2000-04-27City of Beverly, Massachusetts Public Meeting Minutes Board: Board of Health Subcommittee: Date: April 27, 2000 Place: Beverly Council on Aging, Conference Room Board members present: Frank Carbone, Jr., M.D. and Normam Spector Board members absent: Peter Hersee (Excused) Others present: William Burke, Director of Public Health; Steve Douglas and Patricia Goelhert from North Coastal Boards of Health Collaborative and Marc Fortier, Salem News. Recorder: Judith Balboni. Meeting called to order at 7:35 a.m. The March 16, 2000 minutes were accepted as read. Mr. Burke introduced Patricia Goelhert, Program Director and Steve Douglas, Enforcement Officer, from North Coastal Boards of Health Collaborative. Mr. Burke stated that Mr. Douglas. has been visiting food establishments and bars, circulating the ETS Regulation and getting a feel of how many and what type of variances may be applied for. A sample variance application was presented to the Board for their review. The Board voted unanimously to accept the variance application. Mr. Douglas will begin to distribute the application to interested parties and inform them to submit the application by June 1, 2000 to be put on the June 22, 2000 Board of Health meeting agenda. Dr. Carbone asked how many variance requests could be anticipated. Mr. Douglas replied that approximately 12-15 may seek a variance of some form. Some that construct enclosures that meet the requirements of Section VI (E) may not need a variance or may require one that pertains to the 25% seating requirement. Another variance request may pertain to food establishments that would be smoke-free during the dining period but would request smoking be allowed as they provide entertainment and bar service until closing. Dr. Carbone asked Mr. Douglas if now in light of Salem going 100% smoke-free everywhere, was there any support by Beverly establishment operators to have Beverly go 100% smoke-free. Pat Goelhert discussed the smoke-free dining guide to be published later this spring to promote establishments that prohibit smoking. Tobacco sales compliance checks were recently done with a compliance rate of 85%. Four merchants sold, one being Stop & Shop (Enon St.), by the manager. The Board felt strongly that this needs some attention. Mr. Burke will send out violation notices with appropriate fines. Mr. Burke discussed developing a policy of using the last 24 months when determining the compliance check violation for youth access. Also the issue of publicizing violators in the paper was discussed. The Board felt that this could help with recent decrease in compliance rates. A motion was made by Mr. Spector to advertise violators and accept the 24-month compliance check violation policy. Both Dr. Carbone and Mr. Spector expressed concern that the cessation and support programs to help people willing to quit smoking is not broadly advertised. Ms. Goelhert informed the Board of the programs operating in the Beverly community. Mr. Burke suggested inviting cessation program coordinators to the next meeting. Updates Household Hazardous Waste Collection Day is April 29, 2000 at Beverly High School. Mr. Burke attended a meeting in Peabody with several other communities to discuss feasibility of establishing a regional household hazardous facility. Peabody has expressed willingness to provide a site. Inter-municipal agreements and grant monies would still need to be pursued. Ms. Doherty and Mr. Burke have applied for a grant offered by Massachusetts Delta Foundation in collaboration with NorthEast Health Systems and Massachusetts Coalition for Oral Health. Mr. Burke provided copies of the Letters of Intent to the Board. Ms. Doherty and Ms. Pelletier of the Dental Clinic presented an Oral Health Educational Program at the Council on Aging building on April 25, 2000. Seniors were provided with oral health care products and information. All delinquent food service permits have been renewed. Many were charged a late fee. Fifth grader Kristen Ballentine was presented with a 'Certificate of Appreciation', by Mr. Burke on behalf of the Board of Health at the School Committee Meeting on April 10, 2000. Ms. Ballentine was recognized for her poster, being selected as Beverly's entry into the Massachusetts Public Health Association's Poster Contest in honor of Public Health Week. Mr. Burke has been informed by Mr. Good of NorthEast Health System, that after a minor delay, the 'Development of Benefit Directory' is moving ahead. The next meeting to be scheduled.
