RE: Extension of Workmen's Compensation Benefits — School Department
4/15/2011
Regular Meeting
Dear Honorable Council:
On December 12, 1913, the City of Beverly adopted Chapter 807 of the Acts of 1913, an act providing for the
compensation of public employees for work - related injuries, i.e. Workmen's Compensation. In Beverly, such
coverage at this time extends only to laborers, workmen, mechanics, and nurses as those terms have been
interpreted by law, but does not include all City employees.
Current collective bargaining agreements in place between the Beverly School Committee and the Beverly
Teachers Association Unit A (TEACHERS), Unit B (ADMINISTRATORS), and Unit C
(PARAPROFESSIONALS), as well as the current collective bargaining agreement between the Beverly School
Committee and the American Federation of State, County, and Municipal Employees, AFL -CIO, State Council
#93 Local #2894 (CLERICAL EMPLOYEES) all provide that the members of such bargaining units "...will be
covered by worker's compensation ... pending City Council approval." All other current union employees of the
Beverly School Department are already covered by Workmen's Compensation. All non -union employees of the
Beverly School Department are not so covered at this time.
In order to extend Workmen's Compensation to all employees of the Beverly School Department, I request that in
accordance with G. L. Chapter 154, Section 69 your Honorable Council determine that the term laborers,
workmen, mechanics and nurses now include all employees, both union and non - union, employed by the Beverly
School Department and that all such employees be covered by Workmen's Compensation.
Very truly yours,
William F. Scanlon, Jr.
Mayor
