MINUTES OF MEETING
JANUARY 17, 1991
Meeting called to order at 7:50 r.M..
Members present:
Chairman Peter Gilmore, Vice Chairman George
Batchelder, Glenn Terry and Bill Liss.
Motion to recess for Public Hearings made by Glenn Terry and
seconded by Bill Liss. All In Favor.

Representing: Kevin De!oye from Vanasse Hangen Brust!in Company.
DPW Commissioner, George Zambouras and Kevin Deloye went on a site
walk. A. letter from the DPW Commissioner to the Commission
submitted for tonight's meeting defining the two changes requested.
At this time there were no further comments from the general
pu~.lic. Hearing none. Hearing closed.
Continued-#5-368. KELLEHER 13 Brlmbal Avenue. House constructzon
in a buffer zone. Kel!ene~'s Pond.
Representing from Hayes Engineering was Carl Balsley, from
Wakefield, MA, also, Attorney Nancy E. O'Connel!.
Photos were displayed at this time of the area flooding.
A future potential of an added garage displayed on the plan. A
dirt path around the pond, when pond rises, path is filled. Ground
elevation = 64.5 inches, of the white house, noted on the plan.
Grading down 3 To 1 slope, elevation 65" Driveway 12' in length.
50 cubic yards cf fill to be brought on for site landscapin~ near
the garage. A culvert near the garage put in for water flow out
onto Brimbal Avenue. This is a buffer zone project, with no
alteration to the wetlands. All staking requested by the
Commission has been done.
George Batchelder commented're: bedrock.
Balsley-Went i' below, struck no bedrock nor water. Cellar is
designed into the house 3' below ground level. Driveway, curb and
berm added, pavin9 is being considered.

Gerry Overberg-174 Colon Street-Concerned with water flowing over
Brimbal Avenue.
Carl Balsle¥-A catch basin should contain it on Brimbal Avenue.
DPW Commissioner-Commented that flooding should not be a problem.
In a rainstorm of 6", there is some flooding.
George Batchelder suggested to leave the hearing open in order that
all the Commission members might view it, since the scheduled site
visit for January 12th was snowed out. Other than that,
information is sufficient. Plans to close the hearing, next
Thursday's meeting, January 24, 1991. When the Orders of
Conditions are issued, a copy is to be sent to the Walter
.Residence.
RECONVENE.
Request for a Determination of Applicability for Kelleher's Pond.
Applicant: John C. Kelleher, Jr.
To perform work around the pond.
To repair erosion to the southwest corner bank of the pond. Mr.
Kelleher elaborated on the pond's history. Its uses for activities
in the winter, such as ice skating; and in the summer for fishing.
Maintenance must be done to avoid problems in the pipes and in the
pond. NOTE on site visit, the bank erosion. Plans to use a stone
and gravel mixture to hold the bank (for sturdiness). Growth and
turf to follow.
George Batchelder questioned type of equipment to be used? Also,
vegetation/yardage?
Kelleher: Approximately, 40 yards of material will be brought in
from the far side (gravel), will go 2 to 5' into the pond. To be
pushed in with a shovel.
Saturday morning, anytime, Mr. Kelleher will be on the site for any
Commissioners viewing it.

TABLEd for January 24th, when there is less snow to inspect.
Orders of Conditions-BRIDAL PATH LANE, Dan Finn, Trustee. #5-366.
George Batchelder: Flow, sediment down the hill? To include in the
orders, no clearing on the south, southeast side. Standards.
All of A, B, C, D & H. No removal of standing trees or shrubs on
the south, southeast side of the stream. ALL IN FAVOR.

Orders of Conditions for THE BEVERLY #5-367. Plan dated January
10, 1991 (revised). All but E< F & G.
Standards-any debris and or silt that breaks through the siltation
barrier and into the wetlands will be cleaned up within 5 working
days and the Conservation Commission is to be notified, in writing,
All In Favor.
Discussion: Beverly Airport #5-279.
Plan viewed upon and discussed by George Batchelder. Airport
Commission is responsible to watch over this (tree clearing) after
the first year. George Batche~der to write to DEP. No re-grading,
also a snow fence is needed on the northside.
Also, grubbing, siltation barrier below "A" in the wetlands,
Chairman to submit letter to DEP.

BUDGET DISCUSSION
Eric Rizzo and Eric S.Hyler-Student Interns.
Motioned by George Batchelder and seconded by Glenn Terry to accept
both to work for the Conservation Commission and to be budgeted for
it. Eric Rizzo/Eric Hyler to assist. All In Favor.
Bill Liss motioned to adjourn at 9:25 P.M., seconded by Glenn
Terry.
