There is a quorum of seated members. Bertoni reads the public notice regarding holding meetings remotely due to COVID-19. 2) Certificates of Compliance/Minor Modifications/Extensions/Tree Removals/Emergency Certifications a) Extensions to Orders of Condition i) New: 675E Hale Street,DEP File 45-1264 David Cowell of Hancock Associates is present and says the project entails repairs to a tide gate and that work has not yet begun. Redmond: Motion to extend the OOC for 675E Hale Street, DEP File 95-1264 to May 1, 2025 under the Wetlands Protection Act and the Beverly Wetlands Ordinance. The Commission discusses that there may be some leeway in the guideline stating the request be made 30 days prior to expiration. Charles seconds. Bertoni takes a roll call vote. Motion carries (4-0). ii) New: N-195 Cable Relocation,DEP File#5-1294 Robert Tyler of BSC Group is present and says the underground transmission line replacement project is ongoing and has been slowed by bedrock under the roadways. Duffy: Motion to extend the OOC for N-195 Cable Relocation, DEP File#5-1294 to May 11, 2025 under the Wetlands Protection Act and the Beverly Wetlands Ordinance. Charles seconds. Motion carries (4-0). iii) New: 163 & 167 West Street,DEP File#5-1323 Bob Griffin of Griffin Engineering is present and says the project is for the construction of a pier and more time is needed. Duffy: Motion to extend the OOC for 11 Cabot Street,DEP File 95-1327 to May 17, 2025 under the Wetlands Protection Act and the Beverly Wetlands Ordinance. Redmond seconds. Bertoni takes a roll call vote. Motion carries (4-0). b) Tree Removal Requests i) New: 6 Cavendish Square Property owner Jeffrey Williams is present and says that they have an OOC that was recently extended. Williams says four alder trees have grown in the area and are casting shade on the area where arborvitae are proposed to be planted,which was approved as part of the OOC. The Commission discusses that alder is a native species and Williams says that the alders are approximately three inches in diameter. Williams confirms the arborvitae have not yet been planted. The Commission discusses that the alder is a native tree and whether the arborvitae could be planted elsewhere on the site. Williams says an advantage of arborvitae is that it provides privacy. Williams proposes leaving the two alders that are closer to the water as a compromise. Charles observes that the Hazard Tree Removal process is not appropriate in this situation as the trees are not presenting any hazard to the property. Conservation Agent Spidaliere agrees to work with Williams and the landscaper to get this on a future agenda as a minor modification or Amendment to the currently open OOC. Motion carries (4-0). 3) Recess for Public Hearings 4) Notices of Intent/Abbreviated Notices of Intent/Requests for Amended Orders of Conditions a) Cont.: Multiple Addresses,DEP File#5-1409—City-wide Beach Management Plan— City of Beverly Spidaliere says that the Department of Public Services requested a continuation to the May 14, 2024 meeting. Redmond: Motion to continue the hearing to the May 14, 2024 meeting. Duffy seconds. Bertoni takes a roll call vote. Motion carries (4-0). b) Cont.: 342 Old Essex Road,DEP File #5-1414—After-the-fact filing for unpermitted retaining walls—Klaudio Boka Spidaliere says that the MassDEP file number took three months to be assigned. The DEP technical comments state that after-the-fact filings for walls along intermittent stream banks are not permissible. Property owner Klaudio Boka is present and says that he plans to consult with Spidaliere. Boka expresses concern about the current of the water being impacted or damaged by removing the wall himself. The Commission discusses that even if an afer-the-fact NOI were approved by the Commission, DEP would issue a superseding order based on the comments that DEP provided. The Commission discusses whether to continue the item so that Boka may compose a written plan. Redmond: Motion to continue the hearing to the May 14, 2024 meeting. Charles seconds. Bertoni takes a roll call vote. Motion carries (4-0). c) Cont.: 0 Trask Lane, DEP File #5-1407—ANRAD— Corcoran Trask Lane LLC c/o Peter Mahoney Peter Mahoney of John M. Corcoran and Co. and Dan Bailey of Pierce Atwood are present. Peter Ogren, Joseph Grillo, and Gordon Rogerson of Hayes Engineering are also present. Ogren presents the site plan. Ogren and Rogerson share the resource area boundaries and their buffer zones in 4 locations within the property that have all been delineated as 3 Bordering Vegetated Wetlands (BVW) and 1 Isolated Vegetated Wetland (IVW). The Commission agrees that the IVW is jurisdictional according to the ordinance. The Commission discusses the flagging of the C-series flags. C-32 was added to the plan where it was missing originally. The Commission discusses the flagging of the A-series flags. The Commission and Ogren agree that the approximate wetland line is elevation 98 and it will be added to the plan. Redmond asks why the applicant flagged a portion of the wetlands and not the entire area, and Ogren answers that the wetlands outside the project area were not flagged. The applicant will request an amendment to the ORAD to include the missed P-series flags. Bailey reminds the Chair that it is appropriate to open the item to public comment prior to voting. Lynne Malevich of 4 Duck Pond Road#210 is present and asks how the delineation will affect property abutting the condominiums at Cherry Hill, and Bertoni says there are no plans in front of the Commission today, as this matter is just for the delineation of the wetlands. Patrick Knight of 4 Duck Pond Road 9202 is present and says he feels that the Commission conducted a thorough investigation and expresses his gratitude for their efforts. Malevich says that there are many concerns about the development among the residents of the area and Mahoney answers that the developer is aware of the concerns and anticipates having many future conversations with neighbors. The Commission questions the applicant on the P-series flagging along Duck Pond as this was not walked as part of the site visit. Mahoney requests that the ORAD be issued for all of the flagging other than the P-series flagging along Duck Pond. Bertoni states that the applicant will need to request an amendment to their ORAD to be added back on the agenda to schedule a site visit to review the remaining P-series flags along Duck Pond. Motion carries (4-0). 7:11 p.m.: Squibb arrives. d) Cont.: 47 & 49 Thissell Street, DEP File 45-1413 —replace driveway culvert—Robert Polansky Property owner Robert Polansky is present. Bob Griffin of Griffin Engineering is present and shares the site plan. Griffin says there are now three areas of erosion so the updated plan includes an extension of the swale. Griffin points out trees on the site that will be removed and shares the mitigation planting list. The updated plan includes dimensions of the stone swale and infiltration trench. Duffy observes that Cardinal flower, included on the mitigation planting list, is not a bush. Griffin explains that the plant was included on the list at the request of the property owner. Bertoni asks if the replacement planting ratio is 1:1 and Griffin answers that the applicant is flexible. Berton observes that the species on the planting list are appropriate. Squibb abstains. e) Cont.: 19 Temi Road,DEP File #5-1417— construct an addition, patio, and landscape wall, install stormwater management system and utilities,reconstruct sun room, repair patio, and replace fence—Heather Chisholm Property owner Heather Chisholm is present. Engineer George Zambouras is present and shares the site plan. A revised plan was submitted with the following revisions based on the site walk: - Removal of shelving unit replaced with plantings. - Notation to install stabilization mats in areas of slope disturbance—(wall and patio removal areas and slope planting area). - Added slope stabilization mat detail. Squibb abstains. f) New: 17 Scenna Road,DEP File#5-1416—Construct a detached garage—Kevin Gallant Spidaliere reads the legal notice. Property owner Kevin Gallant is present. Bob Griffin of Griffin Engineering is present and says that the property owner lives in the house with his parents. Griffin shares the site map and aerial photos of the site. The planned garage will be located at the end of the existing driveway. The driveway is fairly level and lined by curbing. The planned garage dimensions are 24 feet by 30 feet and it will be within the 100-foot buffer zone. The two-car garage will be built on a concrete slab and will result in a decrease in impervious surface of approximately 49 square feet. 4 City of Beverly Conservation Commission April 23,2024 Meeting Minutes Page 5 of 11 Duffy asks where the roof runoff will be diverted, and Griffin answers that approximately half is piped off the back of the structure, and half is directed to the trench on the side. Bertoni asks what the ladder and staging pile located on the site plan is, and Griffin answers that it is made up of items from the owner's construction business. Griffin agrees that the owner will tidy and move the pile away from the adjacent property line. The Commission discusses the enhancement to habitat with Griffin. Redmond: Motion to close the hearing. Redmond: Motion to continue the RDA for 114 Livingstone Avenue to the May 14, 2024 meeting. Duffy seconds. Bertoni takes a roll call vote. Motion carries (4-0-1). Squibb abstains. b) Cont.: 9 Kennedy Drive—install an above-ground pool and patio—Michael Sabella Spidaliere says that he will reach out to the applicant again to get an update on this application. Squibb abstains. c) New: 16 Middlebury Lane—replace existing deck—Robert Gahan Spidaliere reads the legal notice. Property owner Robert Gahan is present and says the project is to replace the deck and stairs in-kind. Berton asks whether the four footings will be replaced and Gahan answers that the code has been updated since the initial construction of the house, so the new footings will comply with new codes. The stairs and the concrete slab need to be replaced. Bertoni asks if Gahan is amenable to working with Spidaliere on creating a GIS plan that shows the buffer to BVW to have on file and Gahan answers yes. Duffy asks if any vegetation will be disturbed, and Gahan answers no. 1. Erosion control devices shall be installed between the project area and the wetland resource area prior to construction. 2. All demolished materials, excavated soils, or other related debris shall be stored or stockpiled outside jurisdictional resource and buffer zone areas, if not immediately removed from the site and shall be appropriately disposed of off-site. 3. The use of timbers pressure treated with A.C.Q. (Alkaline Copper Quats) or the equivalent is permitted as construction material. Creosote treated timber is prohibited. Wood preservative must be dry before any treated wood is used in construction. 5. Hand tools shall be used for on-site assembly.No heavy construction equipment, gas powered tools, or vehicles are permitted. 6. Any damaged or displaced vegetation shall be replaced in-kind. Charles: Motion to issue a negative three determination under the Wetlands Protection Act and under the local ordinance with the conditions as discussed. Duffy seconds. Bertoni takes a roll call vote. Motion carries (5-0). d) New: 85 Boyles Street- addition to single-family house—John and Debbie Allen Spidaliere reads the legal notice. Property owner John Allen is present and says the project is for an addition to the primary bedroom at the rear of the house with a bathroom. Allen says the single-floor ranch was built in 1980 and he has been living there since then. The contractor is Meridian Construction and the addition will have Diamond Pier footings. The house has an existing dry well that will mitigate additional runoff from the new impervious surface. The Commission discusses the following conditions: 1. Any excavated materials/debris shall be removed and properly disposed of offsite. 2. Storage of construction materials shall be located on existing paved areas or outside the resource areas. 3. Erosion and sedimentation control devices shall be installed between the project area and the wetland resource area prior to construction. 4. All areas disturbed during construction shall be immediately stabilized against erosion and revegetated with appropriate fast growing erosion control species or local indigenous plants within thirty (30) days of final on-site grading. 5. Roof runoff shall be directed to the existing drywell. Paul Furnari of Meridian Construction is present and explains that Diamond Pier footings are comprised of a concrete footing with four pins that go into the ground up to 50 inches deep, at different angles. Redmond: Motion to issue a negative three determination under the Wetlands Protection Act and under the local ordinance with the conditions as discussed. Duffy seconds. Motion carries (5-0). 7) Enforcement Matters/Potential Violations a) Enforcement Matters i) Cont.: 342 Old Essex Road The Commission discusses that considering the DEP comments, it is will likely be appropriate to issue an amended Enforcement Order. The Commission discusses continuing this item to the May14, 2024 meeting to give the property owner time to work on a plan. ii) Cont.: 43 Wood Lane 6 City of Beverly Conservation Commission April 23,2024 Meeting Minutes Page 7 of 11 Spidaliere says that the OOC was recorded at the Registry of Deeds. Redmond: Motion to lift the Enforcement Order for 43 Wood lane. Duffy seconds. Bertoni takes a roll call vote. Motion carries (5-0). iii) Cont.: 345 Hale Street Michael DeRosa of DeRosa Environmental, Engineer George Zamboras, and property owner Brad Paul are present. DeRosa shares the site plan and summarizes that he conducted a site visit with Paul and Zambouras. DeRosa says that he researched the history of the site and its preexisting conditions prior to his visit. Zambouras provided grading measurements to DeRosa. DeRosa shares the planting plan and the species list. Paul agrees that August 13, 2024 is an appropriate goal to have the restoration completed. The Commission discusses that the conditions will include the 75% survivability rate over two years for the restoration plantings. Redmond: Motion to approve the restoration plan as prepared by DeRosa Environmental to be implemented by August 13, 2024 and to be addressed at the August 27, 2024 meeting. Duffy seconds. Motion carries (5-0). iv) Cont.: 11 & 13 Bayview Avenue Bob Griffin of Griffin Engineering is present and says that he conducted a site visit with Conservation Field Inspector White to confirm that the rocks have all been removed. Bertoni clarifies that the rocks were mortared together and Griffin concedes that is true. Griffin shares the restoration plan and says the tree at the top of the stone steps will be preserved. The project includes a masonry wall in front of the tree to allow the build-up of soil to protect the tree. Bertoni points out the restoration is intended to be for the removal of the unpermitted stone wall and restoration of the area, yet this proposed plan includes extra items such as masonry repair and a dune mat. Griffin clarifies that the work is above mean high water and that prior to the storm, the area was a lawn with some chairs on it. Duffy asks if the Coastal Dune is vegetated, and Griffin says the plan includes replanting the vegetation up to the location of the posts. Griffin says that the dune mat protects the site from pedestrian traffic, and the property owner has the right to access the water from the property. Redmond asks why the work is not part of an NOI and Griffin says he feels it is appropriate to include in the restoration plan. The Commission discusses that the purpose of a restoration plan is to restore the site to the conditions prior to the unpermitted activity. The Commission discusses that it is not appropriate to include the mat and wall repairs as part of the restoration as it is not pertinent to what the Enforcement Order requested. The Commission discusses that it is not appropriate to place a mat in this VE Zone. The Commission discusses that the property owners are required to attend the meeting as directed in the Enforcement Order yet they are not present. Alison Harrington of 7 Bayview Avenue is present and asks if the proposed wall will impact the flow of the stream and Bertoni answers that the wall is not near the stream. 7 City of Beverly Conservation Commission April 23,2024 Meeting Minutes Page 8 of 11 Griffin agrees to revise and resubmit the plan incorporating the Commission's comments, which excludes all masonry work and the dune mat. Redmond: Motion to amend the Enforcement Order for the violator to submit a revised restoration plan by May 7, 2024, to be discussed at the May 14, 2024 meeting. Charles seconds. Spidaliere says that the City Solicitor advised that if the Commission chooses,it may impose fines of $100 per day from April 9, 2024 through April 19, 2024. The Commission discusses that it is appropriate in light of Kellogg actively misleading the Commission, misleading the Agent, and not complying with the original Enforcement Order. Redmond: Motion to impose fines of$100 per day from April 9, 2024, through April 19, 2024,totaling $1,000. Duffy seconds. Bertoni takes a roll call vote. Motion carries (4-0-1). Squibb abstains. 8) Old/New/Other Business a) Other: Discussion or Action Items Related to Commission Business, Correspondence, etc. Received/Issued After Publication of Agenda,If Any i) Comments on MassDEP's Resilience 1.0 Draft Regulations and 2.0 recommendations The Commission agrees to read the document and submit comments to Spidaliere by April 29, 2024, to forward to MassDEP. ii) Con Com representative for City's Hazard Mitigation Plan Spidaliere summarizes that the Engineering Department updates the City's Hazard Mitigation Plan every five years and Bertoni agrees to represent the Commission. iii) Commission meeting scheduling The members discuss upcoming meeting dates. iv) McPherson Youth Center site visit A site visit is scheduled for Thursday, May 2, 2024, at 4 p.m. 9) Orders of conditions,if any a) 0 Trask Lane,DEP File #5-1407—ANRAD— Corcoran Trask Lane LLC c/o Peter Mahoney The Commission discusses the following findings: 1. The WF A-Series flagging from flags A-1 through A-15 is confirmed as Bordering Vegetated Wetland(BVW); 2. The WF C-Series flagging from flags C-23 through C-54 is confirmed as Bordering Vegetated Wetland(BVW); 3. The WF flagging without a lettering series from 17 through 42 is confirmed as Bordering Vegetated Wetland(BVW); 4. The WF P-Series flagging from P-1 through P-13 is confirmed as Isolated Vegetated Wetland (IVW); 8 City of Beverly Conservation Commission April 23,2024 Meeting Minutes Page 9 of 11 5. The above described IVW is protected under the local Beverly Ordinance (Chapter 565-9); 6. Multiple members of the Beverly Conservation Commission were on-site to review and confirm the validity of the above described BVW and IVW flags; 7. A 100-Foot Buffer Zone extends from the above described BVW and IVW flags; 8. The WF P-Series flagging from flags P-1 through P-10 along Duck Pond was not confirmed as these were not visited during the site walk. This will require an Amendment to the ORAD if the applicant would like these flags to be confirmed. 9. The Commission's determination confirms only the requested delineations and is not inclusive of the entire—76 acre parcel. Prior to construction, erosion controls shall be installed along the upstream and downstream limits of the work area. The Conservation Agent shall inspect the location of erosion controls. 2. Erosion controls shall be inspected daily, and maintained or reinforced if necessary. After any storm event, any accumulated silt adjacent to the barriers shall be removed. 3. All demolition materials, excavated soils, or other related debris that are not used for backfill shall be immediately removed from the site for appropriate disposal. No asphalt may be used as backfill. 4. Vegetated areas temporarily disturbed by construction activities shall be re-seeded with an appropriate seed mix. 5. During the work, any storage of equipment shall be located on existing paved areas or as far from the wetland resource areas as possible. 6. When mechanical equipment is being used, contractors shall keep hazardous material spill containment kits on-site in case of a release of oil, gasoline, or other toxic substances. 7. All vegetation slated for cutting shall be flush cut to grade and root systems and stumps to be left intact. 8. Tree removals shall be conducted via hand tools and/or all heavy equipment shall be operated from paved surfaces only. All demolished materials, excavated soils, or other related debris shall be stored or stockpiled outside jurisdictional resource and buffer zone areas, if not immediately removed from the site and shall be removed and appropriately disposed of off-site. 2. Storage of construction materials shall be located on existing paved areas or outside the resource areas. 3. Erosion controls shall be installed between the work area and the wetland resource,prior to the start of construction. 4. During construction, disturbed soils are to be re-stabilized and re-vegetated as soon as possible. 5. The mitigation plants depicted on the approved site plan shall exhibit at least 75% overall survivorship after two growing seasons post installation and shall be verified by the Conservation Agent. 6. Annual monitoring reports of the native plantings outlined in Special Condition 95 above shall be provided to the Conservation Agent at the end of the growing season, for a minimum of two growing seasons. 7. At least two weather resistant signs or monuments,not less than 2-feet in height, shall be installed at the edge of the 25-Foot No Disturbance Zone, bearing the following language on their upland side: "Protected Wetland Resource Area: No Disturbance Beyond This Point Per Order of Beverly Conservation Commission." 8. The markers described in Special Condition 97 above shall be kept in good repair and replaced as necessary. This condition shall survive as an on-going condition beyond the issuance of a Certificate of Compliance. Duffy: Motion to issue the OOC for 19 Temi Road, DEP File #5-1417 under the Wetlands Protection Act and under the local ordinance with the conditions as discussed with standard perpetual conditions.
