1998-02-24 (3) MASSACHUSETTS BOARD OF APPEAL OF THE ZONING ORDINANCE DIANE ROGERS DECISION ON PETITION FOR A VARIANCE CLERK 921-6025 BY: GEORGETTE B. RIMER a public hearing was held on Tuesday, FebruazT 24, 1998 at 7:00 p.m. at City Hall, Beverly, Massachusetts, to further consider the petition of Georgette B. Rimer for a request of a variance to encroach 12" plus or minus into the required side yard setback of 15' on I 1/2 story addition to house, recently constructed prior to the instrument survey. Property located 10 Posters Point, in an R- 10 Zone. The February24, 1998 public meeting of the Zoning Board of appeals was called to order at 7:00 p.m. by the Chairman Scott D. Housean. The following members were present at the call of order: Scott D. Houseman Day ann Kelley Joshua anderson Martin J. Freeman Robert McLemore Margaret O'Brien The public hearing of this petition was .opened at the regular JanualT, 1998 meeting of the Board · At that meeting, the Board voted to continue the public hearing on this petition until the February meeting of the Board. The written record of the January public hearing was filed with the City Clerk's office of February 9, 1998, and a copy of it is attached hereto and incorporated by reference into this decision. The February 24 re-opening of the public hearing of this petition connaenced with the Building Commissioner, Mr. Brennan, distributing to the Board members a copy of the application and accompanying plans describing the location and zoning of the property at 10 Fosters Point. Ms. Rimer's husband appeared on her behalf. Mr. Rimer stated that he and his wife wanted to withdraw her petition without prejudice. No member of the public accepted the opportunity to speak in favor or in opposition to the petition. The public hearing was then closed. The members of the Board had no questions for the petitioner. On a motion made by Mr. Freeman and seconded by Ms. Kelley, the Board voted 5-0 to GRANT the request to withdraw the variance petition without prejudice and without conditions. Appeals from the Board's decision on this petition may be filed in accordance with the provision of M.G.L. Chapter 40A, Section 17, within twenty (20) days of the filing of this decision with the City Clerk. Respectfully, Scott D. RIMER A public hearing was held on Tuesday, January 27, 1998 at 7:00 p.m. at City Hall, Beverly, Massachusetts, a notice of said hearing having been duly advertised in the Salem Evening News, a newspaper having a circulation in said Beverly and the required persons having been duly notified by mail of the time and place of said hearing concerning the application of Georgette B. Rimer in a petition for a request for a variance to encroach 12' plus or minus into the required side yard setback of 15' on 11/2 story addition to house,recently constructed prior to instrument survey. Property located 10 Fosters Point, in an R-10 Zone. The hearing was called to order at 7:00 p.m. by the Chairperson, Day Ann Kelley. The following members were present: Day Ann Kelley Scott Houseman Leonard J. Martin Freeman Paul Belmonte Bertaux The Building Commissioner, Timothy Brennan, exhibited plans relative to the application describing the location and zoning of the property. Scott Thompson of 10 Fos~er's Point represented Ms. Rimer at this hearing. He requested postponement until next month because of permitting problems. The Members of the Board agreed but requested that the Building Inspector bring all permitting documents to the February hearing of the Zoning Board of Appeal.
