Subdivision Approval Not Required Plans a. none at this time Request for Modification: OSRD #11-18 and Definitive Subdivision Plan for Thaxton Heights—Michael McNiff Bob Griffin of Griffin Engineering is on call to discuss the subdivision plan related to minor building location and drainage changes to Lots 1 and 2. Lot 3 is not included. He provides project schematics on screen and summarizes how the layouts have changed on each lot. He invites questions from the Board. Hutchinson asks for clarification on changes to the impervious surface and the addition of the dry well. Beckwith asks about the distance of the new building plan to the track buffer. He asks that the Board make corrections to the typo in the square foot totals for the proposed house. Beckwith: Motion to deem the modification to Site Plan OSRD 9 11-18 at Thaxton Heights as minor in nature. Flannery seconds. Hutchinson takes a roll-call vote. The motion carries 5-0. Beckwith: Motion to approve the modification to Site Plan OSRD#11-18 at Thaxton Heights. Craft seconds. Hutchinson takes a roll-call vote. The motion carries 5-0. Request for Modification: Site Plan#141-99— 108 Bridge Street—David Cutler Thomas Alexander, attorney for the property owner, is on call to discuss the modification request. He summarizes the proposed changes and invites questions from Board members. Beckwith asks about the retaining walls from George Zambouras, site engineer. Beckwith asks about drainage from the retaining wall. Beckwith and Hutchinson ask about the location of the retaining wall on either 108 or 106 Bridge Street. Mr. Alexander says that there was a retaining wall at that location and they have moved its location just slightly. Hutchinson is not sure how to authorize the building of a concrete wall that is on someone else's property. Mr. Zambouras answers that both properties are owned by the same owners. Mr. Alexander says that because the owner is the same for both properties, there is no issue of trespassing. Beckwith asks about the removal of the privacy fences between the unit patios. Request for Modification: Site Plan# 124-16— 62 Dunham Road/64 Dunham Road— Iron Tree Services c/o John Maestranzi John Maestranzi is on call to discuss the project as the applicant and summarizes the request. He solicits questions from the Board. Flannery would like to know how long the trailers would be on the site. Mr. Maestranzi replies that their timeline would probably be in the vicinity of five years and notes they are called"temporary" because of how they are installed on a site, without foundations. Beckwith asks about parking on the site and the general layout or flow of the site. Hutchinson is concerned that they will set a precedent and potentially allow misuse of the minor modification statute. Beckwith asks whether they could condition an approval such that no additional trailers would be added. Members discuss a condition based on a percentage of the current square footage of the property. Craft: Motion to deem the modification to Site Plan # 124-16 at 62/64 Dunham Road as minor in nature. Craft seconds. Hutchinson takes a roll-call vote. The motion carries 5-0. Beckwith: Motion to approve the modification request to Site Plan # 124-16 at 62/64 Dunham Road with the condition that any additional buildings or structures, exceeding 5,490 sq. ft. in total, representing 30% of the existing square feet of building space, including this addition, must be brought before the Planning Board for approval. Flannery seconds. Hutchinson takes a roll-call vote. The motion carries 5-0. Endorse Definitive Subdivision Plan (without Covenant) and 81X Certificate—R65 West Street (63 West Street)—Evan Wile,West Street Realty Trust Sander Rikleen, attorney for the applicant, and Evan Wile, owner, are present on call to discuss the application. Rikleen summarizes the requests and the legal history of the site and subdivision approval. He explains that a Form G Covenant or Performance Bond are not necessary because the roadway is already constructed. Craft asks Wynne if they must rule on the Covenant separately. Wynne answers yes. Hutchinson asks about the abeyance. Flannery: Motion to endorse the Definitive Subdivision Plan without a Covenant or performance bond—R65 West Street(63 West Street)—Evan Wile, West Street Realty Trust, as presented. Beckwith seconds. Hutchinson takes a roll-call vote. The motion carries 5-0. Flannery: Motion to approve 81X Certificate indicating the plan has not changed since previously approved despite the elapsed time greater than 6 months —R65 West Street(63 West Street)—Evan Wile, West Street Realty Trust, Beverly Planning Board May 17,2022 Meeting Minutes Page 3 of 3 with affirmation that the plan has not changed. Beckwith seconds. Hutchinson takes a roll-call vote. The motion carries 5-0. Set Public Hearings Prior to setting public hearing, the Board took out of order the discussion of rescheduling the June meeting. Board agreed to reschedule the meeting from Wednesday June 22, 2022 to Tuesday June 21, 2022, because the City Council is not meeting that day, which aligns with the Board's regular schedule. a. Definitive Subdivision Plan—Trask Lane—Folly Hill Associates Trust Wynne provides a status update on this project and the legal status of the appeal. Hutchinson asks if they should hold a public hearing, which members discuss. Beckwith: Motion to schedule a public hearing for the Definitive Subdivision Plan at the Board's meeting on June 21, 2022 — Trask Lane—Folly Hill Associates Trust for June 21, 2022. Craft seconds. Hutchinson takes a roll- call vote. The motion carries 5-0. Approval of Minutes a. April 26,2022 The approval of minutes will be deferred until the next meeting as they were not available to all members.
