The City of Beverly has received a Notice of lntent regarding the prospective sale of two parcels of
la~d on which the City holds the Right of First Refusal.
The parcels are: 1) Beverly Assessor's. Map 57, Lot2 and
2) Beverly Assessor's Map 45, Lot 26 excluding p portiofi known as Parcel A.
The purchase price for the first parcel is $470,000 and that for the second is $700,000. The parcels
total approximately 15.5 acres.
I would urge the Council to give early considention to the question of whether the City should
entertain the question of acquiring the land. To do so would require the expenditure of $ 1 , 1 70,000. I
would be happy to participate with the Council in discussing this matter.

Chapter 700 of the Acts of 1913 as amended requires the Salem and Beverly Water
Supply Board to annually determine the volume of water supplied to the cities of
Salem and Beverly during the three years prior to September 30. This date establishes
the proportions in which the cities shall pay the expenses for the operation of the
Water Board for the next succeeding fiscal year.
At its meeting on November 2, 1999 the Salem and Beverly Water Supply Board
certified that during the three-year period prior to September 30, 1999, Salem
consumed 49.7% of the water supplied while Beverly consumed 50.3%. A copy of the
determination is attached. Consequently, the Water Board certified that the
assessment for the fiscal year 2001 budget period shourd be proportioned between
the cities on the basis:
SALEM 49.7% Beverly 50.3%

RE: 121A Agreement with J.T. Associates
Civil Action No. 98-6232-G
The City Assessors Office has been working with the Solicitors Office in an effod to
resolve the above mentioned superior coud case. Attorney's David J. Shlansky and
John P. Sullivan represent the Plaintiff's.
The City entered into a 121A agreement with the plaintiff's that spans a 40 year
period commencing in 1976 and ending in 2016. The agreement called for J.T.
Associates to pay the Commonwealth of Massachusetts an annual excise tax of 05%
of gross revenue plus 01% of $2,000,000 which was deemed the Realty Assessment at
the time of the agreement. Said excise and realty assessment was then reimbursed
to the city in lieu of a real estate tax bill and was intended to be less than what the
property would pay in real estate taxes if not subjected to the 121 A Agreement.
Since 1987 (when Proposition 2 '~ went into effect) the property has been paying
more money under the excise than if it were paying property taxes. The sum of all
years is approximately $240,000 more than if subjected to property taxes.
The plaintiff's attomey's are looking for 1/~ that money to be returned to them by
having the next three years payments returned to them. At the end of the three-year
term the 121A agreement would be terminated and the property would pay
property taxes pursuant to M.G.L Chapter 59.
The above mentioned offer assumes that the Plaintiff's would be entitled to a
retroactive abatement and that they are not obligated to adhere to a contract that
they willingly entered into with the City in 1976. The rules governing real property
taxation have changed, but there was no provision in the agreement specifying that
they would pay the lesser of property tax or excise tax.
The City of Lynn is currently negotiating with'the same Attorney's on a 121 A
agreement. Their position is they are willing to brake the agreement, but are
unwilling to give any cash back for past overpayments between the excise tax and
the property tax.
It should also be noted that in all but two (2) years the investors were allowed to
recoup the full amount of their annual cash return. Any monies turned back to them
should be used for their capital improvement funds as the investors have already
received cash returns.
