Recommendation to City Council for acceptance of portions of Thaxton Road and Old 20 Planters Road, in addition to Cumnock Street,as public ways. 21 22 Clawson stated that the City is trying to get some private streets accepted as public ways. These 23 streets are being lived on and are ready to be paved but cannot be until they are accepted as 24 public ways. The Board can make a recommendation to the City Council that they be accepted. 25 26 In response to a question from Gomes, Clawson explained that there are over 200 private ways in 27 the City. Gomes asked why more public responsibility is being taken on if this is the existing 28 condition for these ways. Clawson explained that most of these ways were intended to be public 29 and taken over, or the developer went bankrupt. Trash removal is also a concern with these ways 30 being accepted. Beckwith explained that this seems to be part of an overall plan and process for 31 the City. 32 33 Beckwith: Motion that the Planning Board recommend to the City Council the acceptance of 34 portions of Thaxton Road and Old Planters Road, in addition to Cumnock Street, 35 as public ways. Continued Public Hearing: Site Plan Review 4167-24 and Inclusionary Housing#28-24-- 54 478 Rantoul Street--478 Rantoul Street LLC 55 a. Conversion of existing 3-family residential use to 250 s.f. of commercial use on the 56 first floor. A one-bedroom residential use and three-bedroom residential use will 57 occupy the rest of the existing building. The existing building will be connected to 58 the new building consisting of a first level parking area and four levels of residential 59 use above totaling 30 new one-bedroom residential units. 60 61 Tom Alexander, of Alexander and Femino presented on behalf of the applicant. He explained 62 that, since the last hearing, this project has been reviewed and unanimously approved by the 63 Design Review Board (DRB) and Parking&Traffic Commission (P&TC). Various departments 64 have reviewed it, including Engineering,the Fire Department, and the Health Department, and 65 have indicated that they would like certain conditions, and the applicant has agreed to 66 incorporate those conditions into a decision. This is a site plan review, not a special permit, 67 meaning that this is a by-right project subject to reasonable conditions. All officials have 68 concurred that this proposal complies with all zoning requirements and safety codes for the 69 district. One of the conditions the P&TC indicated was a Temporary Traffic Control Plan, 70 although this typically does not occur until the building permit phase. He respectfully requested 71 that the Board approve the application with any reasonable conditions. 72 73 Beckwith stated that the existing conditions plan seems to lack certain information on abutting 74 properties. He expressed concern regarding the emergency access provided along the perimeter 75 of the building. Alexander stated that the applicant complies with the law as it currently is. The 76 applicant does not have control over neighboring properties or potential future contingencies. 77 Beckwith stated that, in the future, this property may be landlocked and may not be accessible 78 for emergency equipment. Alexander stated that there is no requirement for that. The applicant 79 cannot be required to do something that is not within its control. Vincent Orlando,principal for 80 479 Rantoul Street LLC, stated that a hypothetical building abutting this property in the future 81 would have to go through this same process. Hutchinson suggested an easement for aerial access 82 to the property if needed. Orlando stated that he reached out to the abutting property owner but 83 never heard back. Beckwith expressed concern with there being no emergency access for 84 equipment around the proposed building. 85 86 Fire Captain Jake Kreyling stated that the codes do permit the construction to exist as-is and that 87 the building can have sprinklers. The City likes to have three sides of access for all new 88 buildings, but this is not required by code. The Department requested that the applicant provide a 89 document as to how its equipment can access the site,which was provided showing that the Page 2 of 12 City of Beverly Planning Board August 20,2024 Meeting Minutes 90 southwest and southeast corners can be accessed. The Board and applicant need to realize the 91 risk involved with this proposal. 92 93 Beckwith asked if the Board should consider calling out for emergency vehicle access through 94 Rantoul Street in the plan. Kreyling stated that this project should be constructed in such a way 95 that the building does not impinge upon Rantoul Street so that the Department can continue to 96 access it. Enforcement can be an issue if the construction does not align with the plans,which is 97 why the Department tries to address them at this stage. 98 99 There was no public comment at this time. 100 101 Flannery: Motion to close the public hearing. (7-0). 104 105 The Board discussed the merits of the matter. Beckwith expressed concerns with some of the 106 safety issues of this plan. The plan meets the letter of the law, but he is still concerned with the 107 safety of the site. This may just not be an appropriate site for the proposal. Hutchinson stated that 108 she also has significant concerns,even though this is a by-right plan. She asked what happens 109 when a by-right plan is not in the public interest. Some land is not meant to be built on. 110 III Alexander stated that the determination of the public interest is made by the City Council. The 112 Planning Board is not empowered to say that the City Council made a mistake in determining the 113 zoning. Those with jurisdiction have determined this proposal to be an appropriate use and 114 location. Board members are entitled to their opinion but must apply the law as it exists. The 115 Board cannot substitute its opinion for the work done by the City Council and others to create the 116 existing zoning. Hutchinson disagreed with this assessment. 117 118 Miller expressed that the jurisdiction sits with the Fire Department,which has not disapproved 119 this project. It appears the Department has given its approval, and he does not believe he can 120 override this. Beckwith stated that the Department noted an increased risk from this project 121 compared to similar projects. The height, scale, and access points for the project lead to this 122 safety risk. Miller stated that this is apparently not a high enough risk for the Department to 123 negate the proposal. Bartley stated that an elevated risk has been identified and she would be 124 open to conditions. Beckwith suggested a condition that the applicant enter into some form of a 125 legal agreement with the owners of 85-93 Elliott Street, 434-440 Rantoul Street, and 446-448 126 Rantoul Street, and provide emergency vehicle access, including aerial fire apparatus, along 127 abutting property lines to the 478 Rantoul Street property, now and in the future. Said legal 128 agreement must be approved by the City Solicitor, City of Beverly, and Essex County Registry 129 of Deeds. Hutchinson stated that this must also run with the property. 130 131 Alexander stated that,to force someone to go off their property to get legal rights is not a 132 reasonable condition. 133 Page 3 of 12 City of Beverly Planning Board August 20,2024 Meeting Minutes 134 Flannery: Motion to approve the Site Plan Review application#167-24 located at 478 135 Rantoul Street with the applicant being 478 Rantoul Street LLC, with the 136 following conditions: 137 138 1. To the extent permissible and approved under Fair Housing and the Department 169 of Housing and Community Development,the Applicant will honor any local 170 preference should the City of Beverly Administration request it, up to the EOHLC 171 maximum of 70%. EOHLC will require that this request be made in collaboration 172 between the Applicant and City. 173 174 6.Any changes made in any plans,proposals, and supporting documents 175 approved and endorsed by the Planning Board without the written approval of the 176 Planning Board, shall require submission of a modification request to the 177 Planning Board for review and approval and shall include a description of the Page 4 of 12 City of Beverly Planning Board August 20, 2024 Meeting Minutes 178 proposed modification, reasons the modification is necessary, and supporting 179 documentation. The Planning Department shall determine the course of review. 180 181 7. Prior to the commencement of authorized site activity,the Applicant shall 182 provide to the Planning Department the name, address, email, and business phone 183 number of the individual who shall be responsible for all construction activities on 184 site. 185 186 8. The terms, conditions, restrictions and/or requirements of this decision shall be 187 binding on the owner and its successors and/or assigns. In the event of the transfer 188 of the site as a whole, within five (5) days of such transfer,the owner shall notify 189 the Board in writing of the new owner's name and address. 190 191 9. Refuse removal, ground maintenance, and snow removal shall be the 192 responsibility of the Applicant. 193 194 10. As-built Plans, stamped by a Registered Professional Engineer, shall be 195 submitted to the Beverly Planning Department and City Engineer, prior to the 196 issuance of the Certificate of Occupancy. The As-Built plans shall be submitted to 197 the City Engineer in an electronic file format suitable for the City's use and 198 approved by the City Engineer, prior to the issuance of the Certificate of 199 Occupancy. 200 201 11. To the extent that construction work has been completed sufficient for a 202 Certificate of Occupancy to be issued for a portion of the Project or the Project in 203 its entirety, but that the As-Built plans have not yet been fully completed (for said 204 portion of the Project or the Project in its entirety), the applicant may provide a 205 performance bond or surety in an amount and form subject to approval of the 206 Planning Department to ensure that the As-Built Plans are completed within a 207 reasonable timeframe. 208 209 12. The Applicant shall be responsible for maintenance of the stormwater 210 management system. In the event that the Applicant, its successors, or agent fails 211 to maintain the stormwater management system in accordance with the operation 212 and maintenance plan(Stormwater System Inspection and Maintenance Schedule) 213 as shown on the above-referenced plan, the City may conduct such emergency 214 maintenance or repairs, and the Applicant shall permit entry onto the Property to 215 implement the measures set forth in such guidelines. In the event the City 216 conducts such maintenance or repairs,the Applicant shall promptly reimburse the 217 City for all reasonable expenses associated therewith; if the Applicant fails to so 218 reimburse the City, the City may place a lien on the property to secure such 219 payment. 220 Page 5 of 12 City of Beverly Planning Board August 20,2024 Meeting Minutes 221 13. Violations of any condition shall result in revocation of this Site Plan Review 222 approval by the Planning Board, unless the violation of such condition is waived 223 by a majority vote of the Planning Board. 224 225 Gomes seconds. 226 227 Discussion: 228 Beckwith suggested an amended motion with an additional condition. 229 230 Beckwith: Motion to include an additional condition for the Site Plan Review of 478 Rantoul 231 Street that the applicant enter into a legal binding agreement with the Ardi 232 Company LLC, owners of 85-93 Elliott Street, 434-440 Rantoul Street, and 446- 233 448 Rantoul Street, to provide emergency vehicle access, including aerial fire 234 apparatus, along abutting property lines with the 478 Rantoul Street property, now 235 and in the future that will run with the property. Said legal agreement must be 236 filed with the Essex County Registry of Deeds. Hutchinson seconds, 237 238 Discussion: 239 Gomes stated that the Board can impose reasonable conditions and there is no 240 definition of`reasonable,' but he finds this condition to be unreasonable. The 241 project meets all of the rules and is not asking for any exemptions. 242 243 Beckwith stated that the situation is that public officials did not likely contemplate 244 a project of this type,with extremely limited Fire Department access and 245 potentially no aerial access. Not every circumstance can be planned for. It is 246 unclear what will happen to these properties into the future, and he wants 247 emergency access as a minimum. 248 249 Gomes stated that the Board is betting on codes and fire suppression systems to 250 make the properties safe. 251 252 Clawson stated that, as a professional planner, he believes this could be an 253 unreasonable condition. It is unclear how it would be enforced. 254 255 Motion failed by roll call vote: Hutchinson - aye; Flannery -nay; Bartley -nay; 256 Gomes - nay; Lewis-nay; Miller-nay; Beckwith—aye. (2-5). 257 258 The Board discussed Flannery's original motion. There was discussion regarding the suggestion 259 for more green space on the property per the Board of Health. (7-0). 268 269 The Board took a brief recess. 270 271 4. Public Hearing: Special Permit#194-24-- 14 Greenwood Avenue--Benco LLC 272 a. Creation of Pork-Chop shaped lots. 273 274 Gomes: Motion to reconvene the meeting at 8:33pm. Beckwith seconds. (7-0). 277 278 Tom Alexander stated that this is a three-lot project to create two pork-chop shaped lots. 279 Comments have been received from the Planning, Fire, and Engineering Departments. 280 281 Clawson reads the legal notice. Robert Griffin, P.E., Griffin Engineering Group, LLC, reviewed 282 the existing conditions for the three lots. The proposed division line is located away from the 283 existing structure and so no modifications are needed. The Fire Department expressed some 284 concern regarding access to the site, so a SWEP path analysis was completed to show how it 285 could access the right of way. The road will be widened between 14%19' to allow for better 286 access. 287 288 Stefano Basso, Salem, MA, stated that he is interested in purchasing the existing home on this 289 property. The subdivision of the lots is proposed as a way to subsidize the restoration of this 290 home. The renovation will be completed in phases. A letter of support from Historic Beverly was 291 received for this project. The architectural schemes for the proposed lots were reviewed. 292 293 Beckwith asked about outreach to the neighbors. Ben Carlson, Benco,LLC, stated that the 294 applicants have spoken to the neighbors on a number of occasions to discuss the locations of the 295 proposed homes. The two pork-chop lots are proposed for the project to be financially viable and 296 a shared driveway to them is proposed. 297 298 Alexander stated that Captain Kreyling, Beverly Fire Department, viewed the property and noted 299 that the existing shared roadway was unsafe. Changes are proposed to the roadway to make it 300 safer. The width of the roadway is proposed to be increased in certain areas to make it easier for 301 emergency vehicle access. The edge of the right of way is well defined by the property lines on 302 one side and the other side is defined on the 1972 record plan.An easement will be provided to 303 make a turnaround area. There are some issues with utilities to work though. 304 305 Beckwith asked who currently handles the maintenance and plowing of the roadway. Carlson 306 stated that the neighbors all chip in. A shared driveway agreement could be considered. 307 308 Kreyling stated that the Department's equipment cannot currently access this area. The plan, as 309 designed,will alleviate this concern. The design will also help in terms of snow removal in the 310 winter. Page 7 of 12 City of Beverly Planning Board August 20,2024 Meeting Minutes 311 312 Beckwith noted that there is a vernal pool on the site, though it will not apparently be disrupted 313 from this project. He asked about ledge within the sites. Griffin explained that ledge is always a 314 concern but, due to the large piece of land, fill can be placcd over areas to create the necessary 315 frost protection for water lines in order to not have to dig as far down. The houses have been 316 proposed in the areas that seem most advantageous. 317 318 Hutchinson asked for public comment at this time. 319 320 Steve Catalucci of 133 Common Lane stated that he found out about this hearing via a mailing. 321 This is a beautiful lot with a lot of history. The applicants are proposing to create two additional 322 lots in order to finance rehabilitating the existing home, but at what cost. The ledge in this area is 323 outstanding and it is unclear why anyone would want to try to build here. The construction is 324 only to benefit the applicants financially in order for them to buy a house that they may or may 325 not be able to afford and resurrect it. This is to the detriment of those who currently live around 326 the property without any benefit. He has not been part of the discussion regarding this project 327 and opposes it fully. 328 329 Hutchinson asked about the specific detriments of this project. Catalucci stated that the two new 330 lots will be major disruptions to the existing wildlife and natural habitat. The movement of the 331 land for the creation of housing lots will also cause environmental impacts. There are vernal 332 pools flowing through his property onto the nearby land. To push everything closer to his 333 property and other abutting properties for the benefit of one owner makes no sense. 334 335 William French, 125 Common Lane, stated that he heard that the applicant plans to use Common 336 Lane to access the utilities needed. He asked how this area will be accessed. Griffin stated that 337 the sewer line will run from Greenwood Avenue to Common Lane and up to the City manhole 338 that several houses are already tied into. 339 340 Charles Ball of 6 Greenwood Avenue explained that there is a single lane gravel driveway in this 341 area to access several of the lots. The first section is very steep. He is concerned that two 342 additional houses would lead to a total of nine lots on a shared, single lane road. A condition of 343 approval should require measures to allow cars to pass each other for the first 500'. 344 345 Charles Dunne, 16 and 18 Greenwood Avenue, stated that the applicant plans to save the existing 346 historic house.The applicant plans to save the house from likely demolition, but only if they can 347 first create two additional house lots. The entire neighborhood is accessed by a narrow gravel 348 driveway. The road will likely become impassable during construction of the new lots and 349 associated utilities for current homeowners. The existing driveway should be widened and 350 improved if this application is approved. 351 352 Donald Brusca of 11 Greenwood Avenue stated that the current owner of the property in 353 question is not present this evening. Those who live in the neighborhood take care of the lands 354 and the road. She asked about how the septic system will be addressed. There is no way to 355 connect to the City sewer, The current owner has not been a good steward of the property. Page 8 of 12 City of Beverly Planning Board August 20, 2024 Meeting Minutes 356 Before any plan is approved,the developers should be required to present plans addressing the 357 system of streams on both sides of the driveway. 358 359 Clawson read comments from the Health Department. The property currently possesses a 360 cesspool for subsurface sewage disposal. This system failed its Title 5 inspection on January 13, 361 2014. The current system does not meet the minimum requirements for Title 5. On December 7, 362 2017,test pits and soil evaluations were conducted to assess the onsite conditions for an 363 upgraded system. The soil did not possess suitable conditions for an upgraded system in the 364 proposed area. Bedrock was encountered at 24". Additionally,the current dwelling has eight 365 bedrooms which would require a sizable leaching field for proper filtration. if sewer can be made 366 available,the recommendation is that the Planning Board consider the applicant require the lots 367 be connected to sewer. He noted that this hearing is only to allow for the creation of pork-chop 368 lots, but no site plans have yet been filed for these lots. 369 370 Suzanne Lamont reviewed the draft Great Estates Ordinance. 14 Greenwood Avenue is one of 371 the historic properties that was considered. The property contains many of its historical elements. 372 Adoption of the ordinance remains a goal of the City's Historic Preservation Plan. Ahead of its 373 adoption,the pork chop lots request before the Board seems to align with the intention of 374 balancing new housing creation without leading to the detriment of existing historic structures. 375 376 The Board discussed a potential site visit. 377 378 Clawson read three additional letters into the record. 379 380 Flannery: Motion to hold a site visit at 14 Greenwood Avenue on September 12, 2024, at 381 12pm. (7-0). 388 389 5.Public Hearing: Special Permit#195-24--14 Paine Avenue—Ford and Kate O'Neil 390 a. Creation of Pork-Chop shaped lots. 391 392 Clawson reads the legal notice. Miranda Siemasko, representing the applicant,this property is a 393 four-acre parcel that is currently vacant. The applicants purchased the property in December 394 2023 and are the owners of the immediately adjacent property at 22 Paine Avenue. A house was 395 located on the property until 2013. The lot has been acquired twice to preserve privacy for 396 surrounding owners. The property was noted to be a pork-chop lot, specifically with 88 linear 397 feet of frontage on a private way. The lot however actually has more than twice the amount of lot 398 area required. The proposal is to create one lot on the property. The special permit criteria are 399 satisfied as the lot has supported a single-family house in the past,there are two means of access, 400 there are existing utilities to the lot, and there are not more than one other pork-chop lots Page 9 of 12 City of Beverly Planning Board August 20, 2024 Meeting Minutes 401 contiguous to this lot. The applicants have reached out to all immediate abutters. After 402 discussions with the owners of 33 and 35 Paine Avenue, the applicant stated that they would 403 agree to a condition that driveway access to the subject lot would not come from the frontage on 404 Paine Avenue. The plan satisfies the Special Permit requirements, and the lot will adequately 405 support a single-family home. 406 407 Clawson stated that no City Department,commission or board have issued any comments on this 408 plan. 409 410 Hutchinson asked for public comment at this time. 411 412 Marcia Glassman-Jaffe of20 Paine Ave stated that she had concerns that she addressed with the 413 applicant team.
