2000-12-12City of Beverly, Massachusetts Public Meeting Minutes Board: Board of Health Subcommittee: Date: December 12, 2000 Place: Beverly Council on Aging, Conference Room Board members present: Frank Carbone, Jr., MD, Norman Spector and Peter A. Hersee Board members absent: Others present: William Burke, Director of Public Health and Thomas Scully, Director of Community Services Recorder: Iudith Balboni. The meeting was called to order at 7:30 a.m. The Board reviewed and accepted the minutes of November 16, 2000 meeting. The meeting schedule for the next three months is January 18, February 15, and March 15, 2001. All are at the Senior Center Conference Room and at 7:30 a.m. Mr. Burke introduced Pat ZingarieIlo, Public Health Nurse to the Board. Ms. Zingariello will be starting on Ianuary 18, 2001. In recent tobacco compliance checks by the North Shore Tobacco Control Collaborative both Walgreen's and Gloria Foods were third time offenders within the past twenty-four month period. Scott Ofeish from Gloria Foods and Steve Bryan from Walgreen's both told the Board there is no excuse for violations. Employees are well informed, trained and sign acknowledgement forms. Ofeish said payment of fine comes from employee's salary. Walgreen's gives the employee a five- day suspension. The fine is $200 and a 2-day suspension of tobacco sales permit will be observed. Mr. Burke introduced Ms. Colleen DiMambro, part-owner of Chickie's, a newly-constructed bar / restaurant on Rantoul Street who has requested a variance from smoking regulations to allow a smoking bar. She claims her restaurant was designed around regulations but didn't realize it would have to be completely smoke-free. Mr. Hersee made motion to deny, seconded by Mr. Spector. Mr. Burke introduced and welcomed Pat Goelhert and Issac Rowe from the Tobacco Control Collaborative. Mr. Rowe summarized his finding of recent site visits. Board members agree that variance compliance checks be done to ensure compliance. A closer look at incidental food should be taken and also how smoke-free in the early hours of opening. A letter could be mailed to variance holders reminding them of variance conditions and informing them we will be monitoring to assure that it is being honored. Mr. Burke to send reminder letter to all variance holders. Mr. Rowe would conduct variance compliance checks and investigate complaints. The Board would like to keep the Chamber/community involved. Mr. Burke informed the Board that the State DPH is having a seminar on Model Body Art Regulations on December 13, 2000. Staffmembers to attend. Mr. Burke updated the Board on the December 7th Flu Clinic held here at the Center. We received our expected allotment and continued to vaccinate citizens and public employees who had to be turned away from our November clinic. Chairman Carbone would like to invite Senator Berry and State Representative Cahill to the next meeting. We need to discuss monies, grants, education, tobacco control and recent amendments to the sanitary codes. Also invite Carol Seamans, Smoking Cessation, Rob O'Hannon of Heaith and Education Services.
