Chairperson Dinkin calls the meeting to order.
1. Subdivision Approval Not Reauired (SANR) - 7.9 & 11 Con2ress Street - Eleven
Con2ress Street Corp. & Hansbury Court. LLC
Attorney Marshall Handley states that they are reconfiguring the lots to have more
parking on each lot.
Zambernardi confirms that this lot meets all of the zoning requirements for an ANR.
Thomson: Motion to endorse this ANR, seconded by Dunn. Passes 6-0-2. Mack and
the Chair abstain.
2. Subdivision Approval Not Reauired (SANR) - 510 Cabot Street and 2 Bradford
Road - J. Levv & N. Levv. Trustees of 510 Cabot Street Realtv Trust
Attorney Mark Glovsky states that he was recently here with another ANR plan for this
project and then the building inspector, Steve Frederickson advised him that the frontage
did not comply, so to satisfy the building inspector they bent the property line further
down Bradford Road toward Cabot Street. He adds that Mr. Frederickson claimed that
the frontage needed to be on the paved portion of Bradford Road. Glovsky confirms that
there are now 100 feet of frontage on the paved portion of Bradford Road. He points out
the change on the plan. He states that he doesn't necessarily agree with Mr.
Frederickson's interpretation, but rather than contest it, his clients found this alternative
means to comply with the frontage as it is interpreted by Mr. Frederickson.
Thomson states that in the future the Board will need to look more closely at the frontage
when reviewing ANR's.

Thomson: Motion to endorse this ANR, seconded by Flannery. Passes 7-0-1. The
Chair does not vote.
3. Subdivision Approval Not ReQuired (SANR) - 34 Cole Street - Herbert Rice
Zambernardi states that the applicant has requested to withdraw without prejudice,
because there are some frontage issues that haven't been resolved.
Thomson: Motion to accept the withdrawal without prejudice, seconded by Flannery.
Passes 7-0-1. The Chair does not vote.
4. Set Public Hearin2 Date - Site Plan #100-09 - Black Cow Restaurant - One
Water Street - City of Beverly and Joseph A. Leaone. c/o Black Cow Restaurant
Thomson: Motion to schedule the public hearing for 9:00 p.m. on March 17, 2009,
seconded by Flannery. Passes 7-0-1. The Chair does not vote.
5. Continued Public Hearin2 - Site Plan Review Application #98-08 - CVS -
northeasterly corner of Elliott and Rantoul Streets - G.B. New En2land 2. LLC. R.
Me2uerditchian & ARDI Co.. LLC
The members agree to meet again on Monday, March 2,2009, at 7:30 p.m.
Harris: Motion to recess and reconvene at 7:30 p.m. on March 2, 2009, seconded
by Hutchinson.
6. Approval of Minutes - Januarv 20. 2009 Meetin2
Harris: Motion to approve the minutes, seconded by Dunn. Passes 7-0-2. The
Chair and Hutchinson abstain.
Harris: Motion to adjourn, seconded by Hutchinson. All members and the Chair
vote in favor. The motion passes 8-0.
The meeting is adjourned at 8:00 PM.
