2004-02-05BEVERLY HARBOR MANAGEMENT AUTHORITY February 5, 2004 Beverly Public Library PRESENT: J. Frates, S.M. Seamans, D. Neuman, R. Costa, C. Raymond, S. Menezes, G. Ward, and M. Troubetaris GUESTS: Mayor Scanlon, City Solicitor R. Gelineau, R. Oosthoek, L. Bochynskl, G. Whitney, R. Maglio, D. Earl, P. Merrill, and T. Bartley J. Frates opened the meeting. He stated he was happy to see everyone, and asked all to introduce themselves. S.M. Seamans made a motion to accept the Minutes of the previous meeting. C. Raymond seconded, and all approved. Committees: Planning and Development: J. Frates spoke with J. McSweeney regarding the path at the Cummings Center. J. McSweeney told J. Frates that the Cummings Center would be willing to help the City relocate the sign and move the fence. J. Frates, D. Neuman, and the Mayor met re: Ventron Property. We will have to wait and see what happens. The City has not told Acorn Management whether the proposal was acceptable or not. R. Costa stated that he bad proposed with the last administration that we ask the new owners to return what was known as Congress Court. He hopes to propose again to the new owners. Public Access S. Menezes met with Bass Haven, and they are now in compliance. He made a motion that we send a letter to them thanking them. M. Troubetaris seconded, and all approved. Facilities D. Neuman reminded that rates should be set for summer. Licenses and Permits D. Neuman spoke of the Port Marina. They lost their appeal for unlicensed floats. He stated that the City might want to take enforcement action. The USACE requested that they take the little house out of the water. The Harbosmaster has not given 1OA Permits. M. Troubetaris asked what kind of income we would get from these floats. D. Neuman stated that it would be mlrlimal. Mayor Scanlon says they give us some income. D. Neuman says that it is public property without compensation to the City. The City was charging a sheet fee, but it was determined illegal by M. Handly. D. Neuman asked the City Solicitor to look into it. M. Troubetaris asked whether it is legal or not, couldn't it be put into and Escrow account in case it is challenged. J. Frates stated that we need solutions. He has great hopes that we can. D. Neuman asked the City Solicitor if it could be brought up in Executive Session at the end of this regular meeting. City Solicitor answered yes. R. Oosthoek asked about the Master plan and what are the thoughts on shrinking the Federal Channel. He also asked about the Seaport Advisory Council money. D. Neurnan says that we are still on the list, but they have no money. J. Frates says that the Master Plan is done. M. Troubetaris says that the money as been paid. D. Neuman says that shrinking the Federal Channel is not in the BHMA plans. The Mayor says that we should have the best harbor we can have and have a safe harbor. D. Neuman stated that we asked USACE how wide the channel should be to accommodate a small cruise ship. His answer was that it would be OK with existing floats, this was verbal, and there is nothing in writing. R. Oosthoek stated that he tried to give Mayor Crean names of people to be on the BHMA. The names are in the City Clerk's Office. G. Ward stated that he attended Ward Il Civic meeting, and they asked if the BHMA could put together a boat ride to bring people together. Ward II will help organize. It was stated that either Hannah Glover or Sunline should have boats. It was stated that Mass Electric has no walkway; word is that they say for safety reasons. G. Whitney says that other mitigation is advised. The Mayor will talk to them. D. Neuman asked the Mayor if be would put this on his list. M. Troubetaris asked if we were going to put out new bids for the waterfront. The Mayor stated no, but he thinks that we may hear from the Ventron purchase. C.Raymond asked if those who went to review Acorn properties could tell us about them. S.M. Seamaus said that they visited a well run Marina in Quincy. They also have condos, and they are all very well kept. S.M. Seamans asked if Algonquin is finished yet. L. Bochynski stated that this is an on-going project. J.
