municipal officials requested the Board of Health to deny these variance requests. The Code Enforcement Inspector, Richard Montoni, quoted Regulation 12.1 or Article II of the Massachusetts Sanitary Code, and the Building Inspector, John T. Whitaker, quoted the Beverly Building Ordinances, Article 7, Section I on page 52 as their reason for denying these requests. Mr. & Mrs. Wolf Winikur's request for a variance regarding one means of egress at 17 Fayette Street, Beverly, Massachusetts. On a motion duly made and seconded, the Board voted unanimously to deny this request. Orlando Desilvestre's request for a variance regarding one means egress at 12 Highland Avenue, Beverly, Massachusetts. On a motion duly made and seconded, the Board voted unanimously to deny this request. Cecil Weinstein's request for a variance regarding one means of egress at 23-23 ½ Central Street, Beverly, Massachusetts. On a motion duly made and seconded, the Board voted to deny this request. The Board instructed the Code Enforcement Inspector, Mr. Richard Montoni to check with the above property owners as to their intentions regarding the addition of a second means of egress and report his findings to them. Request of Mr. John Taylor to use cooking facilities in his rooming unit in a dwelling located at 12 Highland Avenue, Beverly, Massachusetts. Mr. Taylor had stated health reasons for his request. On a motion duly made and seconded, the Board voted unanimously to grant a temporary hardship variance of six (6) months duration to only Mr. Taylor, the tenant. The Board of Health wants the cooking area inspected by the Gas Inspector before the variance becomes effective. Kanter Realty Trust Mr. Montoni reported to the Board that Kanter Realty Trust has made considerable progress in repairing the following structures: 6, 8, 10, 12, Fossa Terrace and they are now working on 17 Fossa Terrace. Walsh read a petition signed by 49 residents of the Central St. area to the Board regarding 14 Central Street and its dilapidated condition which is owned by Kanter Realty Trust. Mr. Walsh also submitted to the Board a letter from Mr. Scanlan to Mayor Grimes regarding the problem and a letter from Mr. Richard Kanter of Kanter Realty Trust stating his intentions as to repairing 14 Central Street. The Board tabled, until the August Board of Health meeting, further action and at that time, Mr. Montoni will submit to the Board his report as to what progress has been made in correcting the numerous violations of Article 2. Mr. Walsh instructed by the Board to inform petitioners in writing of the Board's action and send a copy to Mayor Grimes. Section 8. Food Regulation The addition of Regulation 8. "Toilet Facilities" which will be added to Chapter III of the Board of Health's "Food Regulations" has been approved by the City Solicitor and now has to be advertised in the local newspaper before it becomes effective. On a motion duly made and seconded, the Board unanimously voted to have Mr. Walsh advertise the new regulation in the local newspapers. 16 Bennett Street Mr. & Mrs. Lowell Sawyer, 16 Bennett Street, Beverly requested permission to move back into their apartment. At the request of the Board of Health, inspections were made by the Plumbing, Building, and Electrical Departments along with our inspector and all inspectors agreed that it was alright to allow Mr.& Mrs. Lowell E Sawyer to move back into their apartment, but the other three (3) apartments could not be inhabited until they were inspected by the above inspectors. On a motion made and duly seconded, the Board voted unanimously to allow Mr. & Mrs. Lowell E. Sawyer to occupy their apartment, but the other three (3) apartments could not be occupied until approval had been obtained from all city inspectors. Re-organization The Mayor's re-organization of inspectors tabled until next Board of Health meeting. NEW BUSINESS Substitute Plumbing Inspector The Board of Health discussed Mayor Grimes' suggestion that the Gas Inspector fill in for Mr. Russo, the Plumbing Inspector, while was on his annual vacation. The Board felt that the nature of the work required a full-time inspector rather than an inspector on an emergency or part-time basis. On a motion duly made and seconded the Board voted unanimously to appoint Mr. Albert Grant as substitute plumbing inspector while Mr. Russo is on vacation. Mayor Grimes to be informed in writing of the Board's decision. Food Service Personnel Mr. Panunzio, discussed with the Board of Health the feasibility of tine testing of all food service establishment personnel by the Health Department nurses. Mr. Callahan wanted to know if a Board of Health regulation would be required in order to have these employees tested. Dr. Fine requested more information regarding the procedure to be followed.
