04.05.2022 BPB Minutes Final Beverly Planning Board April 5,2022 Meeting Minutes Page 1 of 5 CITY OF BEVERLY PUBLIC MEETING MINUTES BOARD OR COMMISSION: Beverly Planning Board DATE and TIME: April 5, 2022; 7:00 p.m. LOCATION: Virtual Meeting via Google Meet MEMBERS PRESENT: Chairperson Ellen Hutchinson, Sarah Bartley, Derek Beckwith, Ellen Flannery, Wayne Miller, Rodney Sinclair, Andrea Toulouse MEMBERS ABSENT: Vice-Chair Alexander Craft OTHERS PRESENT: Assistant Planning Director Emily Hutchings RECORDER: Stacia Chamberlain Call to Order Chairperson Hutchinson calls the meeting to order at 7:03 p.m. and reads a prepared statement introducing the meeting and noting the authority to hold a remote meeting. Miller, Sinclair, and Craft are not present when the meeting is called to order. Subdivision Approval Not Required Plans a. 573 Hale Street & 9 Avalon Avenue: Christopher B. Loring, Ellen G. Loring and Jonathan B. Loring Hutchings states she has been informed that changes need to be made to this plan. In order to provide time for the applicants to submit a revised plan she has recommended that the applicant ask to continue this item to the next meeting. She states the applicant's representative, who is not present, has agreed and requested a continuance. Beckwith: Moves to continue this item to the April 26, 2022 meeting. Flannery seconds. Hutchinson takes a roll-call vote. The motion carries 5-0. Flannery: Moves to open public hearings. Beckwith seconds. Hutchinson takes a roll-call vote. The motion carries 5-0. Continued Public Hearing: Site Plan Review #153-22— 105 Sam Fonzo Drive, 10 LP Henderson Road—Thomas Ford Tom Ford, the property owner,introduces the project team, including Richard Salvo, civil engineer; James Emmanuel, landscape architect; Mark Schryver, principal architect; and Brandon Purrington, contractor, who are on call to discuss the project. Mr. Ford summarizes findings and discussions they have had with other committees regarding this project. Mr. Ford invites questions from Board members. Wayne Miller enters the meeting at 7:12 p.m. Beckwith asks Mr. Ford roughly how much fill will be brought in and how it will change the elevation or grade of the building on the land. Mr. Salvo refers to the project schematic presented on the screen to explain the proposed changes to grading. He confirms there will be an increase in the grade of over 10 feet. Beverly Planning Board April 5,2022 Meeting Minutes Page 2 of 5 Rodney Sinclair enters the meeting at 7:19 p.m. Beckwith asks Mr. Salvo to illustrate the sightline that neighbors will have of the property including landscaping and the building. Mr. Emmanuel uses the property schematic to provide details of the landscaping. Beckwith asks what type of additional landscape screening will be used for the Trask Street residents. Mr. Ford replies that this area of the property has protected wetlands on it and would not be suitable for plantings in the area where Beckwith is indicating. Members and the applicants review the area and consider which property owners will be most impacted by the building, visually. Mr. Ford says that while conducting public engagement with property owners, they did not get many requests for additional landscaping for screening of the building, and what was proposed appeared to be sufficient. Hutchinson asks for clarification on the designation of the building, and notes that in documents it is designated as both a warehouse and a manufacturing facility. Mr. Ford says that it's more of a warehouse although Axcelis will likely do some finishing of assembly before delivery. Flannery asks about the final locations for the pedestrian crossings. Mr. Ford reviews the locations and states they will comply with the recommendations of the Parking and Traffic Commission. Beckwith asks Hutchings about the comments made by Eric Barber, City Engineer. Hutchings clarifies that while Mr. Barber has made specific comments about the plan and has recommended certain conditions of approval, he is comfortable with the Planning Board approving the plan. If those conditions are incorporated into the Planning Board's decision, they will need to be met prior to the approval of building permits. Hutchinson asks Hutchings to summarize the Parking and Traffic Commission letter, dated April 5, 2022, as well as the Conservation Commission comments, for the public. Hutchings reviews the comments and states that all three organizations have reviewed the application and stated that they recommend approval and/or their issues have been addressed to their satisfaction. Hutchinson asks Mr. Ford if they plan to comply with the Orders of Conditions for this project as set forth by the Conservation Commission;he replies that they plan to do so. Beckwith states he is concerned with the decibel increase in ambient noise that could be generated on site by the HVAC system, and that the system would be audible by the neighbors. He asks if they expect the decibel count to meet local regulatory standards. Mr. Ford replies that they are currently sizing the HVAC units and have yet to solidify their engineering plans. Mr. Purrington says that any consideration for reducing decibels, including screening and insulation of the HVAC units, will be made. Hutchinson invites comments from the public. Michael Petkavich, 60 Trask Street: Mr. Petkavich thanks the Board for their work, and the applicants for addressing the landscaping and noise. Margaret Vernon, 56 Trask Street: Ms. Vernon thanks Mr. Ford for his diligence in this project. Mrs. Vernon states her concern about the height of the building, which she had not realized would be increased due to the grading and fill, and says that she would greatly appreciate it if the applicant would plant additional landscaping screening on her property. Mr. Ford replies that he is happy to go to the property with Mr. Emmanuel and make any adjustments necessary. Beverly Planning Board April 5,2022 Meeting Minutes Page 3 of 5 Linda Briggs, 54 Trask Street: Ms. Briggs states her concerns about the visual impact of the building and requests that Mr. Ford come to her property to discuss sightlines and landscaping in greater depth. Mr. Ford replies that he would be glad to visit with the neighbors. Miller recommends hoisting balloons up to the sight line for neighbors to determine what the visual impact would be in terms of building height. Ms. Vernon speaks again and asks to confirm that Mr. Ford would come to her property for a landscaping discussion. Mr. Ford states that he will reach out to all the neighbors for a relevant site visit. There being no further comments from the public nor the Board, Hutchinson asks Board members if they would like to close the hearing now or wait until the next meeting to hear if Mr. Ford has made progress with neighbors in terms of landscaping. Beckwith states he would like to keep the hearing open and continue the matter to their next meeting. Flannery supports keeping the hearing open until the April 26, 2022 meeting. Request for Modification: Site Plan#141-99— 108 Bridte Street—David Cutler David Cutler is on call to discuss the application. Hutchings provides the project schematic on screen and Mr. Cutler presents the as-built plans and the minor modification requests. He explains the main modifications relate to the landscaping and elevations. He explains that due to a shallow ledge on the property it was not possible to plant as many perennials and trees as they had planned. He also outlines how several architectural details had to be changed, including the placement of windows. He presents a letter from an attorney describing the easement for the condominiums to use portions of the property at 106 Bridge Street. He invites questions from the Board. Hutchinson expresses her disapproval of the manner of his conduct, in that he is coming to the Board after making changes rather than before. She also asks why the wooden fences installed in the rear of the site were not included in the modification application. She invites comments and questions from other Board members. Beckwith asks whether there were patios in the approved plan. Miller asks for clarification on what specifically they did without approval. Mr. Cutler states that there were patios built, and each such patio was placed several feet into the adjacent property. He reviews the landscaping in greater detail and reviews photographs of the site. Flannery says that in her opinion, the easement aspect of the application deems the request to be not minor. Hutchinson states that she agrees the proposal constitutes a major modification and for the application should be considered in a public hearing. Beckwith and Flannery concur. Hutchings provides an overview of the initial application and modifications that were submitted. Beckwith seconds. Hutchinson takes a roll-call vote. The motion carries 7-0. Approval of Minutes a. March 15,2022 Board members review the minutes and have offered comments and/or corrections. Beckwith: Motion to approve the minutes from the meeting on March 15, 2022, as amended. Sinclair seconds. Hutchinson takes a roll-call vote. The motion carries 7-0. Other /New business a. Hutchings lets the Board know that she has submitted her resignation to the City of Beverly, with her last day working for the City being April 15, 2022. b. Members discuss whether or not to meet in person for the April 26, 2022 meeting. Hutchinson favors a remote meeting. All members concur. Hutchings confirms that a vote is not required to allow the meeting to be virtual. Adiournment Toulouse: Motion to adjourn at 9:30 p.m. Flannery seconds. The motion carries 7-0.
