Re: Land Takings
Dear Honorable Council:
I am writing to request that you approve, permit and direct me to effect the following takings and
relocations, and take such steps as are necessary to transfer and appropriate the funds to accomplish
that purpose,
Parcel 1:31 BurIcy St., Wenham (Relocation) Award $56,650
Acquisition of house and property was identified by the FAA as necessary to remove from the nmway
safety zone at Beverly Municipal Airport and parcel was acquired in September, 1997. Per federal and
state relocation regulations, the owners' daughter and children were allowed to stay until comparable
decent, safe, and sanitary housing could be found. The relocation award has been established by FAA
authorized relocation consultant and is a final cost within the limit authorized by the FAA. Upon
payment the City will receive $50,985 (90%) in reimbursement from the FAA, $3,965 (7%) from Mass.
Aeronautics Commission and $1,700 (3%) from the airport. Please authorize me to effect this
relocation and transfer and appropriate sufficient funds to accomplish this acquisition.
Parcel 2:35 Burley St., Wenham (taking in fee) Award: $317,000.
This house and property was identified by FAA as necessary to remove from the nmway safety area at
Beverly Municipal Airport. The price of the acquisition has been established by FAA approved
appraisal and negotiation, and is a final price within the limit authorized by FAA. The price includes
relocation and moving expenses. Upon payment and acquisition ofthe parcel, the City is expected to
receive $285,300 (90%) reimbursement from FAA, $22,190 (7%) from Mass. Aeronautics Commission
and $9,510 from the airport. Please authorize me to effect this acquisition through the exercise of the
City's power of eminent domain and transfer and appropriate sufficient funds to accomplish this
acquisition.
Parcel 1 and 2:31 and 35 BurIcy Street, Wenham (Demolition, engineering and legal fees)
Award: $26,675
These are demolition, engineering and legal fees associated with the Parcel 1 and 2 acquisition and
relocations as submitted by the airport engineering consultant. The City is expected to receive $24,007
(.90%) reimbursement from FAA, $1,867 (7%) from Mass. Aeronautics Commission and $800 from the
an'port. Please authorize me to effect this work and transfer and appropriate sufficient funds to
accomplish this acquisition.

Last march, the City Council and Planning Board conducted a Joint Public Hearing
on the above-referenced Order which proposed a series of amendments to the
Zoning Ordinance. While the Planning Board submitted most of its recommendations
to you in April and May, the Council was unable to vote on the proposals within the
timelines specified by State law (MGL Chapter 40A, Section 5).
Accordingly, the Planning Board respectfully requests that the Council consider
scheduling another joint public hearing to discuss Order #43. The Planning Board
anticipates the process to move fairly swiftly, since it has previously formulated
recommendations on all but two or the proposed amendments.

RE: Airpod Proposals
Dear Honorable Council:
As you may know, due to changes in corporate structure and operations, GTE Service
Corporation has made little use of the facilities it holds at Beverly Airport under lease
from the Beverly Airport commission and approved by this Council GTE has
expressed interest in terminating its lease, conditioned upon the approval and
acceptance by the City of leases for the GTE facility to North Atlantic Air, Inc, and
&Yanai Sightseeing LLC.
With the Airport Commission and on its behalf, I have negotiated leases with North
Atlantic Air, Inc. and Yanai Sightseeing LLC, copies of which I enclose herewith for
your review and approval. ~ have also negotiated a termination transaction with
GTE, the substance of which is set forth in the attached letter of October 29 from GTE
to the City of Beverly. It should be noted that the monies paid by GTE are to be
deposited in the Airport's enterprise fund for the operational requirements of the
Airport.
Please refer these matters to the appropriate Committee for consideration. I will be
pleased to appear with representatives of the Airport commission to respond to any
questions you may have.
