JANUARY 13, 1997
Present:, Commissioners; Farmer, Bamico, Gourdeau, Lydon, Mahoney, Eaton and
Rosen.
Absent: Commissioner Dean.
Public: Ken Robinson and Victor Capozzi.
A. CALL TO ORDER: Chairman Farmer called the meeting to order at 7:30 P.M.
1. Presentations: None.
2. Chairman Farmer called for a reading of the Minutes of the Regular Meeting of
December 9, 1996. Motion to accept by Commissioner Mahoney, 2rid by
Commissioner Gourdeau. Motion passed unanimously.
3. Chairman Farmer called for a reading of the Financial Report for November 1996.
Vice Chairman White explained the report and answered several questions of the
Commission. The possibility of budget breakdowns by project will also be explored.
MotiOn to accept subject to audit by Commissioner Lydon, 2nd by Commissioner
Rosen. Motion passed unanimously.
B. OLD BUSINESS:
I. Hospitality Solutions - City Solicitor Marshall Handly informed the Commission that
Hospitality Solutions was out effective January 1, 1997, that Hospitality was not
making any claims to reoccupy, and the Airport was free to re-rent the property. The
City Solicitor also said Hospitality would be sued for back rent and fuel costs. The
City Solicitor said that proposals would have to go in the Register.
2. Sublet Rent - The City Solicitor said that it was untrue that a LESSEE could only
charge a Sub LESSEE what he the LESSEE paid to the City as rent.
3. General Aviation Services - The City Solicitor reported that the lease was ready to be
executed.
4. Gongas Adverse Possession Claim - The City Solicitor said the city's defense will be
that the city voluntarily moved the fence back from airport property.
5. Property Acquisition - City Solicitor said that in discussions with the Mayor, the city is
not going to buy the properties (though there is no official decision). He believes the
city would not have the money to purchase the property, that the city has a low level'
of confidence in the current property appraisals. He said the city will go for an
avigation easement. He said that one property owner (Murrin) might still be able to be
purchased within the federal appraisal limit amount. City Solicitor also said he does
not feel he can convince City Council to take the Gongas property given the low
confidence in the current appraisals. The City Solicitor said if the FAA would cormnit
to a percentage if the appraisals were found to be higher, he would not have a problem
in acquiring the property. Chairman Farmer requested that the FAA be contacted
regarding the appraisals, and that the Airport and City Solicitor then make a decision
on whether to acquire avigation easements. Further discussion led to the decision that
the property line by Gongas's will be staked and we will proceed with offering only the
currently appraised amount and any demand for more, we take only an avigation
easement. Mr. Farmer requested the Airport Manager inform the consultant
negotiator of our proposed plan of action.
6. Sentry Update - City Solicitor reported that Sentry has thus far only submitted a notice
of appeal, but that does not mean that they will get it.
7. Runway 27 RSA & Sam Fonzo Drive Update - Airport Manager updated the
Commission on latest developments. Chairman Farmer said he would talk with the
Mayor about a written statement that the city will bring a water/sewer line to the
airport when the same work is done on the City Industrial Park.
8. Vegetation Management Plan - Airport Manager updated the Commission on the
latest developments.
C. NEW BUSINESS:
1. Electing of BAC Chairman - Motion made by Commissioner Lydon to elect Bob
Farmer as BAC Chairman and Leo White as Vice Chairman, 2nd by Commissioner
Mahoney, Motion passed unanimously.
2. Use of Airport Equipment - Manager discussed pros & cons of allowing non-city
employees to use airport equipment, equipment would include use of the older pick up
truck plow. Chairman Farmer read ordinance #91 that said motor vehicles owned by
the City of Beverly shall be operated and driven only by authorized employees of the
City of Beverly. The ordinance raised question that as written, does the ordinance
allow Commissioners to operate a city vehicle.
3. Proposed T-Hangar Development - Airport Manager discussed the interest of a
developer to erect T-hangars. Information contained in developers letter showed it
would not be in airports financial interest.
4. Tie Down Rates & Leasing of City Tie Down Spaces - Airport Manager reported his
findings on tie down rates and feasibility of leasing city tie down areas to FBO.
Discussion ensued. Motion by Commission Lydon to keep rates the same and keep
city control of city tie down spaces, and to review rates next year, 2nd by
Commissioner Barnico, motion passed unanimously.
D. AIRPORT MANAGER'S REPORT ~ In addition to Airport Managers agenda items
the Airport Manager's written report updated the Commission on aircraft lien, aircraft
accident, leasehold inspections, automatic gate operations and MALS operation.
E. CBAIRMAN/COMMISSION COMMENTS:
1. Chairman Farmer recommended that the airport property line be walked in May.
2. Chairman Farmer requested the Airport Manager check with FAA on the Beverly High
School tower.
3. Chairman Farmer requested that the airport property line by Gongas's be defined by
staking.
4. Chairman Farmer requested that the Airport Manager send a letter to the City Solicitor
requesting a taking of the tree on the Gongas properly that penetrates the approach
slope to Runway 16.
5. Chainnan Farmer requested Commissioner Mahoney to place the old Hospitality
Solutions area in the Register, also said re-renting of this space is top priority.
6. Chairman Farmer requested Airport Manager to get information on shutting down
heating system in old Hospitality Solutions building.
7. Chairman Farmer reported that someone from the City will coordinate with the airport
on industrial park development, real estate and building lots.
8. Chairman Farmer said Commissioner absences from meetings are limited to 3.
9. Chairman Farmer made the following Committee appointments:
· Hospitality Solutions/Gumard Buildings - Commissioners Mahoney and Bamico (e.g.;
proposals).
· Cormell Hangar Feasibility - Commissioners Mahoney and Bamico (e.g. location
alternatives, impact).
· Ornni Underground Storage Tanks - Commissioners Mahoney and Barnleo (e.g. actual
use, compliance with regulations).
· Lease Compliance & Maintenance - Commissioners Gourdeau, Rosen and Dean (e.g.
review, responsibility comparisons of LESSEE/LESSOR).
· Sam Fonzo Road Impact - Commissioners Lydon and Eaton (e.g. involvement with
engineering firm (what they are doing, what they propose, get schedules).
· Legal Affairs - Airport Manager to coordinate with City Solicitor.
Each Committee will automatically be on each months BAC Regular Meeting agenda and
will be re4t. uested to give information at each meeting.
F. ADJOURNMENT: Motion made by Commissioner Lydon to adjourn, 2nd by Vice
Chairman Bite. Motion passed unanimously.
