LICENSE BOARD MINUTES -' DECEMBER 13, 2012
The meeting of the Beverly License Board was called to . order on Thursday, December 13, 2012
in the Council Chambers at 3:00 pm.
In attendance at the meeting were: Board Members John Roccio, James Duggan, Police Liaison
Sgt. William Page, Lt. Mike Devlin and Clerk Martha Lewis.
Absent: Chairman Richard Kelley
Meeting was called to order at 3:00 pm by John Roccio.
1. Invited in: G &S Sports, Inc, dba Sports Page Pub Ra mond Howell Mana er
Representing the Sports Page Pub - was Attorney Jack Altshuler.
Sgt. Page addressed the Board. He stated that the Police Dept, was no longer interesting
in pursuing the matter. He stated that there was a discrepancy in the procedure that took
place during the compliance check.
Mr. Duggan asked Sgt. Page whether the matter was being withdrawn. Sgt. Page stated
that the police department would not be seeking any action by the License Board. Mr.
Roccio concurred that the matter would be withdrawn. Attorney Jack Altshuler spoke on
behalf of the Raymond Howell, manager of the Sports Page. Attorney Altshuler
requested that the Board vote in favor of dismissing the matter for the record.
Mr. Duggan made a motion to dismiss the charges against G & S Sports, Inc. dba Sports
Page Pub. Mr. Roccio seconded. The motion passed 2 -- 0.
2. Application for Transfers and Change of Location ---- All alcohol license from Lil Ventures
dba Cornerstone to Fazio Enterprises, Inc. dba Sonny's. Mobil, 453 Essex Street, Michael
Fazio, Manager

The application package was reviewed. Clerk informed the Board members that upon
approval of the transfer and change of location from the Local Licensing Board and the
ABCC, Mr. Fazio would be required to turn in his current wine and malt beverage license
to the City.
Mr. Roccio asked Mr. Fazio how he intended to separate the convenience/ grocery store

from the alcohol being sold. Mr. Fazio stated that there would be locks on the cooler
doors and the lights in the area that the all alcohol is sold would be dark during "off
hours ".
Mr. Roccio further asked him if the diagram included in the application package
represented the layout of the store. Mr. Fazio confirmed the diagram represented , the
layout of the store.
Mr. Duggan asked Mr. Fazio if he would be stocking less groceries to accommodate the
sale of all alcohol. Mr. Fazio stated that he would be installing taller shelving for the
groceries and rearranging the stock so he would not be losing any space.
Mr. Roccio mentioned that the Cornerstone Liquors i g s scheduled for a hearing with the
ABCC in February 2013. Mr. Lance Lane, current owner of the Cornerstone was present.
Mr. Lane stated that the problem with the ABCC was in regards to lottery sales and not
about a violation with the alcohol license. He further stated that all monies owed to the
State would be paid and he expected a favorable result to the hearing.
Mr. Duggan asked for a further explanation. Mr. Lane explained that the issue with the
ABCC is over lottery sales. He believes that the amount owed is approximately $2,000
and those monies would be paid in full.
Mr. Duggan made a motion to approve the application for a transfer of the alcohol license
from Lil Ventures, Inc. dba Cornerstone Liquors and the change of location to Fazio
Enterprises dba Sonny's Mobil at 453 Essex Street. Mr. Roccio seconded the motion.
The application was approved 2 — 0, with the understanding the Mr. Fazio's current wine
and malt beverage license would be returned to the Bever) License Board upon approval

by the AB CC of the transfer of the all alcohol license.
3. Applications for Common Victualler's License from Chipotle Mexican Grill, 55 Dodge
Street and Freeda's Pizza & Calzones at 55 Dodge Street. Both applications were
reviewed and discussed. All permits from building inspector and health department are
in order. Both restaurants are located in the North Beverly Shopping Plaza - Chipotle
Mexican Grill is located in the former space of a video store and Freeda's Pizza &
Calzones is located in the former space of a pizza shop.
Mr. Duggan made a motion to approve and issue a common victualler's license to
Chipotle Mexican Grill and Freeda's Pizza and Calzones. Mr. Roccio seconded the
motion. Applications approved 2 -- 0.

4. one Day License
Six applications for one -day special licenses were received. Applications were reviewed
and all information appeared to be in order. Mr. Duggan made a motion to approve the
six one -day licenses as submitted. Mr. Roccio seconded the motion. Motion passed 2 ---
0.
5. Minutes, of the meeting for November 8, 2012 were reviewed. Mr. Roccio asked that the
name of the cashier from Ryal Side Liquors be corrected to read Mr. Kevin Henebury.
Clerk noted the revisions. Mr. Duggan made a motion to accept the minutes from the
meeting held on November 8, 2012 with the revisions as requested. Mr. Roccio seconded
the motion and the minutes of the meeting were accepted with revisions as noted by a
vote of 2 --- 0.
6. other Business --
a. Discussion of All Ages Event —Mr. Duggan to follow up with Councilor Wes Slate.
as to any future or further action to be taken by the City Council.
b. Liquor Compliance Seminar hosted by the Beverly Police De artment and Beverl
License Board On January 14 there will be an informational seminar held at the
Beverly Senior Center, 90 Colon Street from 7:00 pm to 9:00 pm. Several topics will
be discussed including liquor laws, compliance, review of fake i.ds., one day licenses
and other regulations. A notice of the seminar was handed out to licensees during the
issuance of 2013 licenses. Clerk to do a mailing if needed.
Hearing no further business, Mr. Roccio made a motion to adjourn. Motion seconded. Meeting
adjourned at 3:40 pm for the issuance of 2013 licenses.
Next meeting is scheduled for Thursday, January 3, 2013 at 6:30 pm in the City Council
Chambers.
