By Councilor Grimes:
The Code of Ordinances, City of Beverly, Massachusetts is hereby amended by adding the following language after the end of the last
sentence of Section 3-318, as most recently amended by Council Order 174A of 2008, the following:
The Commissioner of Public Services, Public Works and Engineering shall, prior to July 1, 2010 and prior to July 1 of each subsequent
year ending in an even number, submit to the Clerk of the City Council a written paving management plan. Such plan shall include, but
need not be limited to, a list of repairs to be made upon all highways, streets and bridges; the criteria of selection, estimates of cost and
funding sources, planned time sequence of such repairs, estimates of when such repairs shall occur, and provision for emergency repairs.
Each such plan shall, as soon as may be practicable, be reviewed by the City Council, which may refer said plan to the Committee on
Public Services.

The Massachusetts Bottle Bill
A Resolution
Whereas The Massachusetts Bottle Bill, enacted in 1982, has allowed Beverly residents to enjoy a cleaner environment by creating an
incentive for users of certain beverage containers to recycle those used containers; and,
Whereas, states with deposit laws have higher residential recycling rates of beverage containers than those of non-deposit states, and;
Whereas litter decrease in states with Bottle Bills averages 70-850/0, and,
Whereas, through the Massachusetts Bottle Bill, we recycle nearly 800/0 of deposit containers, but only 200/0 of non-deposit containers, and
Whereas the Governor of the Commonwealth, and members of the Massachusetts Senate and House of Representatives have recognized
that the original bottle bill does not take into account those beverages such as bottled water, sports drinks, and teas.
Whereas the addition of bottled water, sports drinks, and teas to the Bottle Bill will decrease the total volume of municipal solid waste that
is needed to be collected, thus saving disposal fees and landfill spac
THEREFORE BE IT RESOLVED: That the Mayor and the City Council of the City of Beverly commemorate the 27th anniversary of the
implementation of the Massachusetts Bottle Bill.
Furthermore, Be It Resolved that the City of Beverly be placed on record as being in support of the Massachusetts Beverage Container
Deposit Law and encourages its strengthening through expanding the list as recommended by the Governor in his proposed budget and
currently being considered by the House and Senate Joint Committee on Telecommunications, Utilities and Energy.
Furthermore, Be It Resolved that the City of Beverly goes on record in supporting programs that encourage residents and visitors to return
or recycle all beverage containers and other recyclable materials to fully utilize the currently available recycling programs.
Be it Further Resolved that the City of Beverly request that our State Representative and State Senator, and our Governor support and
vote in favor of updating the Massachusetts Container Beverage Law, and that the City Clerk spread a copy of this Resolution upon the
City Records.
Recommend the Council approve the resolution
