THE MEETING WAS CALLED TO ORDER AT 7:45 P.M.
FIRST ITEM ON THE AGENDA: PETER OGREN FROM HAYES ENGINEERING
LOT 71 AMENDMENT AT OLD PLANTERS ROAD. A LETTER WAS FILED ON JULY
8, 1993. THE LOT IS NOW INTO RECEIVERSHIP.
A VERTICAL WALL WILL BE INSTALLED NOT A RIP RAP WALL. A VERTICAL
WALL WILL TAKE UP LESS ROOM. IT WILL BE 81' IN HEIGHT, THE GARAGE
FLOOR WILL BE 73'
CLAYTON SHALL ASKED ABOUT A DECK IN THE FUTURE?
PETER OGREN - NO INTENTION AT THIS TIME.
CLAYTON SHALL - IF SO, THEY ARE TO COME BACK TO FILE A NOTICE OF
INTENT.
BILL LISS MOTIONED THIS TO BE NOT SIGNIFICANT AND CLAYTON SMALL
SECONDED THE MOTION.

PRESENT, CITY SOLICITOR, BEN EISENSTADT.
REPRESENTING, FRANK MUZIO, ATTORNEY.
HE STATED THAT NO RAILROAD TIES HAVE BEEN USED, GELPEY FELT TIES
TO BE INAPPROPRIATE.
AN ALLEGED SUB DRAIN SYSTEM AROUND THE FOUNDATION - NONE EXISTS.
PERIMETER FENCING*AROUND THE SITE.
MR. GELPEYHAS DONE ALL THIS THROUGH THE BUILDING INSPECTOR. ALL
DONE PRIOR TO DEP'S INSPECTION.
ON DECEMBER 16, 1992, A CERTIFICATE OF COMPLIANCE FROM THE STATE
WAS ISSUED FOR THE PROPERTY.
GELPEY DID PLACE A PUMP IN HIS BACKYARD TO RELIEVE WATER.
ATTORNEY HAZIO STATED NOVEMBER 11, 1992, CDM CHECKED THE DRAIN.
AFTER MUCH DISCUSSION, HR. GELPEY WILL FILE A REQUEST FOR A
DETERMINATION OF APPLICABILITY TO BE TAKEN UP AT OUR AUGUST 12TH
MEETING.
BILL LISS WANTS TO WAIT FOR THE PROPER PAPER WORK TO DISCUSS ANY
THING FURTHER.

TONI MUSSANTE OF 12 WILLOW STREET. SHE HAS MET WITH DEP AND HAS
NOTES FROM TRACY PETERS. DEP STATES.NOW THAT THE CERTIFICATE OF
COMPLIANCE SHOULD NOT HAVE BEEN ISSUED.
BILL LISS QUESTIONED IF THE WATER IS SALT WATER?
TONI MUSSANTE - IT HAS NOT BEEN TESTED.
BUT SHEHAS ON VIDEO, STORAGE UNDER THE FOUNDATION AND THE PUMP (20
GALLONS PER HOUR AND IS 4" IN DIAMETER AND 4" IN HEIGHT).

AUGUST 12TH MEETING.

STORM AND DID MEET WITH DEP AT THAT TIME. THE BACK OF HOUSE WAS
TO BE LEFT OPEN SO THE WATER COULD FLOW PROPERLY.
FRAN MC CARTHY OF 116 LOTHROP ST. WATER CONCERNS AND SYMPATHIZES
WITH THE NEIGHBORS.
MR. GELPEY STATED THAT THE MUSSANTES HAVE RAISED THEIR LAND AND
TOOK FILL FROM THE BEACH AND .HAS CONSTRUCTED A MASONRY WALL AND IS
STORING ROCK, SAND, WINDOWS AND JUNK IN HIS YARD AND IS 2' ABOVE
THE ORIGINAL FLOOD PLAIN.
THE CHAIRMAN WANTS THE ENTIRE PACKAGE AND ALL OTHER MATERIAL AND
INFORMATION TO BE SENT TO THE CONSERVATION COHMISSION WITH THE
REQUEST FOR A DETERMINATION.
CLAYTON SMALL - THE OPPOSITION SHOULD CONTACT THE MUSSANTESAND GET
IT TOGETHER REGARDING ATTORNEY MUZIO VIEWING THE VIDEO.
THIRD ITEM ON THE AGENDA: PUBLIC HEARING JEFF BUNK
18 FOSTERS POINT LOTS 14 AND 15. TO REMOVE AN OLD HOUSE AND
REBUILD A NEW HOUSE.
THE HOUSE WILL BE 2' WIDER BUT NOT CLOSER TO THE WETLANDS. THE
APPLICANT DOES NOT HAVE TO COMPENSATE WHEN BUILDING IN A FLOOD
PLAIN. THE GRADINGS WILL NOT CHANGE. IT WILL BE A 2-1/ 2 STORY
BUILDING.
CLAYTON SMALL IS CONCERNED WITH THE STORING OF THE MATERIALS.
JEFF BUNK WILL USE A "BOOM TRUCK".
CLAYTON SMALL - MOTIONED THAT THE INFORMATION IS SUFFICIENT ENOUGH
TO CLOSE THE HEARING AND BILL LISS SECONDED THE MOTION.

FOURTH ITEM ON THE AGENDA: CERTIFICATES OF COMPLIANCE (2).
LOT 10 GROVER STREET #5-399. 'CLAYTON SMALL VIEWED IT. IT IS WELL
DONE.
CLAYTON SMALL MOTIONED TO GRANT THE CERTIFICATE OF COMPLIANCE
PROVIDING TO BE STATED IN A LETTER THAT THERE IS TO BE NO MORE
CUTTING OF TREES OR BRUSH, ALSO NOT TO STACK CUT WOOD IN THE
BACKYARD/REAR OF THE HOUSE. BILL LISS SECONDED THE MOTION.
