A public hearing was held on Tuesday, January 27, 1998 at 7:00 p.m.
at City Hall, Beverly, Massachusetts, a notice of said hearing
having been duly advertised in the Salem Evening News, a newspaper
having a circulation in said Beverly, and the required persons
having been duly notified by mail of'the time and place of said
hearing concerning the application of Kristin L. Bucci in a
petition for a request for a variance to encroach 10' plus or minus
into the required 15' side yard setback with a 24'x24' two story
addition containing two car garage with two bedrooms and one bath
above. Property located 7 Rezza Road in an R-15 Zone.
The Hearing was called to order at 7:00 p.m. by the Chairperson,
Day Ann Kelley. The following members were present:

The Building Commissioner, Timothy Brennan, exhibited plans
relative to the application describing the location and zoning of
the property.
David Bucci appeared be~re the Board to explain his plans to add
a two car garage and two bedroom addition to his property.
No one else spoke in favor or opposition.
Leonard Bertaux asked if there were any other ways to sight the
addition. Margaret O'Brien askedif the neighbors were informed by
Mr. Bucci. Robert McLemore was concerned about the brook and the
right- of- way next to the property.
Mr. Bucci explained that the right- of- way was actually where the
brook is and that the road was farther over, not directly next to
his property line.
Day Ann Kelley asked if Mr. Bucci had a problem with flooding from
the brook which would limit his options and could create a
hardship. Mr. Bucci said no, although the brook did flood in the
October 1996 storm.
The basic concerns of the Board were the size of the addition and
the fact that it encroached within 4ft. of the property line. The
size of the lot is 20,800 s.f. in an R-15 Zone, so there appears to
be plenty of land available for an addition.
Mr. Bucci was given the option of continuing the hearing until next

month. This will give him time to review his plans and see how
they can be revised. An architect might be able to provide other
options.
Mr. Bucci signed a waiver of the time limitation on the Board of
Appeals vote.
The Board of Appeals then voted to postpone their decision until
the February 24, 1998 meeting-
